The City Council of the City of Hastings, Minnesota met in a regular meeting
on Monday June 7, 2004 at 7:00 p.m" in the City Hall Council Chambers at the
Hastings City Hall, 101 East 4th Street, Hastings, Minnesota.

Mayor Werner asked if there were any corrections or additions to the minutes
of the regular meeting of May 17, 2004. Hearing none, the minutes were approved

Public Hearing-City Code Amendment #2004-16: Rezoning A to R-3-Williams
2nd Addition (Whispering Lane & Featherstone Road)
Mayor Werner opened the public hearing at 7:02 p.m.
Planning Director Hinzman provided a brief background on the project. A
comment by John Swanson, 1350 Featherstone Road, was read into the record. Mr.
Swanson is concerned that the R-3 zoning will give the developer an opportunity to
construct multiple family homes on the site, Hinzman stated that the zoning is
consistent with the surrounding properties and that the builder is proposing single
family homes on the site.
Harold Featherstone requested a 15-foot conservation easement. The
developer has already agreed to a 10-foot conservation easement, per Mr.
Featherstone's earlier request.
Larry Christianson, 275 Whispering Lane, questioned why the property could
not be rezoned solely for single family development. Planning Director Hinzman
stated that the R-3 designation is generally used in subdivisions, the proposed lots
do not meet the R-1 minimum lot size, and the R-2 zoning designation has
traditionally been used for properties developed prior to 1960.
Hearing no further public comments, Mayor Werner closed the public hearing
at 7:07 pm.
Second Reading-City Code Amendment #2004-16: Rezoning A to R-3-
Williams 2nd Addition (Whispering Lane & Featherstone Road)
Councilmember Schultz requested clarification on the request for a 15 foot
easement instead of the 10 foot easement. The developer stated that they have
agreed to the request for a 10 foot easement, but would not agree on a 15 foot
easement. Mr. Featherstone stated that he understood his request to be a total of 15
feet, with the 5 foot setback.
Councilmember Yandrasits requested clarification on the action to rezone to a
higher density.
Moved by Councilmember Yandrasits, seconded by Councilmember Schultz to
approve the code amendment, rezoning from A to R-2 (not R-3).

Public Hearing-Project 2004-4: 10th Street & Highway 51 Improvements
Mayor Werner opened the public hearing at 7:17 p.m.
Public Works Director Montgomery stated that the project is estimated to cost
$884,000. The Schoolhouse Square development will be assessed and estimated

approve the resolution as presented.

Approve Engineering Department Human Asset and Succession Plan
Mayor Werner suggested that staff review the ethics ordinance to ensure no
conflict of interest with David Gurney being hired as a consultant after he retires.
Werner also suggested a sunset provision on the Acting City Engineer position, in the
case that the ACE doesn't pass the P .E. exam (after two successive attempts at the
test, for example).
Moved by Council member Moratzka, seconded by Councilmember Riveness
to approve the plan as presented.

The Council discussed conducting a comprehensive City analysis of water
supply and quality.
Moved by Councilmember Moratzka, seconded by Councilmember Schultz to
approve the closure of Well #1 as requested, hold off on authorizing a test well at
Conzemius Park, and develop a comprehensive water study.

Resolution-Minor SubdivisionNariance #2004-25: Kupser Lane Properties

Planning Director Hinzman stated that the Planning Commission
recommended approval of both the minor subdivision and the variance. Staff is
recommending denial of the variance, in that the applicant has the opportunity to
create a condominium which would not require a variance.
The applicant, Wendy Kupser, was asked why she is pursuing a variance
rather than a condominium. She stated that two legal opinions recommended
against creating a condominium.
Moved by Councilmember Riveness, seconded by Councilmember Yandrasits,
to approve the minor subdivision as recommended.

Planning Director Hinzman presented a letter from developer Todd Siewert,
which stated that the 36-unit building in Riverwood will be owner-occupied.

City Administrator Osberg stated that after a comprehensive process, he is
recommending the appointment of Barry Bernstein as Parks & Recreation Director,
with an anticipated start date of July 12, 2004. Osberg thanked everyone who was
part of the hiring process.

8 Regarding Parking Regulations in Municipal Parking Lots and City Streets
City Administrator Osberg stated that staff has worked over the last several
months to coordinate these two chapters with universal definitions and general
agreement between the chapters regarding parking and storage of vehicles on both
public and private property.
Moved by Councilmember Yandrasits, seconded by Councilmember Hazlet to
conduct the first reading and order a public hearing for Ordinance Amendments to
Chapter 18 Regarding Certain Property Maintenance Requirements on June 21,
2004.

Add Agenda Item - Pay Bills As Audited, Payment for 31 st St. ROW
Council is requested to add approval of the payment for the 31st St. Right of Way
to Consent Agenda item #1, Pay Bills As Audited. Council approved the right of way
acquisitions agreement with the National Guard Armory at the June 7th meeting. The
State has not signed the agreement warranty deed yet, but their approval is expected
before the next Council meeting on July 6th. Council is requested to approve release of
the $16,967.70 payment, so that the Finance Department can cut a check once the State
has signed the deed.

In our continuing efforts of building maintenance excellence, it was noted that
along with the new roof that was put on City Hall last fall, we also acquired shiny new
downspouts. The old downspouts had been painted to match the buildings trim, so we
looked into having the new downspouts painted. As we did so, it was noted that the South
Entrance Canopy as well as the North Entrance Pillars were also in need of attention.
So, bids were solicited for sandblasting and painting the canopy and six pillars and
painting the six downspouts. Two bids were received.

