Re: 2010 Metropolitan Council Transit Funding Management Plan Amendment

Council Action Requested:
Approve the 2009 management plan amendment for extending the funding agreement with Met
Council through May 31, 2010.
Background Information:
Due to a restructure of the Metropolitan Council's Dial-a-Ride program, funding for the City of
Hastings will end in 2010, when the new TransitLinlc program begins to operate within Dakota
County. Met Council has proposed an amendment to the 2009 funding agreement to extend it
through May 31, 2010 at the current funding level. The 2009 funding amount is $250,841. The
2010 funding amount for January-May, 2010 is $104,515.
That extension will allow the Cite to continue to operate the TRAC program in its current
capacity through May 31, 2010. City staff has been meeting with the Transit Committee of the
Council to determine what local transit the City- may offer after the MaV 31, 2010 transition.

As you know, the transit subsidy agreement between the city of Hastings and the
Metropolitan Council will expire on December 31, 2009. Implementation of the Transit
Link service in Dakota County will begin on May 1, 2010. As mentioned in a letter sent
to you on August 4, 2009, we will be extending the contract through May 31, 2010.
Enclosed you will find two copies of the contract amendment. Please sign and return both
copies na later than November 20, 2009.

FIRST AMENDMENT TO
PERFORMANCE BASED PUBLIC TRANSIT FUNDING AGREEMENT
BETWEEN THE METROPOLITAN COUNCIL AND
CITY OF HASTINGS
The Metropolitan Council (the "Council") and City of Hastings (the "Contractor") agree
that Council Contract No. 08P 193 shall be amended in the following particulars:
1. Contract Term and Maximum Subsidy Amount, The parties agree that the
Contract Term and Maximum Subsidy Amount as shown on page 1 of Council Contract
No. 08P 193 shall be amended as shown below:

Reimbursement: Funding under this Agreement is neither a block grant for assistance
nor a minimum guarantee. In accordance with section 7.01 and subject
to the limitations in sections 7.02 and 7.03, the Council agrees to
reimburse the Contractor for the subsidised service outlined in the
Contractor's approved Management Plan and budget provided during the
Contract Term the lesser of: the Net Servicc Cost or the Maximum
Subsidy Amount.

2. Ratification. The remaining provisions of the above-referenced agreement shall
