HomeMy WebLinkAbout20090817 - VIII-A-2MEMO To: Honorable Mayor and City Council From: Tom Montgomery Date: August 6, 2009 Re: Approve Assessment Agreement for Sanitary Sewer Service Repair - 30o VV. 4th Street The Operations Committee met on August 3ra to consider the issue of a sewer service break at Mark and Deanna Platson's home at 30o W. 4111 Street. A copy of the memo to the Operations Committee on this issue is enclosed. Photos taken from the sewer main indicate that the Platsons' service line is broken approximately 3 feet from its connection with the main. City ordinance notes that homeowners are responsible for the maintenance and repair of their sewer service lines from their house to the sanitary sewer main in the street. However, the Platsons claim the sewer service was damaged during the 1999 4111 St. reconstruction project, noting that their sewer service problems began at that time. City staff questions this assumption, noting that the reconstruction work in this area consisted of a pavement overlay and a hydrant replacement and the lack of other service line problems in the area. Sewage is now draining directly into the ground. The Platsons blame the 4ti' St. reconstruction project in 1999 for the sewer failure. Staff does not support this contention as the street construction on this block was just mill and overlay construction, along with replacement of a hydrant that was 30 feet east of the Platson's sewer service. In addition, there were over 100 other sewer services within this project and we have received no other reports of sewer service problems, even though constn~ction in these areas was much more invasive than that over the Platson's service . As with water services, by ordinance, repair of sanitary sewer services are the homeowner's responsibility from the house all the way to the sewer main in the street. Public Works learned of the sewer service problem on June 11. The Platsons have received quotes for the sewer repair varying between $4,000 and $9,000, but have not yet iiutiated the repair work. Given the unsanitary situation with the broken service and the potential for creating a void under the road, Staff is requesting authorization to hire a contractor to repair the service and bill the Platsons for this work. The Platsons have indicated that the cost of this repair presents a financial hardship to them. Therefore, staff is also requesting approval to assess the repair work if the Platsons enter into the standard assessment agreement for utility service repair. Tnowtas M.
