HomeMy WebLinkAboutX-E-01 Mobile Food Unit License Application Hearing - Gregory Brannon (G's Sweet Truck)1 City Council Memorandum To: Mayor Fasbender & City Councilmembers From: Kori Land & Matt Ziebarth, City Attorney’s Office Date: August 5, 2024 Item: Mobile Food Unit License Application Hearing - Gregory Brannon (G’s Sweet Truck) Council Action Requested: Conduct a hearing on the license application for a Mobile Food Unit for Gregory Brannon to operate G’s Sweet Truck BACKGROUND INFORMATION Gregory Brannon (“Applicant”) has applied for a Mobile Food Unit (“MFU”) license to operate an ice cream truck within the City of Hastings under the name of G’s Sweet Truck, which serves ice cream (Attachment 1).1 Mobile Food Unit licenses are typically approved administratively by the City Clerk, unless the City Clerk recommends denial. When a denial is recommended, the Council must hold a hearing and make the decision on the license application. Following a background check on the Applicant and based on other information received from internal City departments, the City Clerk is recommending denial of the Applicant’s license. The Applicant was notified of this hearing (Attachment 2). Following the presentation provided by the City, the Council should offer the Applicant an opportunity to be heard. The Council can ask questions at any time during the hearing. At the conclusion of the hearing, the Council should make a decision and act on the license application. DISCUSSION In order to operate a Mobile Food Unit, a license from the City is required.2 Background checks are required for Mobile Food Unit license applications and, following receipt of the background investigation from the Hastings Police Department, the City Clerk is recommending denial. Background investigations are not public data, but the public portions of the results of the investigation will be provided to you for purposes of this hearing. 1 G’s Sweet Truck L.L.C. was administratively terminated by the Minnesota Secretary of State on February 8, 2023, and remains inactive. 2 City Code Section 110.20.C X-E-01 2 The City Code provides several grounds for denying a MFU license,3 many of which are applicable in this matter and will be addressed below. 1. Operating without a Mobile Food Unit License, which is a violation of City Code Section 110.20.D City Staff became aware that Brannon was operating an ice cream truck without a license in approximately the spring of 2023. On April 12, 2023, the City contacted Brannon by email to inform him that a license is required to operate his ice cream truck within the City. The email included an application form. (Attachment 3) Brannon did not submit his license application form, but was found at various events in the summer of 2023 conducting his mobile food unit operations. The City’s Recreation Programming Specialist provided a timeline of the City’s interactions with Brannon (Attachment 4): • On June 6, 2023, Brannon was discovered attempting to operate his ice cream truck at the Summer Kick Off event in the City. City staff informed Brannon that the events were invite-only, and he was asked to leave. • On June 14, 2023, Brannon was attempting to operate G’s Sweet Truck at Storytime in the Park. City staff informed Brannon that they already provided snacks at the event and again asked him to leave. Brannon told City staff that he “had a license”, and Brannon subsequently attended most of the Performances in the Park events in 2023. City Staff contacted Brannon again in September 2023, and provided another license application form. On October 4, 2023, Brannon submitted a license application to City Staff. He was informed that before he could operate his business, a criminal background check for Brannon and his employees was required, and also noted that he failed to provide a certificate of insurance (Attachment 5). Brannon did not respond to this email, nor the subsequent email sent to him on October 17, 2023. On April 26, 2024, Brannon submitted a license application (Attachment 1) which did not have a certificate of insurance, or a copy of the Department of Agriculture license. After many emails to try to obtain additional information, City Staff received a new copy of a license application from Antonia Silva, an employee of Brannon’s for G’s Sweet Truck. Silva submitted only portions of the license application on behalf of Brannon (Attachment 6), and it still lacked the documentation needed for City Staff to process the application, including insurance information, therefore, the license application was incomplete. Despite not being issued a license: • On May 30, 2024, Brannon and Silva served ice cream at the Middle School. In the email with City Staff, Silva admitted they served at the Middle School, but claimed she did not know they needed a “permit” (Attachment 7). • On June 13, 2024, Brannon was observed at the Music in the Park event in the City with his ice cream truck. Brannon was escorted out of the area by the Hastings Police Department (Attachment 4). 