Commissioners Present: Bullington, Peine, Schmitt, Stevens, Vaughan, Zeyen Commission Absent: McInnis Staff Present: Planning Director Hinzman, Associate Planner Barker Approval of Minutes 2. –November 24, 2008 Motion by Commissioner Zeyen to approve the December 22, 2008, meeting minutes. Seconded by Commissioner Stevens. Upon vote taken, Ayes 6, Nays 0. Motion carried. PUBLIC HEARINGS Mark & Monica Frazer – 3.Special Use Permit #2008-26 – Dock Expansion – Hubs Landing. Associate Planner Barker provided the staff report. Chair Schmitt opened the public hearing at 7:03. No members of the public spoke to the issue. Chair Schmitt closed the public hearing at 7:03. Commissioner Stevens inquired if the launch ramp will stay if the launch business ceases existence. Mark Frazer, applicant, stated that the launch business will be phased out over time and the slips phased in over time. In addition, the dry dock business uses the ramp. Therefore, the launch ramp will stay for a while. Chair Schmitt asked if parking was an issue with the phasing process. Frazer stated that with the recent bridge construction project, he lost a lot of launch and dry dock business. He further stated he does not expect any launch business to occur in 2010 and that he will also need to clear the dry dock area for MnDot to use. Frazer explained that he also does not want to cut out regular ramp users completely. He stated he has enough parking for thirty additional slips along with the current launch business. Commissioner Stevens asked how many slips Frazer currently had. Frazer stated he currently has 50. Further, he stated that on a good day, he gets 40 vehicles per day for the launch business. He stated that with the new slips only a small amount of them will be used at one time. Frazer stated that some items are taken to Hastings marina while docks are designed to withhold the 1960’s flood levels. Chair Schmitt stated that condition number 5 is contradictory to this information. Planning Director Hinzman stated that the requirement could be amended to state that the docks need to be removed or anchored to withstand floods. Commissioner Zeyen inquired if Hubs has fuel or pump out stations. Frazer stated that fuel sales are not cost effective and that numerous other marinas sell fuel, so it is not necessary. He also stated that he received a grant for a pump-out station three years ago. The pump-out tank is located on a trailer, so that it can be removed during a flood. Action by Planning Commission: Motion by Vaughan to approve the Special Use Permit for Mark and Monica Frazer with amendments to condition #5. Seconded by Bullington. Upon vote taken, Ayes 6, Nays 0. Motion carried. City of Hastings – 4.Ordinance Amendment #2008-28 – Demolition in the OHDS. Associate Planner Barker provided the staff report. Chair Schmitt opened the public hearing at 7:16. No members of the public spoke to the issue. Chair Schmitt closed the public hearing at 7:16. Commissioner Vaughan inquired if the information provided by the HPC was being requested to be put into the ordinance. Associate Planner Barker explained that the information could be included into the ordinance or that the Planning Commission could use it for its review of homes for demolition. Chair Schmitt stated that even with the information from the HPC, he still felt that the Planning Commission did not need to approve homes for demolition. He further stated that the intent of the Ordinance is not to preserve homes and that stricter regulations do not need to be imposed on homeowners. Chair Schmitt stated that the Planning Commission looks out for the historic nature of homes during the building process. Commissioner Peine stated that one concern is that property values are less in the historic district. This may attract people to buy homes with the intent of future teardowns. Planning Director Hinzman stated that we would have to look closely at the authority the Planning Commission has in this situation. He stated that this may not be within the role of the Planning Commission. Planning Director Hinzman stated that this falls more into the role of the HPC. Commissioner Peine stated that perhaps the homes should be put on the historic properties list. Planning Director Hinzman stated that the ordinance amendment would not prevent the HPC City of Hastings Planning Commission Minutes – December 22, 2008 Page 3 of 3 from doing this. Action by Planning Commission: Motion by Vaughan to approve the amendment to Ordinance 155.23 pertaining to the demolition of homes in the Original Hastings Design Standards area. Seconded by Zeyen. Upon vote taken, Ayes 6, Nays 0. Motion carried. Other Business 5. Planning Director Hinzman updated the Commission on past City Council actions and upcoming items. Adjournment 6. Motion by Stevensto adjourn the December 22, 2008, Planning Commission meeting. Seconded by Peine. Upon vote taken, Ayes 6, Nays 0. Motion carried.
