<br />RESOLUTION # <br /> <br />RESOLUTION REQUESTING APPROVAL OF THE INDIVIDUAL PERMIT <br />FOR THE PUBLIC DOCK IN THE CITY OF HASTINGS <br />AND DIRECTING DISTRIBUTION TO THE HASTINGS <br />STATE AND FEDERAL LEGISLATIVE DELEGATION <br />SEEKING THEIR SUPPORT <br /> <br />WHEREAS, The City of Hastings has submitted an application for a Department <br />of Army pennit to construct a public dock in the Mississippi River; and <br /> <br />WHEREAS, The application was submitted to the Army Corps of Engineers on <br />March 19th, 2004; and <br /> <br />WHEREAS, The City of Hastings recently received a letter dated April 21 st, <br />2005 from the Army Corps of Engineers stating that it will need to conduct an individual <br />pennit review for the public dock project in Hastings and will not be able to authorize a <br />general pennit, apparently due to the "preliminary coordination with other agencies and <br />navigation interests indicated a general pennit is not appropriate for this dock because of <br />the controversy and concerns regarding safety"; and <br /> <br />WHEREAS, The same letter states that, "Because our attempts to resolve the <br />differences of opinion infonnally have been unsuccessful, we need to use the fonnal <br />individual pennit review process so that we can make an infonned pennit decision"; and <br /> <br />WHEREAS, The individual pennit process will include a public notice period <br />inviting comments, in an effort to detennine that the project is not contrary to the public <br />interest and that it does not have an adverse effect on navigation; and <br /> <br />WHEREAS; The City of Hastings has utilized the services of a professional <br />engineering finn to assist with the design and location of the public dock to be certain <br />that it is not contrary to the public interest and does not have an adverse effect on <br />navigation; including the consideration of a variety of locations of the public dock; and <br /> <br />WHEREAS; The current proposed location of the public dock is located at the <br />bend of the Mississippi River which provides considerably improved visibility, especially <br />for those boats traveling up-river. <br /> <br />WHEREAS, The dock provides a place for recreational boat traffic to congregate <br />while waiting to lock, getting them off the river, out of the way of commercial traffic; and <br />
