Minutes of the Special Meeting of July 19, 1995
1. Roll: Commissioners Thorsen, Coutu, Schnirring, Anderson, Simacek, Weinberg and Smith
present.
2. Consideration of eligibility of St. BonifaCe Church for designation as an Hastings Preservation
Site.
Mr. Moynihan the City Attorney announced that the City is one of the defendents on a
temporary restraining order and notice of a complaint served at 4 p.m. today, to the effect that
the City, parish, and others named not take any action which would be harmful to the church
building. He recommended that the I-IPC adjourn to avoid allegations by any party to the suit
that the commission had violated the restraining order. He read the restraining order, noted that
the plaintiffs are seeking relief under the state statue, not the city ordinance, and that the motion
was currently scheduled to be heard on Friday, the 21st.
Mayor Wemer recommended that the HPC follow legal staff advice.
Mi. Schnirring moved and Mr. Simacek seconded adjournment. Ayes: Schnirring,
Simacek; Nays: Thorsen, Coutu, Anderson and Weinberg; Abstained: Smith. Motion failed.
Mr. Thorsen moved and Mr. Smith seconded a motion to hear comment but not to take
action. Ayes: Thorsen, Coum, Anderson, Weinberg, and Smith; Nays: Schnirring, Simacek.
Motion carried.
One of the citizens in attendance suggested that they could hold a meeting of their own,
in the room, after HPC adjournment.
3. Mr. Smith moved and Mr. Simacek seconded adjournment. Ayes: Thorsen, Coutu,
Anderson, Weinberg, Smith, Schnirring and Simacek; motion carded.