Recommended CitY Council Action
The City Council is asked to take action authorizing execution of an agreement with the
Hudson Hot Air Affair for balloon launch(s) for the Grand Excursion. Staff will be
continuing to work on the final details of the agreement, with the understanding that the
basic content of the agreement will mirror the attached agreement. Final revisions of
the agreement may take place after the City Council meeting, such as exact numbers of
balloons, insurance ,etc. which will all be reviewed for legal and insurance provisions.
One issue that is required from our insurance, is that no passengers will be allowed in
these balloons.

Long Term Disability Change
Council Action Requested:
Approve participation of the City's long term disability policy in the League of
Minnesota Cities Insurance Trust Pool.
Background Information:
The City currently purchases long-term disability through Assurant (formerly
Fortis). We have the opportunity to purchase the same coverage through the
LMCIT's Municipal Pool. The City of Hastings currently purchases its long-term
care policy through the LMCIT's Municipal Pool. There are currently over 66
Minnesota cities and counties in the pool. Rates are negotiated, and by joining
the Municipal Pool for the City's long-term disability coverage, a 10% rate
savings would be achieved. This results in a savings of approximately $2,300
annually.
No provisions or conditions of the coverage would change as a result of joining
the Municipal Pool.

necessary paperwork. Should the paperwork not be received, the applicant's renewal

The Natural Resources and Recreation Commission approved the concept plan for
Pioneer Park at their June 15,2005 meeting. The NRRC is asking Council to approve the
first phase of re-development of Pioneer Park which would be soliciting of quotes to
construct a new hockey rink. The proposal is to have a pennanent hockey rink that
would be lighted and quotes would include the option of having a bituminous surface. In
the 2004 budget Council authorized $50,000 for improvements at Pioneer Park.
COUNCIL ACTION
Authorize staff to solicit quotes for the construction of a pennanent lighted hockey rink
that would have an option of installing a bituminous surface. Cost estimates would be
submitted back to Council for final approval.

Approve 2004 Sealcoat Program
Council is requested to approve the proposed 2004 Sealcoat Program. A drawing
illustrating the sealcoat area is attached. The seal coated streets are located just west of
Pleasant Drive roughly between 12th Street and 2151 Street. This area contains a large
number of cul-de-sacs. Vehides turning around or making sharp turns in cul-de-sacs will
typically dislodge the oil coated aggregate ftom sealcoat operations. For a number of
years now, cul-de-sacs have been treated with a slurry seal, which once fully cured, is not
affected by vehicle turning movements. However, the slurry seals take about 8 hours to
cure, during which time traffic is kept off of the road surface. This year's slurry seal
program will involve 18 cul-de-sac areas.
Separate contractors will construct the seal coat program and slurry seal PiDil'am.
Both programs are under the $50,000 competitive bid limit. Instead of advertising for
bids, staff will solicit quotes ftom contractors. Construction on both projects is expected
to begin by mid to late July.

Request Bid Award for Rescue Truck

At the April 19, 2004 Council meeting, approval was given for solicitation of bids for a
fire department rescue truck. The bid process produced proposals from three reputable
manufacturers.
The following comparison will outline the results of the bid process. Prices shown
include trade-in of the 1981 Pierce rescue truck.

Upon receipt and opening of bid proposals, fire department staff extensively reviewed
and compared the manufacturers. Although Ferrara was not a company familiar to us,
research, reference checks and review of their manufacturing processes all proved
positive results. Although Ferrara Fire Apparatus Incorporated cUIfently does not have a
strong customer base in the Midwest, it was learned that they are the fastest growing in
the industry. A dealership has been established in the area and warranty service and
repair are contracted by a local company very familiar to us. Both Pierce and E-One
have produced fire apparatus which cUIfently sit in our station. The bid proposal from E-
One was excluded from committee review early on due to the unexplainable price
difference.
Although comprehensive review of the two responsible bidders required additional
clarifications, Ferrara Fire Apparatus Inc. has proposed a vehicle with no exceptions to
our specifications. Pierce Manufacturing provided a proposal that was very difficult to
follow and required clarification on major components and included several exceptions.

After careful research of our needs, flTe apparatus industry standards and company
review, it is the Fire Department Rescue Truck Committee's and my recommendation
that the City enter into contract with FeITara Fire Apparatus Inc. for the purpose of
providing us a rescue truck.
The original request for this project was approved in 2001 with funding in the amount of
$240,000 from the Fire Department ERF. As outlined in my April 15, 2004 memo to
you, this project was placed on hold due to the unknown impact oflocal govemment aid.
It is important that I bring to your attention that approval ofthÌs request will require an
additional appropriation of $45,000. All funding for this project is cUITently available in
the Fire Department Equipment Reserve Fund.

Ordinance Amendments to Chapter 18 Regarding Certain Property
Maintenance Requirements and Schedule Public Hearing
Recommended City Council Action
It is recommended that the City Council take action approving the 2nd reading of the
attached Ordinance Amendments to Chapter 18 Regarding Certain Property
Maintenance Requirements, after completion of the scheduled public hearing. Staff has
added a short sentence in the Ordinance to affirm that it is a violation to use a motor
vehicle, passenger vehicle, recreational vehicle/equipment or commercial
vehicle/equipment as place of residence, in any zoning district.
Background
At various meetings of City Staff and City Council workshops and Committees, there
has been significant discussion regarding Chapter 18 regarding certain property
maintenance requirements relating to the storage of certain types of "vehicles" and
"equipment" on private property. The number of complaints that the City Council and
City Staff have dealt with over the last several years has risen. Furthermore, the
amount and type of vehicles that are stored on private property has also increased
considerably.
With prior direction from the City Council, Staff has attempted to modify the ordinance to
better define certain vehicles and equipment, and limited the number that can be stored
on private property.
Highlights of the new ordinance revisions include 'the following:

DEFINITIONS: The definition section has become more extensive in an
effort to reduce the discrepancies and gaps in the definitions. While
everything may not be covered, most items that Staff has had to contend
are included in the definition section.
NUMBER OF VEHICLES: The current draft suggest that you cannot have
more than five (5) vehicles [the broadest definition] stored outside a
structure on a lot in an R-1 zoned area; and no more than three (3) in an
R-2; 3 and 4 zoned area.
RECREATIONAL VEHICLE/EQUIPMENT and COMMERICIAL
VEHICLE/EQUIPMENT: In the R-1 district, of the five vehicles that you
may have store outside, no more than two may be of the recreational
vehicle/equipment and commercial vehicle/equipment category, and there
may be no more than one of those, in the R-2; 3 and 4 district.
In other words, in an R-1 District the greatest number of vehicles, (which is
intended to included everything,) stored outside is five, and three in the R-
2; 3 and 4 District.
Taking it to the next level, of the five in an R-1, and three in an R-2; 3 and
4 Districts, you may not have more than three recreational
vehicle/equipment and commercial vehicle equipment in the R-1 District
and one in the R-2; 3; and 4 Districts. Please read the definitions, to
understand that this would include the big campers, commercial service
vehicles, dump trucks etc.
Should a person wish to store these recreational vehicles/equipment and commercial
vehicles/equipment outside, the next section of the Ordinance illustrates those
regulations, and includes the following:

Cannot be at the end of the driveway and/or in the right-of-way, which is intended
to prevent blocking of views as neighbors attempt to back out of their driveways.
If a person is going to park a recreational vehicle/equipment or commercial
vehicle/equipment in their driveway it must be under eight feet in height. (Current
provision references seven feet) Under no circumstance can you have more
than one in your driveway.
One currently licensed recreational vehicle/equipment or commercial
vehicle/equipment can be parked in the side yard. (Similar to current provisions.)
A person cannot live in their vehicle or equipment
Recreational Vehicles/Equipment and Commercial Vehicles/Equipment may be
parked in such a manner with exceptions to the above, for a period not to exceed
24 hours for loading and unloading..
Staff has also included some additional language in this section that clarifies
further what vehicles can be parked in the driveway, and under what conditions.
There were certain discrepancies that Staff noticed since the first reading.

CURRENT HASTINGS CITY CODE SECTION 18.03 ISAMENDED BY ADDING THE
FOLLOWING NEW DEFINITIONS:
Section 18.03 DEFINITIONS
The following terms as used in this Code shall have the following meanings:
Miscellaneous Material: Miscellaneous material includes, but is not limited to, wood pallets and
miscellaneous construction materials, glass, wire, metal items, vehicle or bicycle parts, tires,
gasoline cans, plastic containers, indoor furniture, cookware or other items meant for indoor use.
Vehicle: Any motor vehicle, passenger vehicle, recreational vehicle/equipment or commercial
vehicle/equipment.
Motor Vehicle: Any self-propelled vehicle designed and originally manufactured to operate
primarily upon public roads and highways, It includes any vehicle propelled or drawn by a self-
propelled vehicle.
Passenger Vehicles: Passenger automobile, pick-up truck, van, self-propelled recreational vehicle
motorcycle, motorized bicycle, school bus or farm truck.
Pick-up Truck: Any truck with a manufacturers nominal rated carrying capacity of three-fourths
ton or less, commonly known as a pick-up truck.
Truck-Tractor: Also known as a tractor-trailer, a truck tractor is a motor vehicle designed and
used primarily for drawing other vehicles and not constructed to carry a load other than a part of
the weigh of the vehicle and load drawn.
Trailer: Trailer means any vehicle designed for carrying property or passengers on its own
structure and for being drawn by a motor vehicle.
Semi-Trailer: Semi-trailer means a vehicle of the trailer type so designed and used in conjunction
with a truck -tractor that a considerable part of its own weight or that of its load rests upon and is
carried by the truck-tractor and includes a trailer drawn by a truck-tractor semi-trailer
combination.
Van: Any vehicle of box-like design with no barrier or separation between the operators and the
remainder of the cargo-carrying area, and with a manufacturers nominal rated capacity of three-
fourths tons or less.
Motorcycle: Every motor vehicle having a seat or saddle for the use of the rider and designed to
travel on not more than three wheels in contact with the ground, including motor scooter and
bicycles with motor attached, other than those vehicles defined as motorized bicycles.
Motorized Bicycles: A bicycle that is propelled by a motor of a piston displacement capacity of
50 cubic centimeters or less, and a maximum of two brake horsepower, which is capable of a
maximum speed of not more than 30 miles per hour on a flat surface with no more than one
percent grade in any direction when the motor is engaged.
Recreational Vehicles/Equipment: Motorized or non-motorized; Includes but is not limited to
boats, boat trailers, travel trailers, pick-up campers and coaches, tent campers, tent trailers,
canoes, motor homes, jet skies, all-terrain vehicles, go-karts, mud trucks, stock cars, stock car
trailers, buses, snowmobiles, snowmobile trailers, jet ski trailers, truck toppers, and enclosed box
trailers, whether occupied or not with equipment or vehicles, and all trailers designed for or
frequently used to transport any of the above.
Commercial VehicleslEquipment: Includes but is not limited to backhoes, dump trucks,
landscaping equipment, skid steers, wood chippers, cube or box type trailers or trucks, tow
trucks, tractor trailers, semi-trailers, farm trailers, custom service vehicles, such as, but not
limited to, well-drilling machines, wood- sawing machines, cement mixers, rock crushers, road
grader, ditch digger, grading equipment; typical household or property maintenance service
vehicles, any service vehicle engaged in a business which includes the repairing or servicing of
vehicles, snow removal and road maintenance equipment and vehicles and all trailers designed for,
or frequently used to transport any of the above.
Lot: A separate parcel, tract or area of land undivided by any public street or approved private
road, established by plat, metes and bounds subdivision, or otherwise pennitted by law, and
occupied or intended to be developed for and occupied by a principal building or group of
buildings or accessory buildings, or utilized for a principle uses and uses accessory thereto,
including such open spaces and yards as are designed and arranged or required by this City Code
for such building, use or development.

