<br />VII-1 <br /> <br />MEMO <br /> <br />To: <br />From: <br />Date: <br />Re: <br /> <br />Honorable Mayor and City Council <br />Tom Montgomery <br />May 10, 2005 <br />Public Hearing, Second Reading, and Adopt Ordinance - Centerpoint Gas <br />Franchise Agreement <br /> <br />Centerpoint's Gas Franchise Agreement with the City expired in March. City <br />staff and Centerpoint have been working since December to prepare a new franchise <br />agreement and I have enclosed the proposed language for the new franchise agreement. <br />As with the electric franchise agreements, the gas franchise agreement is actually an <br />ordinance amendment, updating the existing gas franchise agreement located in Chapter <br />12 of the City Code. James Strommen, the attorney for the Suburban Rate Authority, <br />who prepared the League of Minnesota Cities model franchise agreement and has drafted <br />several franchise agreements for other communities, has also reviewed the gas franchise <br />agreement. Mr. Strommen did note that the City should also adopt a right of way <br />ordinance to better regulate and control use of the City right of ways. Staff will be <br />drafting a right of way ordinance for Council review later this year. <br /> <br />COUNCIL ACTION REQUESTED <br />Council is requested to hold a public hearing and second reading, and adopt the <br />proposed ordinance that would renew the City's franchise agreement with Centerpoint <br />Energy. <br /> <br /> <br />- <br />ern' OF HASTIN6S <br />
