Roll Call Commissioners Present: Alongi, Greil, Hollenbeck, Mcinnis, Schmitt, Truax, Twedt Staff Present: Planning Director John Hinzman, Associate Planner Kris Jenson, Planning Intern Courtney Wiekert 2. Approve March 22, 2004 Planning Commission Meeting Motion by Commissioner Truax, seconded by Twedt to approve the minutes of the March 22, 2004 Planning Commission as presented by staff. Motion passed unanimously. 3. Matthew Freiermuth - Variance #2004-18 - Sideyard Setback to allow an addition on a non-conforming garage - 2112 Pine Street. Planner Jenson presented a brief summary and background for a variance to allow an extension a non-conforming garage. Commissioner Truax asked if the extension of the exterior of the garage will be the same as the existing garage and if changes will be made to the existing garage as requested under fire code. Planner Jenson confirmed with Matthew Freiermuth stating the extension of the garage will be the same as the existing garage. She also stated that both the existing and extension of the garage will be fire rated to building code requirements. Planning Commission Action: Commissioner Alongi moved and Commissioner Schmitt seconded the motion to recommend approval of the Matthew Freiermuth variance, with the 3 recommendations listed, to the City Council. 1) 2) A building permit is required prior to construction of the addition. The soffit on the south side of the garage - of the addition and the existing portions - must be fire rated to building code requirements. 3) Approval is subject to a one year Sunset Clause; if significant progress is not made towards construction of the proposal within one year of City Council approval, the approval is null and void. Upon vote taken: Ayes: 7, Nays: O. Motion passed. 4. Dean Snyder Construction - Site Plan #2004-14 - Construction of a Culvers Restaurant - 1713 Market Blvd. Director Hinzman presented a brief summary on the site plan for the construction of a Culvers Restaurant. Commissioner Alongi asked for additional methods from Dean Snyder Construction on the parking spaces after the drive-thru window. Dale Snyder, Dean Snyder Construction, stated that they will look at other options for parking after the drive-thru window to increase the green space between the drive-thru and Market Blvd. They will bring the alternative options back to Planning Director Hinzman. Also, they will provide other options on the trash and recycling receptacles as requested by the staff. Mr. Snyder asked on behalf of the owner if the city would allow a concrete parking lot. Director Hinzman stated he was unsure and would ask the City Engineer for comments. Commissioner Alongi asked what the other roof tops are like on the other buildings in the area. Director Hinzman responded that most of the roofs in the area are red; otherwise, they did not have a pitched roof top. He also included that most of the lettering in the area was red; however, Cub Foods does have blue lettering on their "Pharmacy" sign. Commissioner Twedt requested that they ensure a better flow of traffic compared to other drive-thru windows in the city. Planning Commission Action Commissioner Truax moved and Commissioner Hollenbeck seconded the motion to approve the Site Plan Review for Culvers Restaurant, with the 20 conditions, to the City Council. 1) The sidewalk along the south side of Market Blvd must be constructed prior to certificate of occupancy for the building. Truck deliveries to the site shall be limited to South Frontage Road only. 2) 3) The block and fascia colors of the building must be consistent with the brown earth tones of the neighboring buildings. 4) 5) 6) 7) 8) 9) 10) 11 ) 12) 13) 14) 15) 16) 17) 18) The trash and recycling enclosure must be constructed of materials to match the restaurant building and include plantings to help screen\buffer the structure. Boulevard trees must be planted at spacings of no less than 50 feet along all public right-of-ways. Boulevard trees must be deciduous and at least 2.0 caliper inches at planting. All landscaping and plantings shall be irrigated. An escrow account must be established to ensure completion of outstanding site improvements, including landscaping prior to certificate of occupancy. A designated off street loading area of at least 250 square feet must be identified on the Site Plan and kept free of parking as stipulated in the Zoning Ordinance All parking and drive aisle areas shall be constructed to City standards including bituminous or concrete surfacing and concrete curb and gutter. All disturbed areas on this property shall be stabilized with rooting vegetative cover to eliminate erosion problems. The disturbed areas of the site shall be maintained to the requirements of the City's property maintenance ordinance. Final approval of the development grading and utility plans by the City of Hastings. The applicant shall be liable for any costs involved in consultant review