HomeMy WebLinkAbout19930916 MemoMEMORANDUM DATE: September 16, 1993 TO: Charter Commission Members FROM: Dave Osberg, City Administrator SUBJECT: Charter Change, Mayor, Law Enforcement At the Charter Commission meeting conducted on Thursday, August 19, 1993 City Attorney Shawn Moynihan and I were directed to review Section 3.06 of the City Charter which outlines the provisions associated with the Mayor serving as the Head of the Law Enforcement Department in the City of Hastings. The basic direction provided to City Attorney Shawn Moynihan and me was to "clean-up" the language, to be certain it reads more clearly, and spells out the proper responsibilities of the Mayor as it relates to the Police Department. Attached members of the Charter Commission will find this draft as prepared by Gity Attorney Shawn Moynihan and me. Please take an opportunity to review this draft, as it will be discussed at the next Charter Commission meeting to be conducted on Thursday, October 14, 1993. Regarding the next Charter Commission meeting scheduled for October 14, 1993, you may recall that I indicated that this meeting could be -conducted in the "new City Hall". Unfortunately, the optimism I had on August 19, 1993 has slowly been taken over by a more realistic date for location in the new building, thus the Charter Commission meeting scheduled for Thursday, October 14, 1993 will be conducted in the Council Chambers in the existing CitvJ~all. 100 Sib[ev S#reet. MAYOR LAW ENFORCEMENT ~ U SEC O The Police Department of the City of Hastings shall be administered and directed by the Chief of Police. The Department shall be composed of the Chief of Police and such other number and rank of personnel as may be authorized and budgeted for by the City Council. The Chief of Police shall be accountable to the Mayor for the administration, efficiency, effectiveness and discipline of the Police Department. The Chief of Police shall also be accountable to the Mayor for the deployrr-snt of Police Department personnel. The Mayor shall be the appointing authority for purposes of appointment, promotion or dismissal, in consultation wi#h the Chief of Police, and so governed by civil service rules. The Chief of Police sha11 be appointed by the Mayor with approval of the City Council, as so governed by civil service rules. All persons appointed or promoted to the Police Department shall be persons qualified and certified by the Hastings Police Civil Service Commission in accordance with the Ordinances of the City of Hastings and Minnesota State Statutes. The Mayor may appoint citizens, including City Councilmembers, to a committee to advise the Mayor on Police Department matters. The authority of the committee shall be advisory only.