SUBD. 2 PARKING AND STORAGE OF VEHICLES
It is unlawful to park or store on a residential lot, outside of a building that complies with City
Code, vehicles in excess of the amount pennitted by this subdivision.
In the Agricultural and R-l Zoned Residential Districts, it is unlawful to park or store more thana
combined total of five vehicles outside of a structure on a lot. Of these five, no more than two
may be of the recreational vehicle/equipment category or the commercial vehicle/equipment
category, combined.
In R-2, R-3, R-4, R-5 Residential Districts, it is unlawful to park or store on a residential lot more
than a combined total of three vehicles per residential dwelling unit outside of an enclosed
structure on any lot. Of these three, only one may be of the recreational vehicle/equipment or
commercial vehicle/equipment category.
For those allowed in Subdivision 2, the following conditions shall apply:
a.) No recreational vehicle/equipment or commercial vehicle/equipment shall be parked or stored
at the street end of a driveway within the boulevard portion of the public right-of-way.
b.) No more than one currently licensed recreational vehicle/equipment or commercial
vehicle/equipment 8 feet or less in height may be parked in a driveway on a residential lot.
c,) One currently licensed recreational vehicle/equipment or commercial vehicle/equipment may
be parked on the lot behind the nearest portion of the building closest to a street.
d,) No motor vehicles, passenger vehicles, recreational vehicles/equipment or commercial
vehicles/equipment shall be used for the purpose of a residence and/or housekeeping, in any
zoning district, unless approved by the City.
e) Except as provided in subparagraph b) above, no commercial vehicles/equipment may be
parked or stored on a residential lot outside of a structure, except while work is being performed
at the property.
f.) Except as provided in subparagraph b) above, recreational vehicles/equipment can be parked
in a driveway for a period not to exceed 24 hours for purpose of loading or unloading.

Every person violates a section, subdivision, paragraph or provision of this chapter when
they perform an act thereby prohibited or declared unlawful, or fails to act when such
failure is thereby prohibited or declared unlawful, and upon conviction thereof, shall be
punished as for a misdemeanor.

Regulations in Municipal Parking Lots and City Streets
Recommended City Council Action
It is recommended that the City Council take action approving the 2nd Reading of the attached
Ordinance amendments to Chapter 8 regarding parking regulations in municipal parking lots
and City streets, after completion of the scheduled public hearing.
Backaround
Much like the discussion on the regulations associated with parking and storing of vehicles and
equipment on private property, the City Council and City Staff have had to contend with an
increase in the number of complaints and problems associated with parking on City streets and
in municipal parking lots. Staff has attempted to modify the ordinance to assure that the
definitions of vehicles, trailers, equipment, etc are identical and inclusive of that which is listed in
the changes in Chapter 18. Under previous direction at City Council/Staff workshop meetings,
the following changes have also been made in the Ordinance:
a.) Parking of truck-tractors; semi-trailers and commercial vehicles and equipment is allowed in
City streets, only for loading and un-loading, and in no case longer than 6hours; nor can
they have their motor running for more than 30 minutes.
b.) No overnight parking (7:00 PM-7:00 AM)
c.) No parking in municipal parking lots
d.) Should trailers be parked in City streets, they must have blocking device to prevent damage
to the street.
e.) Recreational Vehicles/Equipment may be parked in City streets for loading or unloading and
in no case longer than 6 hours.
f.) It is unlawful to park recreational vehicles or equipment on any municipal parking lot, except
the lots at the Mississippi River, Lake Rebecca and Lake Isabel boat ramp parking areas.

HASTINGS CITY CODE SECTION 8.13 IS AMENDED TO READ AS FOLLOWS:
SEC. 8.13, RESTRICTED DAYS AND HOURS OF PARKING.
It is unlawful for any person to park on any street on any day during prohibited hours on any
day, or in excess of the permitted number of hours when the same has been marked by
signposting in each block or contiguous area of parking thereon, provided that parking on any
street is prohibited in excess of +J,... 24 hours. This provision shall supplement any other
provision of this Chapter.
VIIL VIOLATION A MISDEMEANOR.

