<br />ORDINANCE REVIEW <br /> <br />Residential Use of First Floor 0 . " <br />Currently, residential use of the 1 st floor in the DC zoning district is allowed only by <br />Special Use Permit if the residential use is "accessory to a commercial use, less than <br />50% of the first floor level area, and in the rear of the building." <br /> <br />The DC zoning district already requires conformance with the Design Guidelines for <br />Original Hastings. The guidelines were adopted as part of the Heart of Hastings Master <br />Plan in 2003, (please see attached figures) and regulate the design, placement, type, <br />and uses for Downtown Development. The downtown area is divided into different <br />"Street Types" (based on traffic, use, and commercial viability), as follows: <br /> <br />Street Type <br /> <br />Location <br /> <br />Building Functions (Uses) <br /> <br />Main Street <br /> <br />2n Street (Vermillion to Bailey) <br /> <br />Downtown <br /> <br />Remainder of Downtown - <br />Generally North of 4th Street <br />between Eddy & Bailey <br />Downtown Alleys - <br />Generally North of 4th Street <br />between Eddy & Bailey <br /> <br />Below Ground = Parking, Work, <br />Ground level = Retail <br />U er Levels = Live, Work, Retail <br />Below Ground = Parking, Work <br />Ground level = Live, Work Retail <br />U er Levels = Live Work Retail <br />Below Ground = Parking, Work <br />Ground level = Retail, Work <br />U er Levels = Live, Work <br /> <br />Downtown <br />Alley <br /> <br />Proposed Changes to The Design Guidelines for Original Hastings <br />The Planning Commission also recommended the following changes be made to The <br />Design Guidelines for Original Hastings: <br /> <br />1) First Street, between Vermillion Street and Bailey Street should be identified as a <br />"Downtown" Street on Figure 2 - Street Types. The street is not currently identified <br />on Figure 2. <br /> <br />2) Residential use (live) shall be added as an allowable use under "Ground Level <br />Uses" for "Downtown Alley" on Figure 4 - Frontage Key. The change would allow <br />for residential garage use. <br /> <br />Building Height <br />Changes would allow buildings over 47 feet in height if the maximum building height was <br />less than 756.5 feet (upper level ofthe Finch Building). This would on!!, affect areas with a <br />lower ground elevation than the Finch Building (generally north of 2n Street). <br />