3 City Code Section 110.03.F, Section 110.20.E X-E-01 3 On June 14, 2024, the City Clerk sent a compliance notice to Brannon alerting him that his attempt to operate G’s Sweet Truck without a license was a violation of Hastings City Code, and that he must cease operating immediately or he may receive an administrative citation (Attachment 8). • At the 4th of July parade and fireworks at Hastings Golf Club, Brannon was seen with his ice cream truck and was asked to leave the premises by the Hastings Police Department. • On July 11, 2024, Brannon was photographed operating his ice cream truck in the South Pines neighborhood of Hastings (Attachment 9). On July 16, 2024, the City issued Brannon an administrative citation for violating City Code § 110.20.C for operating without a license and imposed a $500 penalty (Attachment 10). Brannon sent an email to Mayor Fasbender on July 17, 2024, asking her to intervene on his behalf, stating that the City Staff should issue his license. In that email, Brannon admits that he operated his ice cream truck at the Middle School on May 30, and that he had been doing so for the last three years. In addition, he admitted that he had been operating or attempting to operate at every City event for the last two years, even though he knew he did not have a license. (Attachment 11). 2. Failing to disclose criminal violations in violation of City Code 110.02.C.6; failing to truthfully provide information as part of the application process in violation of City Code 110.20.E.2 Hastings City Code § 110.02.C.6 requires all applicants to provide a sworn statement on the application and include “whether or not the applicant has ever been convicted of a felony, or misdemeanor, including a violation of a municipal ordinance but excluding traffic violations, and if so, the date and place of conviction and the nature of the offense.” Hastings City Code § 110.20.E.2 requires applicants to be truthful on the application. While Brannon admitted he had one drug “charge” in 2021, Brannon failed to disclose other felony and misdemeanor convictions on his application. As part of the criminal history background investigation, which was required under City Code § 110.20.F.3, it was discovered that Brannon has been convicted of the following offenses in the last 4 years: • July 15, 2020, Brannon was convicted of threats of violence with the intent to terrorize while in possession of a dangerous weapon. This was originally charged as 2nd degree felony assault, but after completion of probation on July 15, 2023, it was reduced to a misdemeanor (Attachment 12). • Between 2016 to 2024, Brannon was convicted 9 times of driving without a license, driving after suspension or driving after revocation (Attachment 13). Again, these offenses were charged as misdemeanor offenses but were reduced to petty misdemeanors. At least one of these offenses occurred while driving his ice cream truck. X-E-01 4 3. Failure to meet the Insurance Requirements for Mobile Food Unit License in violation of City Code 110.20.D. City Code §110.20.D.1 requires the applicant to provide a certificate of insurance covering commercial general liability, automobile liability and worker’s compensation. While Brannon provided the City with a certificate of insurance, it does not have commercial general liability insurance as required (Attachment 14). 4. Operating the business in violation of the laws of the State of Minnesota by failing to have a driver’s license in violation of City Code 110.20.F.3 After being told to leave the Hastings Golf Club on July 4, 2024, Brannon drove his truck out of the parking lot and was stopped by the Hastings Police Department. He was cited for driving his ice cream truck with a suspended license, which is a misdemeanor under Minnesota Statutes § 171.24 (Attachment 15). 