A (3) (h) relating to Portable Sign Regulations. The proposed amendment changes the following: 1) Allows smaller portable signs (sandwich boards) downtown. Presently all portable signage is prohibited downtown. 2) Exempts portable signage under 16 s.f. from needing a permit, provided the signs are removed nightly. 3) Requires portable signage over 16 s.f. and those not removed nightly to apply for a portable sign permit. st The City Council held the 1 reading and called for the public hearing at its November 2, 2009, meetings. PLANNING COMMISSION ACTION At its September 28, 2009, meeting, the Planning Commission recommended approval (5-0) of the Sign Ordinance with three recommendations. These recommendations included to review how different districts are treated, receive feedback from downtown districts, and the length of time signs are allowed. Staff has modified the ordinance to address how different districts are treated and the length of time signs are allowed. In addition, the Chamber of Commerce and Hastings Downtown Business Association were notified of the proposed Ordinance Amendment. BACKGROUND Staff proposes the attached ordinance amendment to better match the existing use of portable signage by businesses. The existing ordinance prohibits portable signage downtown, and requires a permit for all portable signage regardless of size. REVIEW Planning Committee of City Council The Planning Committee met on July 10, 2009, to review portable sign issues. The ordinance changes reflect the direction from the Committee. Historic Preservation Committee (HPC) The HPC reviewed the amendment at its August 18, 2009 meeting. The Commission requested the language to be clearer in the ordinance as to how signage would be determined to “complement the nature of downtown.” Staff will work to determine review standards independent of the ordinance. A OF THE CITY OF HASTINGS, MINNESOTA CODE OF ORDINANCES PERTAINING TO: PORTABLE SIGNS BE IT ORDAINED by the City Council of the City of Hastings as follows: 155.08 (A) (3) (h) of the City of Hastings, Minnesota Code of Ordinances is hereby amended as follows: § 155.08 SIGNS. (A) General provisions. (3)Generally. The following are minimum requirements. (h)Portable signs are allowed in all commercial districts, except within the Downtown Overlay District, in addition to permanent signs, only by temporary permit issued by the Planning Department according to provisions established under division (E) below. Portable signs may not exceed 32 square feet in size or 6 feet in height. The length of permits for portable signs shall be either 15 or 30 days. Permits for portable signs may be obtained for no more than 60 days per legal parcel per year. Only 1 portable sign per legal parcel may be permitted at a time. Portable signs may not be situated within any public street right-of-way or easement. Portable sign permit fees shall be established by resolution of City Council. (h)Portable signs are allowed in all commercial districts as follows: nd 1.Properties zoned DC (Downtown Core) or within the East 2 Street Historic District are allowed to have one portable sign per business. The sign shall be no greater than eight (8) square feet in size, six (6) feet in height, and shall not substantially impede pedestrian traffic along the sidewalk. Signs may not be left outdoors overnight. Signage shall complement the historic nature of downtown. 2.Commercial Districts, excluding the DC (Downtown Core) and nd East 2 Street Historic District, are allowed to have one portable sign per business. A sign permit is not required if 1) The sign is less than sixteen (16) square feet in size and six (6) feet in height and 2) The sign is not left outdoors overnight. 3.Portable Sign Permit (Excluding the DC (Downtown Core) and nd East 2 Street Historic District). The following signs may be allowed subject to a Portable Sign Permit issued by the Planning Department with fees established by resolution of the City Council: 1) Signs between sixteen (16) and thirty-two (32) square feet or 2) Signs left outdoors overnight. The permit is limited to a maximum of 60 days per calendar year per parcel. 4.Additional Regulations. Portable signage may not be situated within any public street right-of-way or easement, unless the building has a zero front yard setback. Portable signs over thirty- two (32) square feet and six (6) feet in height are prohibited.