Public Hearing and Resolution, 2004 Public Works Fee Schedule
Council is requested to hold a public hearing on the attached proposed 2004
Public Works fee schedule, and adopt the fee schedule. Recent questions over invoices
for emergency Public Works services have brought to the forefront a need for an official,
Council adopted fee schedule for equipment and staff services. Staff rates were
established using the same guidelines used to bill for development review: hourly rates
equal to two times the 2004 salary rate rounded up to the nearest $5 increment.
Equipment rates were established through a comparison of past billed rates and the City
of Eagan's recently completed rate review. The fee schedule was revised from the one
presented for the first reading, to update the fee for filling pools and operating hydrants
for flow tests. Those fees were last increased in 1992.

REQUEST
The City Council is asked to hold a p~ic hearing to rezone approximately 17 acres from A
- Agriculture to R-3\PRD - Medium\High DBnsity Residence Planned Residential
Development. The property is located along the future extension of 13th Street, west of
Bailey Ridge\General Sieben Drive, and north of 14th and Tierney.
The request is made in conjunction with a preliminary plat and site plan application from
Centex homes for construction of 114 multiple family units.
First Reading of the Ordinance to rezone property was held at the June 7, 2004 meeting.
RECOMMENDATION
The Council is asked to hold the public hearing but to delay 2nd Reading and Final
Adoption of the Rezoning. The accompanying Preliminary Plat and Site Plan are still
tabled at the Planning Commission. 2nd Reading and Final adoption would be
scheduled concurrent with the Plat and Site Plan requests.
PLANNING COMMISSION ACTION
The Planning Commission voted 5-1 (Schmitt dissenting) to recommend approval of the
rezoning at the May 24, 2004 meeting. During the public hearing one resident spoke in
opposition to the rezoning request citing additional traffic concerns. The Commission
discussed the rezoning, plat and site plan as a single item. Commissioners generally
supported the plan for development of the parcel, but voted to table the Preliminary Plat
and Site Plan until resolution of collector road issues.

BACKGROUND INFORMATION
Neighborhood Meeting
The developer held a neighborhood meeting on May 19th to introduce the concept to
the surrounding residents. Four people attended the meeting. The following issues
were raised:
. Concern over increased traffic
. Preference for single family homes in the development
. Ability to provide city services (police, fire, and sewer) to the area
Annexation
The City Council approved the annexation of the subject property in December, 2003. The
annexation has approved by the State of Minnesota on April 15, 2004 and the property is
now legally part of the City.
Comprehensive Plan Classification
The proposal is consistent with the Comprehensive Plan. The property was identified
for future annexation under the Comprehensive Plan. The property is guided U-II,
Urban Residential (4-8 units per acre). The Site Plan gross density of 6.7 units per acre
(8.0 net density - excluding public right-of-way) is consistent with the plan.
Zoning Classification
The property is currently zoned A - Agriculture. The proposed rezoning to R-3\PRD is
consistent with the density proposed for the plat and site plan. The applicant proposes to
develop the property as a Planned Residential Development to allow for clustering of units
and preservation of open space.

Request
The applicant proposes to rezone +/- 17 acres from A - Agriculture to R-3\Planned
Residential Development.
Analysis
The change is consistent with the density stipulated in the Comprehensive Plan. The area
is adjacent to townhomes of similar density (east). The area serves as a buffer between
future commercial area along Highway 55 to the north, and single family residential area to
the south.

Dear Mayor and City Council Members:
Attached is a proposed moratorium ordinance regarding site plan approvals for residential buildings
of three or more units.
You will see this ordinance contains a mechanism whereby a person who feels aggrieved by the
moratorium can ask the council for essentially a "variance". The literature on moratoriums suggest
that the council have such a devise in any moratorium so as to avoid a claim that you are "taking"
a person's property without due process.
Additionally, I would like to point out that this proposed ordinance includes an exception for the
river ITont redevelopment project. The council previously received a copy of a letter ITom Shennan
Associates Inc. expressing its concern about the moratorium and its impact on the proposed river
ITont redevelopment. To address this concern, I have drafted language in the proposed ordinance
which excludes ITom the moratorium any building containing three or more residential units within
the river ITont redevelopment project. If the council does not wish to exclude the river ITont
redevelopment project ITom the scope of this moratorium that paragraph should be stricken.