5. Questionable moral character or business reputation in violation of City Code Section 110.03.F City Code allows the Council to refuse to grant a license to any person of questionable moral character or business reputation. • Brannon continuously ignored and disregarded City Staff’s notices about the requirement to obtain a license, and repeatedly operated his business without a license in 2023 and 2024, which he admits. • Brannon stated in his application that he had a criminal “charge” of drug possession in 2021, but he failed to disclose that this charge led to a conviction of 3rd Degree Possession of 50 or more doses of heroin, oxycodone, methamphetamine, fentanyl and other drugs. In addition, large amounts of cash and several guns were seized (Attachment 16). • Brannon has had other criminal charges and/or arrests for the following offenses: felony drug possession (2010), Criminal Sexual Conduct (2018), Domestic Abuse No Contact Order Violation (2018), Disorderly Conduct (2021), and Felony Drug Possession (2023). It is important to note that there are no convictions in his criminal history for these offenses. CONCLUSION: Based on the above information, there are sufficient grounds to deny the license and we request that the Council adopt the attached Resolution denying the license. I am writing to seek your assistance regarding my peddler's license application, which has been pending for several months with the City of Hastings. Despite completing all required paperwork, obtaining insurance, and fulfilling all other requirements, my application has not been processed, and my inquiries to the City Hall and the police department have gone unanswered. This delay is causing significant hardship, as I am unable to conduct my business without the necessary license. This year I’ve missed out on thousands of dollars of events that was I was forced to leave by the city or the department. I’ve been attending the last day of school event for the middle school this is my third year and I was able to attend one of those days, but was not able to attend the second day due to no peddlers license by the next day, but I tried my hardest to get everything right for that event and was not able to get a peddlers license because they made it difficult for me to obtain oneI. I’m not sure what the department told the middle school but they wanted my ice cream truck at the middle school, but they did not want me on school property. I have nothing on my record that. would prevent me from being able to attend. Missing the middle school and the fun run from elementary school event which I was invited to both I got prepared. I was ready to do the event and when I show up to the event, I was sent home immediately they never gave me advance notice about any of anything that they needed from me at that time so I wasted time getting prepared for the event by buying ice cream for the event just to get sent home with nothing, no advance notice and I felt like that was pretty messed up for doing that. They could’ve let me know in advance or told me I couldn’t attend in advance, but as soon as I pull in to the event I was sent sent off. Another event that the department told me I couldn’t attend was the Fourth of July at the Golf Course . This would’ve been my second year. They invited me last year and again this year and when I pull in the office told me I can’t sell in Hastings because I don’t have a license, but I have turned in all my information for the peddlers license paid my fee Insurance the city of Hastings with my commercial insurance and I wasn’t able to participate in that either after I pull in there ready to get to work I was told I had to leave the Fourth of July already hadl all my paperwork filled out, turned in all my fees paid and I don’t hear from the city for my peddlers license so I wasn’t able to attend. I’ve also been making all the downtown events for the last two years and been kicked out of every single event downtown this year because I haven’t got my peddlers license which I should have already. Talk about being embarrassed from pulling in and having to get sent out immediately from the events that I have attended years prior It’s making me look bad in front of all the residents or my so-called customers that love having the ice cream truck around Hastings. I believe my past is unfairly influencing the processing of my application, I’ve messed up in the past, but no longer live that life anymore. I changed my Ways for the better and doing what’s right and be a law abiding citizen. i’ve been resident in Hastings since 2003. I have four daughters that live in Hastings as well that I needs to provide for. One daughter in 10th grade two daughters in elementary school and one that recently graduated a couple years ago. I also recently got I also recently got my drivers