1449 Moved by Councilman O'Connor, seconded by Councilman Kramer to allow a Bike parking space at 106 E. 2nd. Street. After further discussion Councilman Novak moved, seconded by Councilman Driscoll to table the park- ing of Bikes until the April 15, 1974 meeting. Ayes, Councilmen Collins, Schnirring, O'Connor, Driscoll and Novak; Nayes, Councilmen Kramer, Hallberg, and Fischer. The City Attorney, Mr. Fluegel, advised the Council that Mr. Roger Swanson and Mr. Donald Fluegel, both presently members of the Charter Commiss- ion, had tendered their resignations from the Charter Commission. Moved by Councilman Hallberg, seconded by Councilman Driscoll to accept the resigna- tions of Mr. Roger Swanson and Mr. Donald Fluegel, and to appoint William Elliott, 713 W. 11th. Street and Audrey Andersen, 1517 Forest Street, Mr. Elliott to Mr. Swanson's position and Audrey Andersen to Mr. Fluegel's position. Ayes, all; Nayes, none. Councilman Novak introduced the following resolution and moved its adoption: / RESOLUTION TO DEFER SPECIAL ASSESSMENTS ON EARL ~I~ AND NETTIE BAKKEN PROPERTY WHEREAS, in 1969 and 1970 the City of Hastings did acquire from Earl Bakken and Nettie Bakken, his wife, certain properties located in Addition No. 13 to the City of Hastings; and WHEREAS, the City of Hastings did pay said Earl and Nettie Bakken for said premises so acquired; and ,--- WHEREAS, as an aditional consideration to said sellers the City of Hastings did agree to defer special assessments against other real estate owned by Nettie and Earl Bakken, particularly Lots ten through eighteen in Block 22, Addition No. 13 to the City of Hastings which assessments so de- ferred were for the Northwest Area direct lateral benefit trunk sanitary sewer in the amount of $3,711.84 and for the Northwest Area Storm ponding Basin and Park Acquisition in the amount of $217.90; and WHEREAS, it is the desire of the City of Hastings to memorialize on the land records of the Dakota County Register of Deeds office pertaining to said lots, the fact that said assessment has been deferred and will later be imposed at such time as said property commences to be used for other than agricultural purposes so that prospective purchasers and other interested parties will be aware of the deferral of said assessment; NOW, THEREFORE, be it hereby resolved by the City Council of the City of Hastings as follows: That the City Clerk of the City of Hastings shall record with the Dakota County Register of Deeds office, on the land records pertaining to Lots 10 through eighteen in Block 22 of Addition No. 13 to the City of Hastings a notice in words and figures as follows: Notice of Deferred Assessment: The City of Hastings does hereby give notice that it has deferred special assessments against Lots 10 through eighteen, in Block 22, Addition No. 13 to the City of Hastings for the "Northwest Area Storm Ponding Basin and Park Acquisition" in the amount of $217.90 and for the "Northwest Area Direct Lateral Benefit Trunk Sanitary Sewer" in the amount of $3,711.84 and that said assessments will be imposed and payment will be required at such time as the pro- perty is used for other than agricultural purposes, or at such other time as may be determined by the City Council of the City of Hastings pursuant to Statute. the . 1 i d h reg01ng reso ut on an t e Nayes, none. same was adopt Councilman Kramer seconded J!llotion _ 0 ;- ( t passed by the following vote: Aye, all; Adopted by the City Council this 1 ~)l;--J~J Cify Clerk ATTEST:
