John Ruggieri of Dovolis, Johnson & Ruggieri, Inc. discussed with <br />the Planning Commission and staff issues related to the site plan <br />including, but not limited to, the applicants desire to leave all <br />drainage and utility easements at five feet in width on the final plat as <br />well as allowing the curb cut as shown on the Taco Bell site plan <br />dated January 13, 1992, at its proposed location rather than aligning <br />the driveway access with Deutschmann/Milliren Dental Office <br />driveway access which is located at 1222 North Frontage Road. <br /> <br />There being no further public comments the public hearing was <br />closed at 7:21 p.m. <br /> <br />The Planning Commission further discussed issues relating to the <br />preliminary/final plat and site plan with the applicant, staff and Dave <br />Tanner the current property owner of the subject plat. The Planning <br />Commission discussed the need for a ten versus a five foot drainage <br />and utility easement as well as the location of the proposed driveway <br />curb cut. <br /> <br />Commissioner Mesaros moved, Commissioner Bateman made a <br />second, to approve the preliminary/final plat for Fifty Five West <br />Second Addition subject to the following conditions: <br /> <br />1. That the hardshells conform with the submitted plat. <br /> <br />That all future development within the proposed plat provide <br />access from the North Frontage Road. Access permits will not <br />be considered for Highway 55 or Westview Drive. <br /> <br />Upon vote taken, Ayes, 4; Nays, 0. <br /> <br />Commissioner Mesaros moved, Commissioner Bateman made a <br />second, to approve the Taco Bell site plan to be located on Lot 1, <br />Block 1, Fifty Five West Second Addition subject to the following <br />conditions: <br /> <br />That the proposed structure and accessory items shall be <br />completed pursuant to the approved site plan. Upon request <br />for occupancy of the building, all uncompleted items <br />contained within the site plan shall be addressed pursuant to <br />the escrow requirements contained within the city's site plan <br />review provisions of the city's zoning ordinance (Section <br />10.24). <br /> <br />The applicant shall submit detailed plans which shall satis~ <br />Public Works Division requirements and indicate that the <br />property will drain exclusively over Lot 2, Block 1, Fifty Five <br />West Second Addition. <br /> <br /> <br />