license reinstated so driving will not be an issue from me, and I am requesting your intervention to expedite this matter. Your attention to this issue would be greatly appreciated, and I am more than willing to provide any additional information or documentation required to facilitate the processing of my application. COUNT II Charge: Threats of Violence (Intent to Terrorize) Minnesota Statute: 609.713.1, with reference to:  609.05.1 Maximum Sentence: 0-5 Years and/or $3,000.00  -  $10,000.00 Offense Level: Felony Offense Date (on or about): 11/09/2018 Control #(ICR#): 18002649 Charge Description: On or about November 9, 2018, in the County of Dakota, Minnesota, GREGORY BRANNON, did while intentionally aiding, advising, or conspiring with another or others, threaten, directly or indirectly, to commit any crime of violence with purpose to terrorize another or to cause evacuation of a building, place of assembly, vehicle or facility of public transportation or otherwise to cause serious public inconvenience, or in a reckless disregard of the risk of causing such terror or inconvenience. 1 Attachment 12 Pg. 1 X-E-01 STATEMENT OF PROBABLE CAUSE On November 9, 2018 at approximately 5:41 p.m., a Hastings Police Officer responded to the area of 4 th Street for a possible road rage incident.  An officer made contact with J.G.  J.G. explained that he nearly was run off the road by a vehicle containing multiple occupants.  He described that this same vehicle had driven slowly by his residence several times.  J.G. stated he went outside to investigate.  He noticed the vehicle was now parked in front of the neighbor’s home with its lights off and there were multiple persons inside the vehicle.  J.G. entered his own vehicle and drove by the other vehicle parked on the street.  He explained that as he drove by the suspect vehicle, the vehicle headlights turned on and the vehicle began following his vehicle.  At one point, J.G. described that the suspect vehicle drove alongside his vehicle and swerved towards J.G.’s vehicle.  J.G. stated he then called 911.  J.G. was able to get behind the vehicle and obtained the license plate number.  After J.G. was nearly run off the road by this vehicle, he stopped and the suspect vehicle drove off. Dispatch received a related 911 call from L.A. indicating that there were men outside her residence brandishing firearms.  Police responded to the residence on 9th Street, Hastings, Dakota County, Minnesota. Upon arriving at the residence, an officer spoke with L.A.  There were five minor children also present at the residence.  L.A. was visibly shaking and afraid.  An officer spoke with L.A. and J.G.  They explained that they were inside their home when a vehicle drove by slowly and then drove by again multiple times.  L.A. explained that after J.G. had left to investigate, the vehicle that was parked near their home (the suspect vehicle) returned to the area and pulled in front of her residence.  She saw four men exit the vehicle.  L.A. stated she observed the men pulling out long barrel firearms from their sweatpants as they approached her residence.  She called 911 as the men walked toward her home.  She observed the men walk to the side and back doors of her residence.  She described that one of the men attempted to enter the residence through the side door.  Another male attempted to enter the residence through the back door.  When she heard police sirens, the men ran back to their vehicle.  She stated she recognized one of the men as being Gregory Brannon.  She stated Brannon had pulled out a long barrel firearm from his sweatpants as he and the other three men approached her residence.  L.A.’s minor son explained that his minor child friends were waiting outside for him in a vehicle when they were approached by four men.   The child’s friends described they saw a vehicle with its headlights off, drive by their vehicle as it was parked near L.A.’s residence.  They saw four men exit the vehicle.  One of the men told the children, “you should not be here.”  The children left the area.  They recognized one of the men as being Gregory Brannon.  2 Attachment 12 Pg. 2 X-E-01 L.A. and J.G. told police they planned to stay the night away from the residence because they were not comfortable staying at home given what had occurred with the four men at their residence earlier that evening.  J.G. texted Brannon later that same evening, asking if this all was drug-related.  J.G. confronted Brannon about bringing firearms and “crazy people” to J.G.’s residence.  