Council Action Requested: Award contract and execute attached Notice
of Award.
Background Information: A section of the Mississippi River bank has been
slowly eroding away, and it became a major safety issue in 2023. At the
February 5, 2024 regular City Council meeting council approved and
authorized funding for the design and engineering of the repair project. Barr
Engineering was hired to complete this process, and have been working
since that time to complete the D&E, permitting and bidding of this project.
On July 23, 2024 bids were received and opened, with Fitzgerald Excavating
& Trucking Inc. submitting a complete bid meeting all of the requirements
and with the lowest cost at $49,515.00. This project is a bit dependent upon
water levels in the Mississippi River, however substantial completion is set
for September 27, 2024 with final completion for October 11, 2024.
Staff and consultant recommend awarding this contract to Fitzgerald
Excavating & Trucking Inc. and execute the attached Notice Of Award.
Financial Impact: As with the design and engineering, this expense was a
bit unexpected yet necessary to maintain trail user safety and retain existing
trail infrastructure. Council approved using Fund Balance from Fund 200 for
the D&E, and staff suggest the same funding source for this project.
An important note here, since the Mississippi River Trail is part of Dakota
County’s Regional Trail System, County staff are supportive of a cost share
for the project with a proposed 40% County cost and 60% City cost for the
entire project. County staff will be presenting this proposal to the County
Board in August.
Design and Engineering Costs were funded at $27,300.00, and the repair
project bid cost of $49,515.00 bring the total project cost to $76,815.00. A
40/60 cost share would bring the City total to $46,089.00 to complete this
project.

Dear Mr. Jenkins,
On Tuesday, July 23, 2024, bids for the Mississippi Riverbank Repair project were received. The following
quotes were acknowledged for the project.

Fitzgerald Excavating & Trucking Inc. submitted the lowest quote price of $49,515.00. Fitzgerald’s
submittal complies with all the requirements of the Contract Documents, and we recommend acceptance
of the quote.
Upon Council’s acceptance of the quote, we will send the Notice of Award to the contractor and request
that they provide insurance information and sign the Form of Agreement. Work will commence at the site
after the Form of Agreement has been executed by all parties and the Notice to Proceed issued.
Fitzgerald has until Wednesday, September 27, 2024 to be substantially complete, and until Wednesday,
October 11, 2024 for final completion.

CONTRACT FOR: Mississippi Riverbank Repair Project
Owner has requested that we notify you that your Bid dated July 23, 2024 has been accepted as the
successful Bidder and Fitzgerald Excavating & Trucking, Inc (Fitzgerald) has been awarded the
contract to perform the Work. The Contract Price is stated in the Agreement.
Fitzgerald must comply with the following conditions precedent within fifteen (15) days of the date
of this Notice of Award, that is by August 16, 2024.
1. Return to Owner a digital copy of the fully executed Agreement (attached).
2. Certificate of Insurance naming the City of Hastings and Barr Engineering Co. as additional
insured.
Failure to comply with these conditions within the time specified will entitle Owner to consider your
bid in default, to annul this Notice of Award and to declare your Bid Security forfeited.
