REQUEST C & G Homes (Gary & Renee Heselton) seek a minor subdivision to split a twin home that is currently being constructed into two lots. Each half of the twin home would be located on its own lot. RECOMMENDATION At the April 13, 2009 Planning Commission meeting, Commissioners voted 5-0 to recommend approval of the minor subdivision request based on the staff recommendation. Public comments Notification was sent to adjoining property owners and no written comments have been received. At the Planning Commission meeting a neighboring property owner asked questions about the proposal. The same citizen said they had concerns that if the twin home were destroyed, could single-family homes be built on each of the small lots. Staff assured them that the zoning ordinance would not allow single-family homes to be built on lots of this size. ATTACHMENTS • Resolution • Survey • Location Map BACKGROUND INFORMATION Comprehensive Plan Classification The property is designated U-I -Urban Residential in the 2020 Comprehensive Plan. U-I allows 1 to 3 units per net acre. Zoning Classification The subject property is zoned R-2 -Medium Density Residential. Single and Two Family homes are permitted uses in the R-2 District. The applicant is constructing a twin home on the lot, which was approved by the HPC in December of 2007. There was an existing home on this lot that burned-down in 2006. MINOR SUBDIVISION REVIEW Minimum Setback Requirements R-2 District: Front 20' Side 7' Rear 20' Lot Size The property meets the minimum lot size requirement. The minimum lot size for a twin home on a single lot in the R-2 district is 9,700 square feet. The combined size of the two parcels is 10,547 square feet. Lot Width The property meets the minimum lot width requirement. The minimum lot width for a twin home on a single lot in the R-2 district is 66 feet. The combined width of the two parcels is 69.9 feet. Sewer Interceptor Fee The developer shall pay $435 in sewer interceptor fees for the additional unit added through the minor subdivision. The payment is due prior to recording of the minor subdivision. Park Dedication The developer shall pay $1,650 in park dedication fees for the additional unit added through the minor subdivision. The payment is due prior to recording of the minor subdivision. Landscaping One boulevard tree and front yard tree is required to be planted for each unit. HASTINGS CITY COUNCIL RESOLUTION NO. Council member Resolution and moved its adoption: introduced the following WHEREAS, Gary and Renee Heselton of C & G Homes have initiated consideration of a minor subdivision on property to split a +/- 5,230 Sq Ft parcel from a 10,547 Sq Ft parcel generally located on the south side of 7t" St East between Ramsey and Tyler Streets, legally described as Ex E 6 Ft of S 15 Ft of W 10 Ft of Lot 1, Lot 2, Block 50, Town of Hastings Blks 1 Thru 99, Dakota County, Minnesota as follows: Parcel A: That part of Lot 1, EXCEPT the East 56 feet thereof and also EXCEPT the South 15 feet of the West 6 feet of the East 62 feet of said Lot 1, and ail of -Lot 2, Block 50, TOWN OF HASTINGS, according to the recorded plat thereof, Dakota County, Minnesota lying westerly of the following described line: Commencing at the northwest corner of said Lot 2; thence South 89 degrees 59 minutes 54 seconds East, assumed bearing, along the north line of said Lot 2, a dis#ance of 37.93 feet to the point of beginning of the line to be described; thence South 00 degrees 06 minutes 27 seconds West, a distance of 140.17 feet to the south fine of said Lot 2 and said fine there terminating. WHEREAS, on April 13t", 2009, a review of this minor subdivision was held before the Planning Commission of the City of Hastings, and NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That the request to subdivide Ex E 6 Ft of S 15 Ft of W 10 Ft of Lot 1, Lot 2, Block 50, Town of Hastings Blks 1 Thru 99 is hereby approved, with the following conditions: 1) Conformance with the City Council Staff Report and plans dated April 20, 2009. 2) Approval is subject to a one-year sunset clause; if the minor subdivision is not recorded within one year of City Council approval, the approval is null and void. 3) Payment of park dedication fee in the amount of $1,650 for the new unit being created, payable prior to recording of the minor subdivision. 4) Payment of the sewer interceptor fee in the amount of $435.00 for the new unit being created, payable prior to recording of the minor subdivision. 5) Planting of one boulevard tree and one front yard tree per unit, consistent with the City Code. 6) Enter into an agreement with the City regarding the abandonment of existing utility service connections. 7) Recording of development covenants to ensure complementary and consistent maintenance of the entire twin home building. Council member moved a second to this resolution, and upon being put to a vote it was unanimously adopted by all Council members present.
