Chair Peine called the meeting to order at 7:00 p.m.

Approval of Minutes
2. –March 23, 2009
Motion by Commissioner Stevens to approve the March 23, 2009, meeting minutes. Seconded
by Commissioner Vaughan.
Upon vote taken, Ayes 5, Nays 0. Motion carried.

3. – Minor Subdivision #2009-07 - 314 7 Street East.
Associate Planner Fortney provided the staff report.
Chair Schmitt opened the public hearing at 7:03
Amy Martin asked why this minor subdivision is happening after the construction has begun.
Chair Schmitt stated applicants may apply for a minor subdivision at any time before or after a
home is constructed. He added that it is done so the applicants can sell the properties
individually; similar requests have generally been supportive by neighbors in the past.
Martin said her concern is that if the building ever burned down, there could be 2 single-
family homes built on the two small lots. Fortney said the lots would not meet the standards
for single-family construction.
Chair Schmitt closed the public hearing at 7:09.
Commissioner Stevens asked if there is a way to have both sides of the twin home maintained
in the same manner. Planning Director Hinzman stated that in the past, the Planning
Commission has added a condition that a covenant be placed on the property requiring both
units to be maintained similarly.

Commissioner Vaughan asked if the NRRC had reviewed the proposal for park dedication.
Hinzman said the NRRC only reviews park dedication for plats; cash in lieu of land would be
paid for the one new unit created.
Motion by Commissioner Zeyen to approve the minor subdivision with the five staff
recommendations and the following 2 additional ones. Seconded by Commissioner Stevens.

Enter into an agreement with the City regarding the abandonment of existing utility
service connections

Record a covenant with the County requiring both parcels to maintain the exterior of
the homes at the same time with the same appearance

4. – Shoreland Variance #2009-06 - Minimum Lot Size and Width – 1016 1 Street
East.
Associate Planner Fortney provided the staff report.
Chair Schmitt opened the public hearing at 7:16
Commissioner Vaughan asked what comments the DNR had made. Fortney said while they
didn’t make a formal comment, they did say in general they don’t like to see a lot of these
types of variance granted often. Hinzman added that the DNR said they would have concerns
with a city routinely granting variances.
Commissioner Vaughan asked why the applicants are proposing a front width of 47’ instead of
the 50’ required by the zoning ordinance. Tim Likes, applicant’s representative, said that is
what they ended up with after giving the existing home its required 7-foot setback. He added
that this would allow a future garage to be rebuilt on the lot of the existing home.
Chair Schmitt asked if there was any way to require garage access onto the alley. He added
that if there wasn’t, the ordinance could be strengthened to require it. Hinzman said that
outside of the OHDS area it would not currently be a requirement.
Commissioner Stevens asked if it is necessary to add a condition that the driveway may not be
located on Adams Street. Hinzman said it is not necessary because it will be worked out when
building plans are submitted.
Chair Schmitt closed the public hearing at 7:20
Motion by Commissioner Stevens to approve the Shoreland lot size and width requirements
and the Zoning lot width requirement as proposed based on the following findings. Seconded
by Commissioner Vaughan.

Consistent with characteristics of development on adjacent properties.
Both of the
proposed lot sizes would exceed minimum requirements of the R-2 Zoning District and are
consistent with the property sizes of the immediate neighborhood. Furthermore, the lots are
preexisting and only their layout will be modified.

Preservation of natural features.
The proposed lot layout will preserve a mature tree and
lead to the demolition of two older garage/ sheds.
?
No adverse affect on Lake Isabel.
Lake Isabel cannot be viewed from the subject property.
The area storm water is collected by the storm sewer system, which does not discharge into
Lake Isabel. The property is over 730 feet from the lake.
?
No adverse affect on the Mississippi River.
The subject property is 235 feet from the river.
The proposed house would be located outside of the River’s shoreland.
Upon vote taken, Ayes 5, Nays 0. Motion carried.

5. – Ordinance Amendment #2009-02 – Industrial Park.
Planning Director Hinzman provided the staff report.
Chair Schmitt opened the public hearing at 7:24
Chair Schmitt closed the public hearing at 7:24 without any comment from the public
Vaughan asked if the staff has denied any proposed signs in the industrial park because they
were too big. Hinzman said not to his knowledge.
Motion by Commissioner Zeyen to recommend approval of the proposed ordinance
amendments. Seconded by Commissioner Peine.
Upon vote taken, Ayes 5, Nays 0. Motion carried.
OTHER ACTIONS

Planning Director Hinzman updated the Commission on past City Council and HEDRA
actions, informed them of upcoming items, and relayed the progress of the bridge planning
process.

Motion by Stevens to adjourn the April 13, 2009 Planning Commission meeting. Seconded by
Vaughan.
Upon vote taken, Ayes 5, Nays 0. Motion carried.
