HASTTNGS <br /> <br />POLI'CE DEPARTMENT <br /> <br />V! !0 <br /> <br />MEMO <br /> <br />TO: <br /> <br />FROM: <br />DATE: <br />SUBJECT: <br /> <br />Mayor Mike Werner <br />Hastings City Council Members <br />Chief McMenomy <br />January 9, 2004 <br />Consent Agenda Item -Abandoned Property/Money to DARE Program <br /> <br />This memo is to request council approval for the disbursement of abandoned property, which <br />in this case is money to be allocated to the Hastings Police Department DARE Program <br />account. <br /> <br />In 1997 officers in this department stopped a vehicle for a theft "dine and dash" offense from <br />Kentucky Fried Chicken. Three subjects were inside the vehicle and in the vehicle was found <br />a loaded handgun and packages of marijuana. Money was seized from two of the individuals <br />in the vehicle. The money was taken as part of possible illegal drug sales and activity, and <br />the handgun was also seized. The driver of the vehicle was charged and did plead guilty to <br />the marijuana offense. There was a total of $960.00 taken from the two individuals in the <br />vehicle who were in the area of the found marijuana and handgun. They claimed the money <br />was from a cashed welfare check they had' received. They were advised at that time that the <br />money would be returned to them if they could provide proof that the money was from a <br />welfare check by showing us documentation that they did indeed have a welfare check <br />receipt. They never did provide any such receipt or proof that the money was from their <br />welfare check and a letter was later sent out to them advising them that if they did not provide <br />a claim to this money with receipts the money and handgun would be considered abandoned <br />property and belong to the City of Hastings. We have never received a response from them <br />in regards to this property. <br /> <br />I am requesting that this money be declared abandoned property by the City and <br />subsequently allocated to be put into our police department DARE account, as we believe this <br />money was from possible drug sales, and as you know we did cut some of our 2004 DARE <br />budget. This money can be used to supplement the 2004 DARE budget and DARE <br />expenses. <br /> <br />If you have any questions regarding this request please do not hesitate to contact me.
