UPDATE/OTHER <br />BUSINESS <br /> <br />ADJOURNMENT <br /> <br />The Planning Commission further discussed the proposed setback <br />variance with Jean Thompson, the applicants realtor, Don Keller and <br />staff. The Planning Commission discussed, at length, whether <br />proposed setback variance met City Code requirements. <br /> <br />Commissioner Mesaros moved, Commissioner Featherstone made <br />a second, to deny the various based on findings that the request <br />does not satisfy the following requirements as established by <br />Section 2.04, Subdivision 6, Paragraph A of the Hastings City Code: <br /> <br />That special conditions and circumstances exist which are <br />peculiar to the land, structure, or building involved and which <br />are not applicable to other lands, structures, or buildings in the <br />same district; <br /> <br />That literal interpretation of the City Code would deprive the <br />applicant to rights commonly enjoyed by other properties in the <br />same district under the terms of the Zoning Ordinance; <br /> <br />C. That the special conditions and circumstances do not result <br /> from the actions of this applicant; <br /> <br />That granting the variance requested will not confer on the <br />applicant any special privilege that is denied by the Zoning <br />Ordinance to other lands, structures, or buildings in the same <br />district. No non-conforming use of neighboring lands, <br />structures, or buildings in the same district, and no permitted <br />or non-conforming use of lands, structures, or buildings in <br />other districts shall be considered grounds for the issuance of <br />a variance. <br /> <br />Upon vote taken, Ayes, 4; Nays, 0. <br /> <br />Czech reviewed City Council actions pertaining to planning matters <br />which occurred at the December 21, 1992, City Council meeting. <br /> <br />There being no further business, Commissioner Featherstone moved, <br />Commissioner Mesaros made a second, to adjourn the meeting at <br />7:41 p.m. <br /> <br /> <br />
