ARTICLE I <br /> Definitions <br /> Section 1.1. Definitions. In this Agreement, unless a different meaning clearly appears <br /> from the context: <br /> "Agreement" means this Agreement, as the same may be from time to time modified, <br /> amended, or supplemented. <br /> "Assessments means the assessments to be levied against the Property pursuant to Section <br /> 3.8 of this Agreement. <br /> "Business Subsidy Agreement" means the agreement in the form of Schedule B to this <br /> Agreement to be .executed by the City and the Developer pursuant to Section 3.9 of this <br /> Agreement as required pursuant to Minnesota Statutes, sections 1167.993 to 1167.995. <br /> "City" means the City of Hastings,Minnesota. <br /> "Construction Credit" means the credit to be given to the Developer against the <br /> Developer's obligations to pay the Assessments calculated as provided in Section 3.8 of this <br /> Agreement. <br /> "Construction Plans" means the plans, specifications, drawings and related documents on <br /> the construction work to be performed by the Developer on the Property which shall be at least <br /> as detailed as the plans to be submitted to the building inspector of the City and shall include <br /> such supplemental information as the City may require. <br /> "County" means Dakota County,Minnesota. <br /> "Developer" means, collectively, Lloyd Lodewegen and Susan Lodewegen, a married <br /> couple, their representatives and assigns, and any future owners of any interest in the Property. <br /> "Event of Default" means an action listed in Section 9.1 of this Agreement. <br /> "Hazardous Substances" means asbestos, urea formaldehyde, polychlorinated biphenyls, <br /> nuclear fuel or materials, chemical waste, radioactive materials, explosives, known carcinogens, <br /> petroleum products and also all dangerous, toxic or hazardous pollutants, contaminates, <br /> chemicals, materials or substances defined as hazardous or as a pollutant or contaminant in, or <br /> the release or disposal of which is regulated by, any Laws or Regulations, as hereafter defined. <br /> Laws or Regulations mean and include the Comprehensive Environmental Response and <br /> Liability Act ("CERCLA" or the Federal Superfimd Act) as amended by the Superfund <br /> Amendments and Reauthorization Act of 1986 ("SARA") 42 U.S.C. 9601-9675; The Federal <br /> Resource Conservation and Recovery Act of 1986 ("RCRX); the Clean Water Act, 33 U.S.C. <br /> 1321, et seq.;the Clean Air Act 42 U.S.C. 7401, et seq., all as the same may be from time to time <br /> amended, and any other federal, state, county, municipal, local or other statute, law ordinance or <br /> 2 <br />
