VIII-C-1 <br /> <br />To: <br />From: <br />Date: <br />Re: <br /> <br />MEMORANDUM <br /> <br />Mayor Werner & City Councilmembers <br />Melanie Mesko Lee, Administrative Assistant/City Clerk <br />January 14, 2004 <br />Suspension of liquor licenses for non-payment of fees <br /> <br />Council Action Requested: <br />Consider suspension of the liquor licenses for RJ's, and The Levee for non-payment of liquor <br />license fees. <br /> <br />Background Information: <br />The City of Hastings invoices liquor licensees twice a year for payment of their on-sale liquor license <br />fee (all other licensefees are paid at time of renewal). For the 2003/2004 liquor license year, the <br />annual fee is $3,400 (Resolution 07-04-03). $1,700 is invoiced at time of renewal and the other <br />$1,700 is invoiced in December. On December 5, the City sent out an invoice to all on-sale liquor <br />licensees for the second % of the 2003/2004 on-sale fee'. The due date for that was December 25, <br />2003. Payments not received by December 26 (due to City Hall being closed on the 25th) were then <br />invoiced again, with a 10% penalty applied for late payment (Ordinance No. 492). The second <br />invoice was sent out January 2, 2004, with a due date of January 12, 2004 for $1,870 ($1,700 + <br />$170 = $1,870). <br /> <br />At the end of business on January 12, 2004, RJ's and The Levee had not paid the liquor license fee <br />nor the penalty. Therefore, staff recommends that the Council consider suspension of each of <br />these licenses until the amount due is paid in full. Each of these businesses were sent a letter on <br />January 13, 2004 explaining to them that Council will be considering license suspension at the <br />meeting on January 20, 2004 (attached) and inviting them to attend. <br /> <br />At the time the memo is being written, payments have still not been received; should any payments <br />come in before the meeting on January 20, staff will forward that information to the Council for their <br />consideration in this matter, <br /> <br />If you have any questions, please do not hesitate to contact me. <br /> <br /> <br />
