Minutes of the Regular Meeting of October 6, 2003 Page 2 of 4 <br /> <br />Copy <br /> <br /> Approve Massage Establishment LicensemNuWave Hair Design <br /> Authorize Assessment Agreement for Sanitary Sewer Service Repairm109 6th <br /> Street East <br /> Schedule Special City Council Meeting for Developer Interviews for Downtown <br /> Redevelopment Project--Monday, October 13, 2003 at 6:00 p.m. <br />of resolutions on file. <br /> <br /> Public Hearing--Amend City Code Chapter 3 Allowing Licensed <br />Establishments to be Open until 2 a.m. <br />Mayor Werner opened the public hearing at 7:02 p.m. <br />Administrative Assistant/City Clerk Mesko Lee outlined staff's <br />recommendation, as recommended by the Public Safety Committee, that the Council <br />approve a 2 a.m. closing time, with no additional City fee to be charged and for <br />licensees to notify the City Clerk when application for a 2 a.m. license is made to the <br />State of Minnesota <br /> Hearing no further public comment, Mayor Werner closed the public hearing at <br />7:03 p.m. <br /> <br /> Ordinance Amendment--Amend City Code Chapter 3 Allowing Licensed <br />£stablishments to be Open until 2 a.m. <br /> Councilmember Yandrasits questioned whether this change would negatively <br />impact the police department. Mesko Lee stated that Police Chief McMenomy has <br />indicated that there is anticipated that there would be no additional impact, as the <br />patrol schedule is already set to accommodate Wisconsin's 2 a.m. closing time. <br />Yandrasits also questioned whether the City could or should approve a 2 a.m. closing <br />time for weekends only. Councilmember Hicks stated that the Public Safety <br />Committee reviewed that issue and recommended no limit on what day a licensed <br />establishment could remain open until 2:00 a.m. Councilmember Yandrasits stated <br />her opposition to the ordinance amendment as recommended and suggested that the <br />Council review the impact of this change in six months. <br /> Moved by Councilmember Hicks, seconded by Councilmember Hazlet to <br />approve the code amendment and to revisit the issue in six months. <br />6 Ayes; Nays, one, Councilmember Yandrasits voting against. <br /> <br />Public Hearing--Comprehensive Plan Amendment and Rezoning #2003-62: <br />Basic Builders (Tiffany and Highway 316) <br /> Mayor Werner opened the public hearing at 7:10 p.m. <br /> Hinzman stated staff's recommendation for approval. <br /> Hearing no further public comment, Mayor Werner closed the public hearing at <br />7:11 p.m. <br /> <br />Second Reading/Ordinance Plan Amendment/Resolution--Comprehensive <br />Plan Amendment and Rezoning #2003-62: Basic Builders (Tiffany and Highway <br />3'16) <br /> Moved by Councilmember Moratzka, seconded by Councilmember Schultz to <br />approve the comprehensive plan amendment and the rezoning as presented. <br /> <br /> <br />
