<br />City of Hastings <br />Charter Resolution No. 2010- <br /> <br />Resolution of the Charter Commission of the City of Hastings <br />Recommending Changes in the Hastings City Charter <br />Section 3.06: Mayor-Law Enforcement and Recommending <br />This Amendment be Enacted by Ordinance of the <br />Hastings City Council <br /> <br /> <br />Date: February 18, 2010 <br /> <br /> Commissioner introduced the following resolution and <br />moved its adoption: <br /> <br />Whereas, <br /> the present Hastings City Charter Section 3.06: Mayor-Law <br />Enforcement provides that the Mayor is the head of the Police Department and the Police <br />Chief reports to the Mayor; and <br /> <br />Whereas, <br /> the present Hastings City Charter Section 3.10: The City Administrator <br />and Section 3.11: Powers and Duties of the City Administrator provide that the City <br />Administrator shall be the chief administrative officer of the City and shall be responsible <br />to the Council for the administration of the City?s affairs and shall exercise control over <br />all departments and divisions except the Police Department <br /> <br />Whereas <br />, the Charter Commission has recently been reviewing these sections, the <br />history of the department, and comparisons to other cities; and <br /> <br />Whereas¸ <br /> thisstructure is unique to the City of Hastings both internally, in that <br />all other City departments report to the City Administrator and externally, in that no other <br />city in the metro area with a population of 15,000 ? 35,000 has a structure where a police <br />chief reports to the Mayor; and <br /> <br />Whereas <br />, upon review by the Charter Commission, the commission has found <br />that the current Charter Section 3.06: Mayor-Law Enforcement is unique and provides no <br />additional advantage to the operation of the police department; and <br /> <br />Whereas <br />, at a Charter Commission meeting on February 3, 2010, Mayor Paul J. <br />Hicks stated his support for amending Charter Section 3.06: Mayor-Law Enforcement to <br />remove the Mayor as head of the Law Enforcement Department. <br /> <br />NOW, THEREFORE BE IT RESOLVED BY THE HASTINGS CHARTER <br />COMMISSION AS FOLLOWS: <br /> <br /> <br />
