Subject: Outside Vendor Permit
The subject matter has arisen as the City of Hastings is seeking and has secured additional
tournaments primarily at Veterans Park on ways to handle inquiries from the local
business community who wish to sell items at these tournaments. Currently, the City has
no policy or practice for allowing such sales.
In our attempt to create a climate of partnership and also meet fiduciary responsibilities on
the City’s part, I have enclosed a draft of a vendor permit the department has been working
on. This permit allows the opportunity for a private vendor to sell items at specified events
and in turn, the City receives a portion of the proceeds.
In our research of what other communities offer in this type of situation, most seem to
receive compensation in terms of a percentage of sales. It is felt this would be hard to
administer. In addition, the City will work with the vendor in attempting not to sell similar
product, but with our exclusive agreement with a beverage provider, the City will sell all
beverages.
I welcome any feedback regarding this new practice of allowing vendors to sell items.

Above vendor will pay a $175 concession stand permit fee (to accompany this application.)

FOOD vendors must have in possession on day of event with an original copy of the SPECIAL EVENT LICENSE
?
issued by Dakota County, MN Department of Health, or MN Department of Agriculture. Call 651-554-6100 or
visit the County’s website at www.dakotacounty.us under the Public Health Department.
A Certificate of Insurance (General Liability) in the amount of $50,000 per person / $100,000 per occurrence,
?
and naming the City of Hastings as an additional insured, shall be sent to the City of Hastings prior to your
event.
Alcoholic beverages are not to be sold if the event is a youth event determined by the Hastings Parks &
?
Recreation Department or other governing body, for example, MYSA, ASA, or USSSA.
The Parks & Recreation Department determines the size and location of your vending area.
?
The vendor permits will be handled on a first-come, first-served basis. Only limited vendor locations are
?
available.
The Parks & Recreation Department may not permit a vendor wanting to sell an item/similar item that is
?
currently being sold by the concession stand operated by the City. This will include food, beverage, or apparel
sales. The City of Hastings will attempt to avoid approving multiple vendors that sell similar products. The City
will attempt to work with vendors on a case by case basis.
Vendor applications must be received in the Hastings Parks & Recreation Office with payment at least two
?
working days prior to the event date.
If severe weather occurs and the event is postponed or cancelled, vendor will receive a refund of the permit
?
fee if the cancellation occurs within the first 6 hours or 50% of the total event time, whichever comes first. If
the event has run longer than 6 hours or 50% of the total event time, no refund of permit fee will be issued.
Vendor is responsible for supplying staff, tables, chairs, equipment, and signage.
?
Vendor is responsible for all clean up of assigned area at end of event.
?
City of Hastings does not assume the role of employer for any vendor contracted through the Parks and
?
Recreation Department. City of Hastings acts only as a sponsor for the vendor and assumes no responsibility
in the areas of payment of FICA taxes, workman’s compensation, or unemployment benefits.
The vendor agrees to indemnify, defend, and hold harmless the City of Hastings, its officers, and employees
?
for any and all claims arising out of the vendor’s activities related to the services provided under this
agreement.
The City of Hastings assumes no responsibility for any lost or stolen equipment/product.

Sales must be completed by 10:00 PM each night of the event.
