HomeMy WebLinkAbout20091019 - VII-1 & VIII-A-1 MEMO To: Honorable Mayor and City Council From: Nick Egger – City Engineer Date: October 14, 2009 Re: Public Hearing – 2008 Infrastructure Improvement Program Assessments The Public Hearing for the 2008 Infrastructure Improvement Program Assessments will include the following projects: thththth 2008-1 North Vermillion Area – 6, 7, 8, and 9 Streets west of Vermillion thth Street (TH 61) to Spring Street, Spring Street between 6 Street and 10 ththth Street, Eddy Street from ½ block south of 5 Street to 10 Street, 7 and th 8 Streets east of Vermillion Street to Bailly Street, and Sibley Street thth between 6 Street and 8 Street, alleys from Vermillion Street west to thth Eddy Street between 6 and 8 Streets, and the alley from Vermillion thth Street east to Sibley Street between 7 and 8 Streets nd 2008-2 Downtown Street & Watermain – Ramsey Street north of 2 Street, on ndstst Tyler Street north of 2 Street to 1 Street, and on 1 Street from Tyler Street east to Lea Street, Trunk Watermain construction between TH 61 right-of-way and Lea Street, new street lighting on Ramsey and Tyler nd Streets north of 2 Street, and bituminous trail construction between the strd intersection of Tyler and 1 Streets south to the intersection of 3 and Bailly Streets. AP SSESSMENT OLICY Under the City’s assessment policy, assessments are based on the benefit received from the improvement and not on the cost to construct the improvement. Benefit is defined as the increase in property value directly attributable to improvement constructed. The policy assesses properties based on 90% of estimated benefit received from the improvements and reduces the assessment to the long side of a corner lot to 25% of the estimated benefit front foot cost. Properties that abut alleys which are reconstructed are also assessed for 25% of the abutting frontage. AR: $60/Frontage Foot SSESSMENT ATE This rate is unchanged from the February2008 Feasibility Report P2008-2DS&W ROJECT OWNTOWN TREET ATERMAIN PFS ROJECT UNDING UMMARY FS A UNDING OURCESMOUNT Assessments$79,117.18 Water Fund $266,629.28 Wastewater Fund$59,617.46 WAC Fund $395,468.44 Dakota County CDA Grant $250,000.00 Bonded Debt $535,740.24 Total Project Costs $1,586,572.60 I MPROVEMENTS This project involved reconstruction of utilities and street surfaces on both Ramsey and ndst Tyler Streets north of 2 Street, and replacement of pavement on 1 Street from Tyler Street to Lea Street. A trunk watermain was installed through Levy Park from near the st Highway 61 right of way on the western end of the park and beneath 1 Street to Lea nd Street, with a connection to a roughed in section of watermain beneath 2 Street near the CP Railroad crossing along the eastern side of the recently replatted Riverfront Addition. New street lighting was installed on Ramsey and Tyler Streets in the project area, and a new trail segment was also constructed along the eastern side of the Riverfront Addition, rd south through Block 16 to 3 Street. AR: This project was also assessed on a $60/front foot rate, with the vast SSESSMENT ATE majority of the assessment falling on the parcels in the Riverfront Addition. The City also made an agreement to waive the assessment that would have been placed on the Graphic Design property in exchange for the concession of a piece of property covering a portion of Tyler Street such that it would be reverted back to City right-of-way. CAR OUNCIL CTION EQUESTED Council is requested to approve the enclosed resolutions adopting the proposed assessments for the 2008 Street and Utility Improvement Programs. CITY OF HASTINGS DC,M AKOTA OUNTY INNESOTA Resolution No. RA ESOLUTION DOPTING THE ASSESSMENTS FOR THE 2008-1NVASUI ORTH ERMILLION REA TREET AND TILITY MPROVEMENTS WHEREAS pursuant to proper notice duly given as required by law, the City Council of , the City of Hastings has met, heard, and passes upon all objections to the proposed assessments for the improvements of: thththth 2008-1 North Vermillion Area – 6, 7, 8, and 9 Streets west of ? th Vermillion Street (TH 61) to Spring Street, Spring Street between 6 Street thththth and 10 Street, Eddy Street from ½ block south of 5 Street to 10 Street, 7 th and 8 Streets east of Vermillion Street to Bailly Street, and Sibley Street thth between 6 Street and 8 Street, alleys from Vermillion Street west to Eddy thth Street between 6 and 8 Streets, and the alley from Vermillion Street east to thth Sibley Street between 7 and 8 Streets These improvements included street, water, sewer, and storm sewer reconstruction, and sidewalk construction and reconstruction. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: The proposed 2008-1 North Vermillion Area Improvement Program assessments, 1. a copy of which is filed with the Hastings Engineering Department, are hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the constructed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable with the first property tax installment of 2010, and shall bear interest at the rate of 5.50% per annum from November 18, 2009. To the first installment shall be added interest on the entire assessment from November 18, 2009 until December 31, 2009. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole or part of the assessment on such property with interest accrued to the date of the payment to the City Clerk, except that no interest or Dakota County assessment certification fee shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the County Treasurer the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before December 30, or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith, transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the Count, and such assessments shall be collected and paid over in the same manner as other municipal taxes. $561,973.00 5.
