The <br />existing home is a legal non-conforming use. <br /> <br />RECOMMENDATION <br /> <br />Approval is recommended. The home was constructed well before any zoning regulations <br />were in place, and the addition is in line with the existing sides of the home. The proposed <br />addition itself meets all required setbacks. <br /> <br />The variance is required due to the fact that the current front yard setback is approximately <br />8' - 10'. The Zoning Code states that a non-conforming structure may not be enlarged, <br />thus a variance is required in order for any construction to take place. <br /> <br />Planning Commission Review <br />The Planning Commission reviewed this item at their June 9, 2003 meeting. They <br />unanimously (5-0) recommended approval of the variance, based on the fact that the home <br />was built prior to the adoption of zoning regulations, and the new addition would not <br />encroach into the required setback. <br /> <br />Heritage Preservation Candidate <br />An application has been submitted to have the home added to the local Heritage <br />Preservation List.