AN INTERIM ORDINANCE ESTABLISHING
A MORATORIUM ON THE ISSUANCE OF SITE PLAN APPROVALS
FOR BUILDINGS CONSISTING OF THREE OR MORE RESIDENTIAL UNITS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS
FOLLOWS:
Hastings City Code is hereby amended by adding the following:
Puroose,
The Hastings City Council is concerned about the recent increase in developers obtaining city
approvals for buildings that are purported to be condominiums but are later operated essentially as
apartment buildings. The Hastings City Council recognizes that current city code provisions allow
this situation to exist. The Hastings City Council believes the city code needs to be changed to
address this problem. The city council has concluded that the issuance of any site plan approvals
for buildings of three or more residential units, while the council studies and then remedies this
problem, would destroy the integrity ofthe efforts of the city council to address its concerns. The
Hastings City Council believes a moratorium is needed to protect the public health, safety and
welfare of the citizens of Hastings for a reasonable period oftime while the city council studies and
passes legislation to address this problem. This interim ordinance is adopted pursuant to the
authority granted by Minn. Stat 462.355, Subd 4.
A. Aoolicability. This interim ordinance shall apply to and govern the entire City of
Hastings. This interim ordinance shall supercede all other ordinances and regulations of the
city which are in conflict with or inconsistent with the provisions herein.
B. Scope of Ref!ulation, While this interim ordinance is in effect:
1.
No application for site plan approval for buildings containing three or more
residential units shall be accepted by the City.
2.
Exceptions. This interim ordinance shall not apply to any completed
applications for site plan approvals which were accepted by the city before
May 18, 2004.
Prior to this interim ordinance the city entered into a Preliminary Agreement
with Sherman Associates Inc. concerning the redevelopment of the river front
property. This redevelopment is expected to include some buildings with
three or more residential units. Because the city has previously entered into
an agreement with Sherman Associates Inc., this interim ordinance shall not
apply to buildings containing three or more residential units proposed to be
constructed by Sherman Associates Inc. as part of its river front
redevelopment project.
Prior to the expiration of this interim ordinance or prior to any fmal action of
the Hastings City Council repealing this interim ordinance, an individual can
request that a detennination be made by the Hastings City Council as to
whether issuance of site plan approval would circumvent the intent of this
moratorium and any remedy that may be adopted by the city council. On
consideration of such request, if the city council finds that the intent of this
moratorium would not be violated and that the public health, safety and
welfare would be protected, the city council may allow that individual to
submit the request for site plan approval for a building containing three or
more residential units.
3.
Penalties. Any person, finn, entity or corporation that violates any provision
of this interim ordinance, shall be guilty of a misdemeanor and shall be
subject to any additional legal or equitable remedies available to the city.
4.
Effective Date. This interim ordinance shalL take effect upon adoption and
seven days after publication and shall be effective for six months after the
effective date or until this interim ordinance is repealed by the city council.
The tenn of this interim ordinance may be extended for an additional period
not exceeding an additional IS months, as provided for by Minn.Stat 462-
355, Subd. 4.

REQUEST
The City Council is asked to hold a public hearing to vacate approximately 30 feet of the
southern right-of-way of 1 st Street, west of Sibley Street, adjacent to the American Legion.
The request would allow for construction of an 18 foot wide deck on the north (river) side of
their existing building.
The request is submitted in conjunction with a Special Use Permit and Site Plan Request to
construct a patio extending from the north (river) side of the building.
VACATION REVIEW
Background
The existing right-of-way is unimproved and was platted as part of the Original Plat of
Hastings. The right-of-way is approximately 130-140 feet wide, extending from the back of
the existing Legion Building to the River. The area of vacation is on a steep slope with a 5-
10 foot grade drop. In 1979 the Council approved an 8 foot vacation of the same right-of-
way for the American Legion. Municipal utilities do not exist in the right-of-way.
Riverfront Development Precedent
The vacation of right-of-way may set a precedent for other requests along the Mississippi
River. Any action on the request should be specific so as to not set an undesirable
precedent for future right of way vacation or uses adjacent to the river.

REQUEST
The American Legion is requesting a Special Use PermiUSite Plan to add an 18' wide patio
on the north (river) side of the existing facility at 50 Sibley Street. The Special Use permit is
required under the Shoreland Ordinance for the expansion of a commercial space. The
variance is required under the Shoreland Ordinance for a structure less than 150' from the
Ordinary High Water Level (OHWL).
In order to construct this patio, the Legion has requested the City Council tôvacate 30' of
the existing First St ROW. The City Council ordered a public hearing at the May 17th
meeting, and the public hearing will take place at the June 21st meeting.
The original correspondence from the Legion referenced a deck; however, plans submitted
to the Planning Department indicate that the proposed structure is actually a concrete
patio.
Staff is waiting for a determination from the DNR as to whether or not the patio constitutes
a structure, which would then need a variance under the Shoreland Ordinance. If that ends
up being the case, the variance would be reviewed by the Planning Commission and City
Council for approvals.
RECOMMENDATION
The Planning Commission held a public hearing forthis item at their June 14th meeting. No
one spoke during the hearing. The Commission voted 6-0 to recommend approval of the
special use permit and site plan to the City Council.
Staff is recommending approval of the special use permit and site plan for the patio at the
American Legion, with the conditions listed in the resolution.
BACKGROUND
The existing right-ot-way is unimproved and contains a steep slope trom the Legion
building to the Mississippi River trail.
In 1979, the City Council voted to vacate 8' of the First St ROW to accommodate a building
addition to the Legion. The current building sits approximately 3' from the north property
line.
Comprehensive Plan Classification
The Comprehensive Plan designates the property as MXD - Mixed Use Development. The
existing use is consistent with this designation.
Zoning Classification
The property is zoned C-3, Community Regional Commerce. Under the Downtown Master
Plan, this property would be rezoned to Core Multi-Use District. The existing use conforms
to both districts.

The site is presently an American Legion, and the area directly to the north is a steep slope
down to the Mississippi River Trail.
Proposal
Construct a retaining wall just over 5' in height above ground 18' from the building, fill in the
portion between the existing slope and retaining wall, and create a patio for outdoor dining.
SPECIAL USE PERMIT REVIEW
Shoreland Ordinance
City Code Chapter 16 - Shoreland regulates the placement of structures within 300' of
rivers as identified in the Shoreland Ordinance.
Any commercial use in the Shoreland District requires a special use permit. Although the
Legion itself was constructed in 1954, and addition/alteration to the commercial use
requires a special use permit.
SITE PLAN
Building Setbacks
Building setbacks are determined through site plan review in this zoning district. The
current building is about 3' from the north property line, thus necessitating a vacation
request to complete the project.
Proposed Conditions
The patio is about 15.5' wide by 85' long, and is situated directly north of the existing
American Legion.
The Legion is asking for additional area to be vaca1ecl to accommodate a memorial at the
base of the retaining wall.
Fencing
The patio is proposed to be surrounded by a 42" high metal railing, with a gate at either
end. The gates open to concrete areas near entrances to the Legion building. Plans show
a seating capacity of 56.
Lighting
Currently there are 2 large lights on the exterior of the building. These will be used to
illuminate the seating area.
Riverfront Development Precedent
The potential vacation of property along with the proposed construction of the patio may
set a precedent for future development along the Mississippi River. Any action on the
request should be specific so as to not set an undesirable precedent for future right of way
vacation or uses adjacent to the river.

