To R-3 PRD <br />Moved by Councilmember Simacek, seconded by Councilmember Yandrasits, to approve <br />the 2nd Reading of the Rezoning from Agricultural to R-3 PRD. <br />7 Ayes; Nays, None. <br /> <br />Summit Point Final Plat- -Res t'Ío, 12..-tO.q~ <br />Moved by Councilmember Riveness, seconded by Councilmember Hicks, to approve the <br />Summit Point Final Plat with conditions as listed below: <br />1. Rezoning of the subject property from Agriculture to R-3 PRD. <br />2. The applicant be required to identify drainage and utility easements or provide <br />documentation that the common open spaces will be used as drainage and utility easements <br />subject to the Public Works Director's approval. <br />That the Developer shall pay cash in lieu of land to meet park dedication requirements at the <br />rate which has been established by the City council at the time of final plat approval. The <br />per residential unit cash in lieu of land requirement may be paid at the time of building <br />permit issuance for each residential unit at the established rate set at that time by City <br />Council (currently $850.00). <br />That proposed street names be changed. Summit Point Drive must continue through to the <br />northeast. <br />That the applicant shall pay $20,590 for the proposed 71 units in Interceptor Sewer Fees <br />prior to City release of final plat hardshells. <br />That the Developer shall obtain Site Plan approval from the City prior to issuance of any <br />building permits. <br />That the developer shall construct a temporary 20 ft. Wide gravel drive as part of Phase one, <br />connecting to Featherstone Road. <br />The applicant shall provide evidence of an easement for storm water outfall in the Oakwood <br />Cemetery Ravine. <br />That reference shall be made in the Development Agreement to the two phases of <br />development and the requirements required for both phases. <br />That reference shall be made in the Development Agreement that the Developer must <br />provide evidence to the City that common areas including the proposed cul-de-sac island and <br />ponding areas will be maintained by a homeowner's association prior to issuance of any <br />building permits for residential construction. <br />That the Developer shall enter into a Development Agreement with the City to memorialize <br />conditions of preliminary/final plat approval and that the executed Agreement shall be <br />recorded against the subject property prior to issuance of any grading and/or building <br />permits. <br />Moved by Mayor Werner, seconded by Councilmember Hicks, to amend the previous motion <br />to specifically identify that the development homeowners association shall be responsible for <br />maintaining the drainage ditch easement that must be provided for the storm water outfall in the <br />Oakwood Cemetery refrained, as identified in condition #8, above. <br />7 Ayes; Nays, None. <br />After approval of the amendment, the Mayor called for the vote on the original motion to <br />approve the final plat as amended. <br />7 Ayes; Nays, None. <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />6. <br /> <br />7. <br /> <br />8. <br /> <br />9. <br /> <br />10. <br /> <br />11. <br />