of the plans. Any rooftop equipment must be completely screened from the front elevation, any part of the roof top equipment that is visible from any other elevation must be painted to match the building on which the equipment sits. Monument signs shall be architecturally consistent with the buildings on site and incorporate similar materials into their construction. Lighting must incorporate cut-off shields and be directed onto parking lot areas. Adherence to the provisions of the Development Agreement for HASTINGS MARKETPLACE, including assessments for utility and roadway improvements. Submission of an electronic copy of all plan sets (TIF, PDF, or similar format) prior to issuance of certificate of occupancy. Approval is subject to a one year Sunset Clause; if significant progress is not made towards construction of the proposal within one year of City Council approval, the approval is null and void. Upon vote taken: Ayes: 7, Nays: O. Motion passed. 5. Siewert Construction - Site Plan Review #2004-16 - Construction of a 36 Unit Condominium Building - Lot 1, Block 7 Riverwood ¡th ADDITION - Southwest Corner of 31 st & County Road 46. Director Hinzman presented a brief summary of the Site Plan Review for the construction of a 36 unit condominium building for Riverwood 7th ADDITION. Commissioner Truax asked for clarification if this development would be a condominium or apartments. He stated that some of the documents show that it is an apartment and other documents show that it as a condominium. Todd Siewert, Siewert Construction, stated the City Council recommended these units to be condominiums from the previous platting of Riverwood in 2000. He clarified they will continue to build them like condos, but they will be held by Siewert and rented out individually. Commissioner Alongi asked why the City Council requested for condominiums and not apartments from the previous meetings. Mr. Siewert understood the Council previously wanted market rate buildings in the city. Commissioner Twedt asked if Siewert Construction would have any problems making changes to the landscape recommendations and the other recommendations in the report. Mr. Siewert responding stating they would have no problems making changes the City requests. Chairperson Greil made comments on the architecture of the building and asked if they could be more creative in the design to ensure the city will be happy with the building in 30 years. Dave Harris, Project Architect, stated that if they made more changes to the unit, the cost for living in the unit would be much higher. He clarified the breaks and varying positions of the building to the Commissioners. Commissioner Schmitt asked if there were breaks on the roof lines. Mr. Harris clarified the projections on the roof lines. Planning Commission Action: Commissioner Twedt moved and Commissioner Alongi seconded the motion to recommend approval of the Site Plan Review for the 36 Unit Condominium of Riverwood ¡th addition, with the 10 conditions, to the City Council. Vehicular access to County Road 46 shall be prohibited. 1) 2) All disturbed areas on this property shall be stabilized with rooting vegetative cover to eliminate erosion problems. 3) Final approval of the grading, drainage and utility plans by the Public Works Director, and reimbursement for any fees incurred in review of the development. The owner assumes all risks associated with the grading and utility placement prior to formal approvals. 4) Boulevard trees must be planted at spacings of no less than 50 feet along all public right-of-ways. One boulevard tree must be added south of the entrance on 31st Street. Trees must be added along County Road 46. 5) Trees planted under overhead power lines should be substituted for a lower growing species to the satisfaction of the City Forester. Amur Choke Cherry trees are recommended. 6) All waste refuse facilities shall be contained in a fully enclosed building. Dumpsters outside of buildings shall be prohibited. 7) All parking areas must be constructed of bituminous surfacing and concrete curb and gutter. 8) 9) All landscaped areas must be irrigated. Any uncompleted site work (including landscaping) must be escrowed for prior to issuance of a certificate of occupancy. 10) Submission of an electronic copy of all plan sets (TIF, PDF, or similar format) prior to building permit submittal. 11 ) Approval is subject to a one year Sunset Clause; if significant progress is not made towards construction of the proposal within one year of City Council approval, the approval is null and void Upon vote taken: Ayes: 7, Nays: O. Motion passed. 