J.G. tells Brannon in the text that J.G. does not have any drugs belonging to Brannon.  Brannon explained via text that there was cocaine missing and they want it back or someone is going to get “wacked”.  Brannon explained that he needs to protect his girls.  Brannon stated he doesn’t care who gets hurt as long as it is not mine, these guys are out for blood.  3 Attachment 12 Pg. 3 X-E-01 Complainant requests that Defendant, subject to bail or conditions of release, be: (1) arrested or that other lawful steps be taken to obtain Defendant's appearance in court; or (2) detained, if already in custody, pending further proceedings; and that said Defendant otherwise be dealt with according to law. While driving on Southview Drive, I saw an Ice Cream Truck turning onto Westview Drive approaching the event. I have been advised this Ice Cream Truck does not have the operating license to be a vender within the City. I watched as the male driver pulled into the Golf Club and open the side window for sales. The registered owner of the truck, Gregory Brannon DOB/1976-10-23, also had a suspended driver's license. The truck came back as 1997 CHEV P30 LIC/YAJ8260 INCOMPLETE (STRIP CHASSIS). I approached the man now sitting in a chair in the back of the truck who identified himself as Brannon. I advised him he did not have the correct license to be operating Ice Cream Sales in the City of Hastings. I also advised him he would not be allowed to sell any Ice Cream at the event. Brannon stated he had turned in all the paperwork, but he was not granted the license. I told him he would have to bring that up with the City. As I also saw him driving, I would be citing him for driving after suspension. Brannon had his girlfriend come and move the truck out of the parking lot. As Gregory Brannon was seen driving a motor vehicle and his driver's license was suspended, he was cited (Citation# 190324902457) for driving after suspension [MN § 171.20.2(a)]. Attachment 16 Pg. 2 X-E-01 STATEMENT OF PROBABLE CAUSE On September 28,2021,Agent Latsch of the Dakota County Drug Task Force (DCDTF)executed a knock and announce search warrant in Goodhue County at the location of 15783 Dakota Circle,Welch,Minnesota 55089.Prairie Island Police Department had been monitoring cameras in the neighborhood and advised Agent Latsch the subject of the investigation,GREGORY BRANNON (DOB:10/23/1976),left approximately an hour before execution of the warrant.The owner of the residence,Raquel Wells-Jacobson,had been seen at the residence about the same time,but also left. Agents knocked on the door and announced loudly.but no one came to the door.DCDTF forced entry into the residence at approximately 1:30 p.m.by breaching the door.A second door had to be breached in the entry way to gain entry into the residence.The residence was cleared,and no occupants were located.Two doors upstairs had to be breached as well to clear and search the residence. Once the residence was secured,DCDTF agents photographed and searched the residence.Bedrooms were givendesignationspriortophotographing.Things of note on those designations included male clothing items and a MN ID for Gregory Brannon in Bedroom G.In Bedroom H,agents found what appeared to be all female items and a social securitycardforRaquelWells-Jacobson.The following items were located during the subsequent search. o Item #1-THC Cartridge located inside a safe in Bedroom G by Agent Grimes o Item #2-19 Sildenafil tablets located inside a safe in Bedroom G by Agent Grimes o Item #3-THC Cartridge located inside a safe in Bedroom G by Agent Grimes o Item #4-Green leafy substance located inside Bedroom G in a plastic shelf by Agent Carlson o Item #5-Brown powdery substance located in Bedroom H in the middle dresser by Agent Beckman o Item #6-Blue M30 pills located in Bedroom G inside a vitamin container in the nightstand by Agent Carlson o Item #7-Two glass bubble pipes located in Bedroom G in the closet by Agent Latsch o Item #8-Powder from a platter in Bedroom H on the dresser by Agent Latsch o Item #9-Black Smith and Wesson handgun with serial number HUN5463 located in Bedroom G on top of entertainment stand by Agent Ordorff Item #10-Two magazines/ammunition/holster located next to the Smith and Wesson handgun by Agent Ordorff Item #11-Taurus Millennium G handgun with serial number TKR68680 located in Bedroom H inside a safe by AgentBowman Item #12-Ammunition located in Bedroom H inside a safe by Agent Bowman Item #13-Baggy of white powder substance located in Bedroom H in top drawer of nightstand by Agent Scovill Item #14-$14,165 in