<br />Camegaran, LLC - Schoolhouse Square Sign Variance <br />City Council Memo - August 2, 2004 <br />Page 4 <br /> <br />Review Criteria <br /> <br />The following criteria have been used as findings of fact in granting variances to zoning <br />provisions: <br /> <br />A. That special conditions and circumstances exist which are peculiar to the land, <br />structure, or building involved and which are not applicable to other lands, <br />structures, or buildings in the same district. <br /> <br />B. The literal interpretation of the City Code would deprive the applicants of rights <br />commonly enjoyed by other properties in the same district under the terms of <br />Chapter 10. <br /> <br />C. That the special conditions and circumstances do not result from actions of the <br />applicant. <br /> <br />D. That granting the variance requested will not confer on the applicant any special <br />privilege that is denied by Chapter 10 to other lands, structures, or buildings in the <br />same district. No non-conforming use of neighboring lands, structures, or buildings <br />in the same district, and no permitted or nonconforming use of lands, or buildings in <br />other districts shall be considered grounds for the issuance of a variance. <br /> <br />REVIEW OF THE CONDITIONS <br /> <br />Enclosed with this memo are color renderings of showing generally what the applicant is <br />requesting for this site. Pat Regan of Camegaran has stated that the wall signage on the <br />site will conform to the 5% limitation set forth by Code. <br /> <br />Review of Requested Variances <br /> <br />Variance #1) To permit projecting signs within the C-3 District. <br /> <br />Variance #2) To exceed the 5% wall signage allowed within the C-3 District thru the use of <br />projecting signs. <br /> <br />The City Council will have to decide if they are willing to allow the use of projecting signs on <br />this site, and if so, can the development exceed the 5% wall area limit. <br /> <br />Existing Circumstances <br /> <br />The first commercial building at Schoolhouse Square has been under construction for <br />several months now. This building will house a Green Mill restaurant, a Dunn Brothers <br />Coffee House, and several other retail spaces. Mr. Regan's intent with this development <br />was to replicate the historic downtown of Hastings with a historic building design and the <br />use of brick around the entire perimeter of the building. <br /> <br />Mr. Regan has indicated that he would like the signage on this site to copy the signage at <br />Arbor Lakes Main Street in Maple Grove. If you're unfamiliar with the development, Arbor <br />Lakes Main Street is the creation of a 3 block long 'downtown' in Maple Grove. The <br /> <br />- .-. <br />
