SUBJECT: Charter Commission Amendment
RECOMMENDED CITY COUNCIL ACTION
It is recommended that the City Council take action approving the 2°d Reading on the Proposed
Amendment to the City Charter Section 3.08 regarding the method in which interim investigations
and studies can be completed by the City Council.
BACKGROUND
At its meeting on January 21, 1999 the City Charter Commission adopted a Resolution making a
recommendation that the City Charter, Section 3.08 be changed. At the City Council meeting on
Apri12, 1999 action was taken approving the 15t reading and scheduling a public hearing for the City
_Council meeting on April 16, 1999 regarding this proposed change. 1 have attached to this
memorandum a copy of the documentation that was submitted to the City Council for review at the
April 2, 1999 City Council meeting. In addition, the proposed Ordinance is also attached, including
the change that was suggested at the City Council meeting on April 2, 1999. Council will recall that
this change resulted in clarification that it must be the "majority of the entire City Council" that must
approve the interim investigation and study. The initial ordinance left it unclear as to whether or not
it was a majority of the entire City Council or simply those present. This clarifies that it must be a
majority the entire City Council.

NOTICE OF PUBLIC HEARING
Notice is hereby given that the Hastings City Council will conduct a public hearing on Monday
April 19, 1999 at 7:00 PM in the Council Chambers at the Hastings City Hall, 101 East 4~' Stx•eet, far
purposes of considering the adoption of an ordinance amending City Charter Section 3.08 "Interim
Investigation, Study and Policy Committees" by changing the method in which interim investigations can
be made. All person interested in commenting on the proposed ordinance will be given an opportunity to
do so. Copies of the proposed ordinance are available for review at the City Hail during noi~rnal business
hours.

AN ORDINANCE OF THE CITY OF HASTINGS AMENDING CITY CHARTER
SECTION 3.08, "Interim Investigation, Study and Policy Committees", BY
CHANGING THE METHOD IN WHICH INTERIM INVESTIGATIONS CAN BE
MADE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS
FOLLOWS:
I. THE FIRST SENTENCE OF THE F[RST PARAGRAPH OF HASTINGS
CITY CHARTER SECTION 3.08, SHALL BE AMENDED TO READ AS
FOLLOWS:
The Council, by a majority rote of the entire Cif Council er~#e-yew shail have the
power to make interim investigations into all City affairs, to subpoena witnesses, to
administer oaths, to compel the production of books and papers, and to demand reports
from department heads on their respective departments' operations.
Ali other existing language in Section 3.08 shall remain unchanged.
Il. THIS ORDINANCE AND CHARTER AMENDMENT SHALL BECOME
EFFECTIVE 90 DAYS AFTER ITS PASSAGE AND PUBLICATION.
