This department previously assisted Chaska for the same major professional golf tournament in 2002. I have also attached the letter from Chaska Police Chief Scott Knight which describes the security duties our Officers will be volunteering to provide during this event. City Attorney Dan Fluegel has reviewed this JPA and advised he saw no issues with our city's participation. If you have any questions please do not hesitate to contact me. Thank You CITY OF CHASKA POLICE SERVICES JOINT POWERS AGR 2009 PGA CHAMPIONSHIP -AUGUST 10 AGREEMENT, Made this day of between the CITY OF a corporation, and the CITY OF CHASKA, a Minnesota (hereinafter "Chaska"); EEMENT -16, 2009 2009, by and Minnesota municipal municipal corporation WHEREAS, the Chaska Police Department has requested the aid and assistance of the-City of with the provision of policing services and other related activities at the 2009 PGA Championship, August 10 - 16, 2009; and WHEREAS, the cities of Chaska and are authorized to enter into an agreement authorizing the exercise of police powers within the jurisdiction of Chaska, pursuant to Minnesota Statutes, Section 471.59; and WHEREAS, it is in the best interest of the City of Chaska to enter into this Agreement in the interest of public health, safety and welfare. NOW, THEREFORE, the parties agree as follows: 1. PURPOSE. As requested by the City of Chaska, the City of will provide policing services at the 2009 PGA Championship and other related activities on August 10 - 16, 2009, in the City of Chaska. 2. COMMAND OF SCENE. The City of Chaska shall be in command of the scene and will make issue and duty assignments. When appropriate and practical, Chaska officers, at the request of City of officers, will handle the citing and arrests of persons, as circumstances require. The personnel and equipment of the City of shall be under the direction and control of the City of Chaska until the City of withdraws assistance. 3. WORKER'S COMPENSATION. Each party shall be responsible for injuries or death of its own personnel. Each party will maintain worker's compensation insurance or self-insurance coverage, covering its own personnel while they are providing assistance pursuant to this Agreement. Each party waives the right to sue any other party for any worker's compensation benefits paid to its own employee or volunteers. 4. DAMAGE TO EQUIPMENT.. Each party shall be responsible for damages to or loss of its own equipment. Each party waives the right to sue any other party for any damages to or loss of its equipment, even if the damages or losses were caused wholly or partially by the negligence of any other party or its officers, employees or volunteers. 5. LIABILITY. A. For the purposes of the Minnesota Municipal Tort Liability Act only (Minnesota Statutes, Section 466), the employees and officers of the City of are deemed to be employees (as defined in Minnesota Statutes, Section 466.0]., Subdivision 6) of the City of Chaska. B. The City of Chaska agrees to defend and indemnify the City of against any claims brought or actions filed against the City of or any officer, employee or volunteer of the City of for injury to,' death of, or damage to the property of any third person or persons, arising from the performance and provision of assistance pursuant to this Agreement. C. Under no circumstances, however, shall a party be required to pay on behalf of itself and other parties, any amounts in excess of the limits on liability established in Minnesota Statutes, Chapter 466, applicable to any one party. The limits of liability for some or all of the parties may not be added together to determine the maximum amount of liability for any party. 6. COMPENSATION. Officers will not be monetarily compensated for shifts worked. The City of Chaska will provide meals to uniformed officers working shifts. Officers will be offered from the Professional Golfers Association (PGA). a day of free admission to the Championship in exchange for each full day (minimum of 8 hours) of uniformed shift work. 2 7. SEVERABILITY. If any portion of this Agreement is found to be illegal, that portion of the Agreement shall be severed and the remainder of the Agreement shall remain in full force. 8. AMENDMENT. KNIGHT Chief of Police Dear f/Sheriff: s you may know, my city is the home of the Hazeltine National Golf Club. We have been the site of many major amateur and professional golf tournaments, such as the 1991 U.S. Open, 2006 U.S. Amateur, and the 2002 PGA Championship to name a few. This year -August 10 through 16 - we will host the 2009 PGA Championship. This tournament is one of golf's "Top Four" championships, with the other three being the Masters; the British Opeh, ahd the U.S: Open. I am the PGA Committee Chair of Public Safety and Security. My department has the command and control responsibility for law enforcement and security functions on the golf course. I term this as "inside-the-fence", which includes any and all tournament public safety and security functions occurring relative to actual player, spectator, vendor, and course protection needs. My area of command does not cover traffic control functions. Those functions will again be -expertly- handled by the Minnesota State Patrol. Our other partners are the FBI, ATFE, Secret Service, and US Postal Inspectors. Many metro and out-state officers have worked our past events, and have contacted us expressing an interest in working this 2009 event. Game-able to again offer interested officers (and spouses) a day of free admission in exchange for each day they'work. Many officers have a desire to work the entire event, because they get the "best seats in the house." Meals will be provided fior working officers. Uniformed officers would be assigned to duties such as: ^ Player escort (Primary) ^ Dignitary escort (Secondary) ^ High profile presence on the course Officers can be assured that a large contingent of private security will be employed and in place to staff the more routine, and mundane (yet important) assignments associated with this type of an event. Here is what I need from you: ^ Your approval of this use of any of your officers. ^ Getting this information out to your officers. ^ A Joint Powers Agreement between our units of government (a standard agreement, which I will provide for your review) I am happy to answer any questions you may have.
