110 Hastings, Minnesota Janua~ 21, 1986 The City Council of the City of Hastings, Minnesota net in a regular meeting on Tuesday, January 21, 1986 at 7:30 p.m. in the Council Chant>ers of the City Hall. Menbers Present: Council.ment>er Berg, Werner, Kulzer, Bond, Trautmann, Nesbitt, Plan, Mathiowetz and Mayor Stoffel. Menbers Absent: None. The Mayor called for additions or corrections to the minutes of the meeting of January 6, 1986 and hearing none declared the minutes approved as presented. I The Mayor declared the Public Hearing open at 7:31 p.m. to coosider amending Chapter 3 as it relates to liability insurance requirements for beer, wine and liquor licensees. '!be Mayor asked if anyone wished to speak 00 the issue; no one wished to do so. '!be Mayor closed the public hearing at 7 :32 p.m. The Mayor declared the Public Hearing open at 7 :33 p.m. to coosider amending the City Ordinance establishing regulations for the use of explosives within the City limits. '!be Mayor asked if anyone wished to speak on the issue; no one wished to do so. The Mayor closed the public hearing at 7 :34 p.m. Moved by Council.IneniJer Berg, seconded by Counci1merrber Traubnann to approve the site plan for a four plex on Lot 3, Block 1 of Whispering Meadows subject to cklditional information being provided at the lighting arrangements and subject to a performance bond or cash escrow being sutmitted pursuant to Section 10.24 of the Zoning Ordinance. 7 Ayes; Nayes, Kulzer. Moved by CouncilmeniJer Mathiowetz, seconded by Counci1meIrber Berg to recoosider the action taken at the January 6, 1986 Council meeting regarding the parking variance at 1317 Vermillion Street. 8 Ayes; Nayes, None. I' Moved by Councilrnerrber Berg, seconded by Counci1meIrber Werner to approve the parking variance at 1317 Vermillion Street for Fair Book and Stationary provided that no more than 5,760 net usable floor area is utilized on the site in adherence to the following provisions: 1. That special comitions and circlDlBtances exist which are peculiar to the land, structures, or buildings involved in which are not applicable to other lands, structures, or buildings in the same district. 2. That literal interpretation of the City Code would deprive the applicant of rights camoonly enjoyed by other properties in the same district under the terns of Chapter 10. 3. That special conditions and circlDlBtances do not result fran the actions of the applicant. 4. Moved by Counci1meIrber Traubnann, seconded by CouncilmeniJer Berg to deny the request to develop Lot 8, Block 15 the original Town of Hastings (3rd & Tyler Street) into a parking lot. 3 Ayes; Nayes, Werner, Kulzer, Bond, Plan, Mathiowetz. Moved by CouncilrneniJer Berg, seconded by Counci1meIrber Nesbitt to approve the parking variance for Lot 8, Block 15 original Town of Hastings (3rd & Tyler Street) subject to the following: 1.