6. Siewert Construction - Site Plan Review #2004-13 - Riverwood ¡th ADDITION Townhomes - Riverwood Drive and Woodland Drive Intern Courtney Wiekert presented a brief summary of the Site Plan Review for the construction of townhome units for Riverwood 7th ADDITION. Commissioner Alongi asked if this plan was presented to the City Council like the 36 unit condominium. Director Hinzman stated that the plat was previously approved, however individual architectural elevations and landscaping included in the site plan application was not. Commissioner Truax asked if the backs of the building will be positioned to eliminate a mirror image of each unit. Director Hinzman responded that most of the backs will not be facing the street; instead they will be facing towards the backyards. Todd Siewert, Siewert Construction, also clarified that these units will have basements and different building positions to break up the view of the buildings. Planning Commission Action: Commissioner Mcinnis moved and Commissioner Schmitt seconded the motion to recommend approval of the Site Plan Review for the Townhome units of Riverwood ¡th addition, with the 8 recommendations. 1) All disturbed areas on this property shall be stabilized with rooting vegetative cover to eliminate erosion problems. 2) Final approval of the grading, drainage and utility plans by the Public Works Director, and reimbursement for any fees incurred in review of the development. The owner assumes all risks associated with the grading and utility placement prior to formal approvals. 3) 4) Boulevard trees must be arranged at least 50 feet apart. All landscaped areas must be irrigated. 5) All abutting driveways serving multiple unit buildings must have a minimum three foot landscaped separation between the driveways, extending from the unit to at least 8 feet behind the curb, and shall incorporate landscaping adjacent to the garage at the common property boundary. 6) Any uncompleted site work (including landscaping) must be escrowed for prior to issuance of a certificate of occupancy. 7) Submission of an electronic copy of all plan sets (TIF, PDF, or similar format) prior to submittal of a building permit. 8) Approval is subject to a one year Sunset Clause; if significant progress is not made towards construction of the proposal within one year of City Council approval, the approval is null and void. Upon vote taken: Ayes: 7, Nays: O. Motion passed. 7. City of Hastings - Zoning Ordinance Amendment #2004-02 - Amend Section 10.12, Subd. 2d - Home Occupation Regulations. Director Hinzman presented a brief summary on the revisions for the zoning ordinance amendment on Home Occupation Regulations. Commissioner Twedt asked if the ordinance did not regulate interior floor percentage than how would the city be able to regulate home businesses. Chairperson Greil responded the city would only regulate any exterior use for home businesses. Commissioner Alongi suggested the city should not enforce any interior spaces and only the exterior uses of their homes. Commissioner Truax commented that the ordinance is trying to separate residential to commercial use. It is to keep "larger" business in commercial districts and not in residential neighborhoods. He states that it is not to regulate traffic and parking. Director Hinzman suggested including additional comments in the purpose section of the zoning ordinance. Commissioner Alongi feels that the city would likely have difficulty determining what space within the building was used for business versus residence. And that interior inspection is difficult to enforce. Commissioner Schmitt asked if it is necessary to regulate percentage on the interior of homes. Chairperson Greil asked if this ordinance amendment started with the Photography Studio and if this affect the existing Studios in the City. Director Hinzman stated that it does not affect the existing Photography Studios. Planning Commission Action Commissioner Schmitt moved and Commissioner Hollenbeck seconded the motion to approve the Home Occupation Zoning Amendment subject to the following conditions: a. Remove section 3c - Not more than 15% of the floor area of the dwelling unit, including the basement, may be used in the conduct of the home occupation. b. Remove section 4c - Not more than 25% of the floor area of the dwelling unit, including the basement, may be used in the conduct of the home occupation. c. Remove the last sentence in 4g - In no case shall the home occupation occupy more than 33% of the structure. d. Add section 2d to the purpose statement - The home occupation shall be conducted indoors and shall be clearly incidental and subordinate to its use for residential purposes by its occupants. Upon vote taken: Ayes: 5, Nays: 2. Motion passed. 8. Other Business Director Hinzman stated the April 26, 2004 meeting may be cancelled due to an APA conference he will be attending in Washington DC. He will only hold a meeting if there needs to be immediate action on a project a resident may wish for approval. He will send notification to the Commissioners by Friday, April 16th. Hinzman stated the next Planning Commission meeting would be held on May 10th, 2004. Adjournment With no further business, the meeting was adjourned at 8:30 pm.
