<br />HASTINGS CITY COUNCIL <br /> <br />RESOLUTION NO. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS <br />AMENDING RESOLUTION NO. 04-09-04 BY GRANTING AN EXTENSION TO THE <br />SUNSET CLAUSE PROVISION FOR THE SPECIAL USE PERMIT AND SITE PLAN <br />OF SCHOOLHOUSE PARTNERS TO CONSTRUCT A 57 UNIT CONDOMINIUM <br />BUILDING EXCEEDING 40 FEET IN HEIGHT IN THE R-5 ZONING DISTRICT ON <br />LOT 1, BLOCK 1, SCHOOLHOUSE SQUARE 3RD ADDITION <br /> <br />Council member <br />moved its adoption: <br /> <br />introduced the following Resolution and <br /> <br />WHEREAS, On April 5, 2004 the City Council of the City of Hastings adopted Resolution <br />No. 04-09-04 approving the Special Use Permit and Site Plan for construction of a 57 unit <br />condominium building on Lot 1, Block 1, SCHOOLHOUSE SQUARE 3RD ADDITION subject to <br />17 conditions of approval; and <br /> <br />WHEREAS, Schoolhouse Partners, owner ofthe project, request to modify Condition No. 14 <br />of Resolution No. 04-09-04, which states as follows: <br /> <br />Approval is subject to a Sunset Clause; if significant progress is not made towards <br />construction of the proposal within 18 months of City Council approval, the approval is null <br />and void. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF HASTINGS AS FOLLOWS: <br /> <br />That the City Council hereby agrees to modify Condition No. 14 of Resolution No. 04-09-04 as <br />follows: <br />Approval is subject to a Sunset Clause; if significant progress is not made towards <br />construction of the proposal by December 31, 2006, the approval is null and void. <br />
