Resolution : Deny Special Use Permit – 1 Floor Residential Use – <br />Jupiter Peak Lodging (213 Sibley Street) <br />Hinzman discussed the special use permit request for 213 Sibley Street <br />requesting to add an additional first floor apartment. The Planning Commission <br />unanimously voted to deny the request. <br />Council discussion on rationale for denial, correlation to 2016 Special Use <br />Permit approval, second floor use of building, lack of separation between <br />commercial and residential uses, clarification on ordinance language, available <br />windows in units, history of ordinance not allowing first floor residential use, <br />and definition of “rear of building”. <br />Vaughan, Braucks to deny application <br />6-1, Folch voting No <br /> <br />C. Administration <br /> <br />1. Appoint City Administrator <br />Flaten discussed the history of the hiring process of the new City Administrator. <br />Braucks expressed gratitude for the thoughtfulness of the process and <br />Administrative and Council members. <br />Lund, Leifeld to approve as presented. <br />7-0 <br /> <br />2. The City will close the meeting to hold a closed-door session with its attorneys as <br />authorized under the attorney-client privilege pursuant to Minn. Stat. § 13D.05, subd. <br />3(b), to discuss the following pending litigation: Robert S. Kleis v.
