Chair McInnis called the meeting to order at 7:00 p.m.

Approval of Minutes
2. –September 28, 2009
Motion by Commissioner Zeyen to approve the September 14, 2009, meeting minutes as
presented. Seconded by Commissioner Stevens
Upon vote taken, Ayes 6, Nays 0, Abstain 1 (Slaten) Motion carried.

City of Hastings – Variance #2009-29 – Side setback for a deck to a Non-conforming

Structure – 312 East 4 Street
Associate Planner Fortney provided the staff report. The applicant is proposing to build a
deck with pergola on the rear of his home. The applicant’s home was constructed about one
foot over the property line. The deck is narrower than the home, but will not meet the required
5-foot setback from the west property line. The applicant is applying for a 3-foot 5-inch
Sideyard variance to build the proposed deck. Adjoining neighbors were notified of the
request and staff has not received any comments. The HPC approved the proposed deck
design.
Commissioner Slaten asked why the City had not ever required the property lines to be
adjusted to correct the encroachment of the house. Fortney said that staff would not
knowingly allow structures to be built over property lines, but this occurred often in the City’s
historic areas. Fortney added that if a structure is believed to be over a property line, the
property owners involved would remedy the situation.

Motion by Commissioner Stevens to approve the variance for the deck at 312 4 Street E. based
on the following findings of fact and hardships Seconded by Commissioner Slaten, with the
condition that the variance only apply to the deck.

The existing home was constructed in 1860 before the establishment of any zoning setbacks.

The proposed addition does not increase the nonconformity of the home.

The special conditions and circumstances do not result from actions of the applicant.
Upon vote taken, Ayes 7, Nays 0. Motion carried.
ADJOURNMENT
Motion byZeyen to adjourn the October 26, 2009, Planning Commission meeting. Seconded
by Vaughan.
Upon vote taken, Ayes 7, Nays 0. Motion carried.
The meeting was adjourned at 7:09 p.m.