US Currency located in Bedroom G inside a safe by Agent Grimes Item #15-Miscellaneous drug paraphernalia located throughout the residence by Agent Latsch Item #16-Remington 1100 12 gauge shotgun located in the living room inside a safe by Agent Bowman All the items above were seized and transported back to DCDTF where Agent Latsch processed them.Item #5 tested presumptive positive for heroin and was sent to the lab for further testing.The net weight of the substance was 5.05 grams.The pills in Item #6 were identified using drugs.com as oxycodone hydrochloride.However,based on Agent Latsch's trainingandexperience,he suspected the pills to be counterfeit so the pills were sent to the lab for further testing.The total numberofpillsamountedto86. Forensic Scientist Kristin Kamerud of the Minnesota Bureau of Criminal Apprehension (BCA)examined Item #5 and her analysis revealed the presence of methamphetamine,a schedule ll controlled substance.Forensic Scientist KamerudexaminedItem#6-one of the 86 pills-and her analysis showed the presence of fentanyl,a narcotic drug and schedule llcontrolledsubstance.Her examination of Item #6 also showed the presence of 4-anllino-N-phenethylplperldine (ANPP),aschedulellcontrolledsubstance. On October 6,2021,Agent Latsch responded to 15783 Dakota Circle to meet with BRANNON and Wells-Jacobson regarding the search warrant executed at the residence.Upon arrival,Agent Latsch obtained a statement from Wells-Jacobson who identified Bedroom G as belonging to BRANNON and Bedroom H as belonging to her.She stated both hadsafestokeeptheirpropertysecure.Wells-Jacobson said BRANNON had been renting Bedroom G from her since June.She said she had access to the room,but never went in.The money seized did not belong to her. As it pertained to the items located in her room,Wells-Jacobson advised the handgun in her safe was left behind by a previous renter and did not belong to her.The baggie of cocaine in her room belonged to her as she was a casual cocaineuser.The other baggie along with the platter on her dresser belonged to her boyfriend who she advised did not live withher.Wells-Jacobson did not know the bag contained heroin.Despite her statements to this,it should be noted no other Attachment 16 Pg. 3 X-E-01 property was located in that room that appeared to belong to a male and the baggie was located along with all of what appeared to be Wells-Jacobson's property. During her statement,Wells-Jacobson said she would be surprised if BRANNON had a gun.She knew the previous renters had guns.She then directly addressed the gun located in Bedroom G and said she had never searched up high in the bedroom before renting the room to BRANNON'Agent Latsch never advised Wells-Jacobson of the exact location of the gun,and she appeared to be addressing it directly,knowing where it was,despite stating she did not know of the gun beingintheroominthefirstplace.She seemed to be attempting to make it appearthe gun did not belong to BRANNON.However,she denied this was the case. Agent Latsch then spoke with BRANNON.BRANNON admitted to having some pills,but said something similar to "nothinginthefurniturewasmine."During his statement,BRANNON admitted to purchasing blue Percocet pills in bulk for about $8apill.BRANNON did not know how many were in the bag and simply asked how much he could get for a certain dollaramount.BRANNON denied selling the pills and claimed they were for personal use despite having such a bulk amount ofthem.BRANNON references he had been told they were real Percocet,but BRANNON seemed to know the pills were fakewithoutAgentLatschtellingBRANNONtheywere. When asked what else would have been found in his room besides pills,BRANNON said nothing.BRANNON adamantlydeniedowningthefirearmlocatedontopoftheentertainmentcenterinBedroom G and BRANNON said he did not evenknowagunhadbeenfoundthere.Agent Latsch advised BRANNON of a search warrant he had for BRANNON's DNA.BRANNON's body language quickly changed while discussing the firearm as he began to avoid eye contact,look downward,and fidget. As Agent Latsch began preparing to obtain a DNA swab,BRANNON said even if his DNA was on the gun it did not mean it was his.He said just because he knew the gun was there and maybe moved it did not mean it was actually his.BRANNONwasprovidedacopyofthesearchwarrantforhisDNA.After obtaining a sample,the buccal swabs were placed in a sealed container inside the DNA swab envelope.The swab was brought back to the drug task force and entered into evidence tracker.Agent Latsch marked both the swab and gun to go