Greg Jablonske seeks Final Plat approval of SOUTH OAKS OF HASTINGS 3RD
ADDITION, a 27 lot multiple family residential subdivision generally located along South
Oaks Drive between Olson Drive and Century Drive.
The request was tabled at the request of the applicant at the January 5, 2004 City Council
Meeting in order to examine park dedication fees. The request has been placed back on
the City Council Agenda following the public hearing and ordinance change to amend park
dedication fees.
RECOMMENDED ACTION
The Planning Commission recommended unanimous approval of the request at the August
11, 2003 meeting with limited discussion subject to the conditions of the attached

Comprehensive Plan Classification
The subject property is designated U-II, Urban Residential (4-8 units per acre) in the
Comprehensive Plan. The use and density is consistent with the Comprehensive Plan
Zoning Classification
The subject property is zoned R-3, Medium-High Density Residence\Planned Residential
Development. The district allows for multiple family residential structures. The zoning is
consistent with the proposed use.
The original R-3 rezoning for South Oaks of Hastings was approved as a planned

Preliminary Plat
Preliminary Plat approval was granted as part of South Oaks of Hastings 2nd Addition on
August 4, 2003. The Final Plat is consistent with the approved Preliminary Plat.
Grading, Drainage, and Erosion Control Plan
The Grading, Drainage, and Erosion Control plan has been reviewed by the BDM
Engineering, the City's consultant engineer. It appears minor issues remain before
approval. Grading, Drainage, and Erosion Control plan approval must be obtained by the
Public Works Director as a condition of Plat approval.

Utilities
All public utilities within right-of-ways will be completed by the City as part of a public
improvement project. Utility Plans have been completed and are nearing approval. Utility
plan approval must be obtained by the Public Works Director as a condition of Plat
approval.
Public Land Dedication
The Natural Resources and Recreation Committee reviewed park dedication options with
the original South Oaks of Hastings plat and recommended the following:
1) Cash in lieu of land shall be paid to satisfy Park Dedication requirements in
the amount of $29,700 (27 units x $1,100 per unit) prior to the release of the
Final Plat mylars for recording.
Interceptor Sewer Fee
The following must be paid to satisfy sewer interceptor fees:
1) Sewer Interceptor fees in the amount of $9,045 (27 units x $335 per unit) shall
be paid prior to the release of the Final Plat mylars for recording.
Landscape Plan
The landscape plan identifies boulevard tree plantings every 50 lineal feet along right-of-
ways, planted at 2.0 caliper inches. The following additions are needed to comply with

Erosion Control Problems
The City has experienced problems with the builder\developer of South Oaks 1 st Addition in
maintaining silt fences, and clear access of streets during construction. Erosion control
measures must be improved for the existing development, and will be closely monitored
during the construction of South Oaks 3rd Addition.
Site Plan Review
Site Plan review and approval for all buildings exceeding t,vo units must be granted by the

6. Sewer Interceptor fees in the amount of $9,045 (27 units x $335 per unit) shall be paid prior to

Commissioner Alongi asked if 3151 Street was constructed yet.
Director Hinzman stated that work had begun on the project, and it's location is visible along
County Road 46.
Planning Commission Action:
Commissioner Twedt moved and Commissioner Hollenbeck seconded a motion to
recommend approval of the final plat for South Oaks of Hastings 3"' Addition to the City
Council, with the following conditions:
1) Adherence to the conditions of the South Oaks 200 Addition Preliminary Plat
2) The following changes shall be made on the final plat mylars prior to release by the City:

Schedule Meeting with Neighboring Townships
REQUEST
The City Council is asked to take the following actions related to future annexations:
1) Consider the request of Capital Real Estate to annex approximately 0.5
acres of right-of-way to facilitate the extension of South Frontage Road
west of the Xcel Substation. The annexation would allow for further separation
of the proposed Centex town homes from the future single family homes along
14th Street in Sunset West. The proposed annexation was included in the 2020
Comprehensive Plan. Upon direction from the Council, First Reading of the
Annexation Ordinance and ordering of the public hearing would take place.
2) Authorize Staff to schedule a meeting with neighboring townships to
discuss future annexation issues. Discuss our growth boundary and timing
for future annexations.

