<br />HASTINGS CITY COUNCIL <br /> <br />RESOLUTION NO. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS <br />APPROVING A VARIANCE FOR LEROY FINKE TO EXPAND A NON- <br />CONFORMING GARAGE AT 1947 RIDGE LANE <br /> <br />Council member <br />its adoption: <br /> <br />introduced the following Resolution and moved <br /> <br />WHEREAS, LeRoy Finke has petitioned to vary 6.5 feet from the 10 foot minimum side <br />yard setback requirement of the R-l Zoning District as regulated under Section 10.26, District Lot <br />Regulations of the City Code to expand an existing non-conforming structure located 1947 Ridge <br />Lane. <br /> <br />WHEREAS, on July 12,2004, review was conducted before the Planning Commission of <br />the City of Hastings, as required by state law, city charter and city ordinance; and <br /> <br />WHEREAS, The Planning Commission determined that the following hardship criteria <br />exists to justify granting the variance: <br /> <br />1) The literal interpretation ofthe City Code would deprive the applicants of rights commonly <br />enjoyed by other properties in the same district under the terms of Chapter 10. <br /> <br />2) That the special conditions and circumstances do not result from actions of the applicant. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HASTINGS AS FOLLOWS: <br /> <br />That the City Council hereby concurs with the recommendation of the Planning Commission and <br />approves the variance request of LeRoy Finke as presented to the City Council subject to the <br />following conditions: <br /> <br />1) A building permit is required prior to construction of the addition. <br />