to the (BCA)for DNA analysis.Forensic Scientist Samantha Nath examined ltem #9-the Black Smith and Wesson handgun with serial number HUN5463-and it failed to reveal anylatentprintsthatweresuitableforfurtherexamination. A review of BRANNON'S criminal history shows he has a felony conviction of possession of over 1.4 grams of marijuana in a motor vehicle from 2021.ln addition,BRANNON was convicted of Threats of Violence under Minn.Stat.section 609.713,subd.1,which is classified as a crime of violence under Minn.Stat.section 624.712,subd.5. Date:i/I fi/z 3 Court File Number:25-CR-23-286 Page 3 of 3 /////L1 Patr'Mt/Biren Jud of District Court Attachment 16 Pg. 11 X-E-01 RESOLUTION NO. ___________ CITY OF HASTINGS DAKOTA COUNTY, MINNESOTA A RESOLUTION DENYING THE ISSUANCE OF A MOBILE FOOD UNIT LICENSE TO GREGORY BRANNON FOR G’S SWEET TRUCK WHEREAS, Gregory Brannon (“Applicant”) applied for a mobile food unit license to operate an ice cream truck known as G’s Sweet Truck, which travels from place to place through residential districts within the City of Hastings; and WHEREAS, the Applicant has been found to be operating his mobile food unit within the City without a mobile food unit license on numerous occasions in 2023 and 2024, but specifically on the following dates: • June 6, 2023, Summer Kick Off Event • June 14, 2023, Storytime in the Park • May 30, 2024, Middle School • June 13, 2024, Music in the Park • July 4, 2024, 4th of July Fireworks and Parade • July 11, 2024, South Pines Neighborhood All in violation of City Code § 110.20.D; and WHEREAS, the Applicant has been found to be driving the truck and operating the mobile food unit within the City without a valid Driver’s License, in violation of Minnesota Statutes, Section 171.24; and WHEREAS, the Applicant is an ice cream truck vendor that travels through residential districts and is required to undergo a criminal background check prior to operating within the City, pursuant to City Code § 110.20 F.13; and WHEREAS, the Police Department conducted a criminal history background investigation on the Applicant which revealed felony and misdemeanor convictions; and WHEREAS, the Applicant did not disclose prior felony and misdemeanor convictions on his application, in violation of City Code 110.02.C.6; and WHEREAS, the Applicant failed to provide a certificate of insurance for commercial liability insurance with the required form and dollar amount of insurance coverage under City Code 110.20.D.1.a; and WHEREAS, the City Council may deny a license in its sole discretion and for any reasonable cause, including questionable moral character or business reputation; and X-E-01 WHEREAS, pursuant to City Code, the City Clerk shall issue a mobile food unit license administratively unless one or more grounds for denial exists; and WHEREASE, based on the background investigation and other information provided by City Staff, the City Clerk recommends denial of the mobile food unit license and therefore, the Council is required to hold a hearing to consider the application; and WHEREAS, pursuant to City Code Section 110.03.F, the Applicant was provided notice of the hearing, the Council held the hearing, at which hearing the City presented evidence and the Applicant was given an opportunity to be heard; and WHEREAS, following the hearing and based on the information presented, the Council hereby makes the following FINDINGS OF FACT: 1. Applicant, Gregory Bannon has violated the following Sections of the Hastings City Code: a. City Code 110.20.D for operating without a license. b. City Code 110.20.D.1 for failing to provide a certificate of insurance for commercial liability insurance. c. City Code 110.02 C.6 for failing to disclose prior felony and misdemeanor convictions. d. City Code 110.20 E.2 for failing to be truthful on his license application. e. City Code 110.20 E.1 for operating his mobile food unit without a valid driver’s license in violation of Minnesota Statutes, Section 171.24. 2. Based on the information presented at the hearing, the Applicant is of questionable moral character and questionable business reputation, which are reasons to refuse to grant a license pursuant to City Code Section 110.03.F. Based on the aforementioned FINDINGS OF FACT, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: 1. The City Council adopts the Findings of Fact above; and 2. The City Council hereby denies the application for a Mobile Food Unit license for Gregory Brannon to operate in the City of Hastings. Adopted by the Hastings City Council on_______________, 2024.