LeDuc House Restoration Update
The following is the June update on construction work for the LeDuc House Restoration. If you have
any questions or concerns, please let me know and I will be happy to discuss them with you.
Summer Kitchen plastering is complete. The City has requested additional plumbing (an extra
rough in water service on north wall, and a floor drain) to be installed in future catering kitchen.
Based upon a proposal from DCHS stating their very reduced intended use for the catering
kitchen MHS has agreed to the changes, The sub floor will need to be cut out and removed to
complete work, and will be replaced by new material. Tiling and painting can begin after the
new catering kitchen items are complete.
Plaster repairs are complete through out the house, with the exception of a small amount of work
around the old stovepipe penetrations.
The City has submitted a list of priorities for the remainder of the funds available for the project.
A wallpaper study was at the top of the list. MHS has contracted Landscape Research to
complete this work. The study is scheduled to be complete on July 6th. Also at the top of the list,
is wallpaper for the first floor. As stated in an earlier memo, MHS would like to draw attention
to the fact that the wallpaper that will be installed in the house has a very long lead-time. It is
likely that by the time the paper is manufactured, MHS will have turned the house over to the
City. This would mean the City would be responsible for installing the paper, .
Radiators are being painted and covered through out house.

Painting, trim repair and storm window repair are scheduled to begin this month
The architect made a mistake in the design of the restoration of the interior woodwork.
Currently the documents call for varnish work, when in fact the woodwork has a shellac finish.
This portion of the project will need to be redesigned and likely a change in pricing by the
painting sub-contractor. A special consultant is being considered, as shellac is a more difficult
finish to work with, and not well known by the average subcontractor.
It appears that the carpenter ants were not as active as previously thought. We presumed that the
large amount of wood trass found in the basement was made by a large crew of ants. The frass
was in fact "leaking" sawdust used for insulation in the bay window. However, a number of ants
were spotted. A pest control operator has come out and sprayed for the problem. MHS will have
then come out again at the end of the project, spray and make recommendations for continued
care.

The second change to the construction contract amount has been made through change order.
This amount represents an increase in plaster, electrical, mechanical and masonry work. Almost
all increases are related to conditions found as portions of the house were revealed during
construction.

Members of the Downtown Riverfront Redevelopment Committee including City

update to the City Council from the June 14, 2004 meeting of the Downtown Riverfront
Redevelopment Committee.

The Committee agreed to schedule a public open house on Monday June 28, 2004 from
5:30-8:30 PM to allow for public comment on the proposed plans. Based on the results
of the open house, Sherman and Associates intends on submitting revised master plans
and site plan for one phase, back to the City for formal approvals in July and August. At
the same time, a redevelopment contract would be negotiated. The planning process
would take until early September. The City and HRA are under contract with Sherman

The Hastings HRA has requested Ehlers Associates to review Sherman Associates' draft
development concept for financial feasibility. The development concept has three phases. We
examined each phase independently, as a stand-alone project.
The components of the three phases are as follows:

FinalMlial Feasibilitv
Ehlers has evaluated the general financial feasibility of each phase. This means that we looked at
whether the development would be financially feasible using up to 90% of the tax increment and
land write-downs. We look at whether the developer's debt and equity, plus the sale proceeds of
the condos, are sufficient to pay for all of the development costs estimated by the developer. If
there is a gap, we then analyze what increment the proposed project will generate, and whether
the increment plus land write-downs are sufficient to close the gap. We have not examined
whether or how much increment would really be necessary to complete the project. That analysis
will be completed after the development uses and located have been finalized, and before any
commitment for public assistance is made.
For all three phases, the developer is initially projecting the need for tax increment financing and
land write-downs.
Ehlers evaluated each phase as a stand-alone project. We have concluded that all three phases are
generally financially feasible, assuming the developer takes a reasonable fee. Both phases have a
financial gap that can be filled with tax increment and land write-downs. Our analysis assumes
that future development on Block 2 will pay for streetscaping along the east side of Ramsey and
the west side of Tyler, as well as the completion of the esplanade adjacent to the park.
The amount of the financial gap, and thus the demand for tax increment, can be reduced by
reducing the developer fee, reducing project costs, increasing the value of the condominiums,
reducing the amount of retail space, and refining the restaurant proposal. At this point, the
developer used GV AMarquette's financial profonna for the restaurant.
In general, tax increment may be used for land acquisition, site improvements such as
streetscaping and sidewalks, public parking, public and on-site utilities, demolition, relocation,
and administration.

Sherman Associates' preliminary master plans show the types of uses
proposed within the redevelopment area, consisting of three construction
phases. The following points clarify items not shown on the drawings,
but explained by the developer as of this date. There are three sheets,
showing some alternate building arrangements.
. Phase I is between Sibley and Ramsey, Bloc~ 3, owned by the City
and by the HRA. The plan shows condominium housing, with
public parking on the surface and in structured parking below
grade. Residential parking is beneath the building.
. Not having site control, Sherman is not making a proposal for
Block 2. The master plan shows generic buildings in the area
between Ramsey and Tyler on Block 2. Plan B-1 shows the north
building moved back from the property line to allow for a large,
multi-use public space.
. Most of Block 2 is owned by private parties, some of whom have
entered purchase agreements with Rick Ahern and partners. One
lot is owned by the HRA.
. Phase II is the north half of the area east of Tyler on Block 1,
entirely HRA owned. The plan shows a restaurant and banquet
facility, public parking, and a condominium housing building with
parking under.
. Phase ill is on the south half of the area east of Tyler on Block 1,
entirely HRA owned. The plans show two alternatives. A is one
large mixed-use building with residential above commercial. Band
B-1 are two buildings, one of row houses, one mixed-use
residential above commercial.
. Not shown on the master plan is a row house development on the
HRA property on the south side of 4th Street, opposite City Hall.
This would be built with Phase I.
The preliminary master plan is proposed for comment and direction by
the HRA, Advisory Committee and City Council. Additional material will
be coming with the presentations.
