City Council
April 5, 2010
The City Council of the City of Hastings, Minnesota met in a regular meeting on
Monday, April 5, 2010 at 7:00 PM in the Council Chambers at the Hastings City Hall,
101 East 4"' Street, Hastings, Minnesota.
Members Present: Mayor Hicks, City Councilmembers Balsanek, Alongi, Nelson
Schultz, and Slavik
Members Absent: City Councilmember Hollenbeck

Approval of Minutes
Mayor Hicks asked if there were any corrections or additions to the minutes of the
regular City Council meeting on March 15, 2010. Hearing none, the minutes were
approved as presented.
Proclamation — Declaring May 17 -22, 2010 as Youth Appreciation Week in the City
of Hastings
Crrotjohn provided an overview of some of the events planned during the week.
Moved by Councilmember Schultz, seconded by Councilmember Nelson to
approve as presented.

Council Items to be Considered
Moved by Councilmember Slavik, seconded by Councilmember Nelson to add an
item declaring excess property. It was also noted that item #22 should be removed as it is
a duplicate.

Moved by Councilmember Nelson, seconded by Councilmember Balsanek to approve

Public Hearing — Charter Amendment: Section 3.06: Mayor -Law Enforcement and
3.11: Powers and Duties of the City Administrator
City Administrator Osberg introduced the item and provided background on the
proposed changes. Osberg noted that no action is required; that will occur at the April
19, 2010 Council meeting.

Public Hearing -2010 Street and Utility Improvement Program
City Engineer Egger introduced the item and provided background on the
proposed changes.

Ed Stegman, 111 Lyn Way, stated opposition to including new sidewalks in the
proposed project.
Mr Blomgren, 1375 Westview Drive, inquired about drainage issues and standing
water. He also stated opposition to including new sidewalks in the proposed project.
Don Bettis, owner of Auto Doctor, 1370 South Frontage Road, commented on the
alignment of the SE corner of South Frontage Road/Pleasant Drive. He also commented

on accessibility during the project, and the number of projects over the last several years
that have impacted this area.
Duane Fike, 1306 Sun Valley Drive, stated opposition to including new sidewalks
in the proposed project.
Mike Sieben, 1117 Lyn Way, stated opposition to including new sidewalks in the
proposed project.
Terri Cavalier, 1107 Lyn Way, stated opposition to including new sidewalks and
narrowing the street in the proposed project.
Scott, manager of MGM Liquors, 1250 South Frontage Road, inquired about
accessibility during the project.
Katie Lee, 1352 Westview drive, stated opposition to including new sidewalks in
the proposed project.
Wayne Schleussler, 1110 Lyn Way, stated opposition to including new sidewalks
in the proposed project.
John Hauser, 1206 Lyn Way, stated concern with the speed and supported adding
new sidewalks in the proposed project.
Jim Johnson, 1202 Lyn Way, stated opposition to including new sidewalks in the
proposed project.
Gary Seibert, 1315 Lyn Way, stated opposition to including new sidewalks in the
proposed project.
Dennis Deane, 1028 West 14 Street, stated opposition to including new
sidewalks in the proposed project.
Cress Gackle, 1200 Westview Drive, inquired about whether Westview Drive
would be narrowed.
Cheryl Schaefer, 1221 Westview Drive, stated opposition to including new
sidewalks in the proposed project. She also commented on a few properties
monopolizing on street parking on Westview.
Jeanne Pauletti, 1362 Westview Drive, stated opposition to including new
sidewalks in the proposed project.
Chris Kuhns, 1311 Lyn Way, inquired about recent traffic studies. He stated that
the street should be made wider, not narrowed.
Richard Becker, 1130 Westview Drive, stated opposition to including new
sidewalks in the proposed project.
Carol Hadac, 1490 Westview Drive, stated opposition to including new sidewalks
in the proposed project.
Steve Heller, 1372 Westview Drive, stated opposition to including new sidewalks
in the proposed project.
Egger responded to a number of the inquires regarding drainage, pavement
replacement and the South Frontage Road/Pleasant Drive intersection modification
proposed.
Hearing no further comments, Mayor Hicks closed the public hearing at 8:20 p.m.
Resolution —Order Improvement, Approve Plans, and Authorize Advertisement for
Bid: Project 2010 -1: 2010 Infrastructure Improvements
Moved by Councilmember Schultz, seconded by Councilmember Slavik to
approve the resolution as presented.

Moved by Councilmember Nelson, seconded by Councilmember Schultz to
amend the motion to exclude all new sidewalks from the project except those located on
Westview Drive north of Highway 55 to Pleasant Drive.
6 Ayes; Nays, none. Amendment to original motion was approved.
There was discussion over cost savings and unique nature of neighborhood that
make sidewalks not a good fit as part of this project.
6 Ayes; Nays, none, on the motion of the original motion as amended.
Public Hearing -- Ordinance Amendment Changing Name of NRRC
Bernstein introduced the item and provided background on the proposed change.
Mayor Hicks opened the public hearing at 8:50 p.m.
Hearing no further comments, Mayor Hicks closed the public hearing at 8:51 p.m.
Second Reading /Ordinance Amendment—Changing Name of NRRC
Moved by Councilmember Slavik, seconded by Councilmember Alongi to
approve the ordinance amendment as presented.

Public Hearing — Ordinance Amendment Relating to Chapter 95.04: Tree Diseases
Bernstein introduced the item and provided background on the proposed change.
Mayor Hicks opened the public hearing at 8:54 p.m.

Second Reading/Ordinance Amendment — Relating to Chapter 95.04: Tree Diseases
Moved by Councilmember Alongi, seconded by Councilmember Schultz to
approve the ordinance amendment as presented.

Resolution— Prohibit Parking on West /South Side of Westview Drive from North
Frontage Road to Pleasant Drive
Moved by Councilmember Alongi, seconded by Councilmember Slavik to
approve the resolution as presented.

Police Chief Hiring Process
• Approve Police Chief Recruitment Profile
• Authorize Utilization of PDI to Assist with the Police Chief Hiring Process
• Authorize Solicitation of Applications for the Position of Police Chief
Osberg introduced the item and provided some background on the item.
Moved by Councilmember Schultz, seconded by Councilmember Nelson to approve the
process as outlined.

Announcements
• The HEDRA meeting scheduled for April 6 has been canceled due to lack of quorum.

• The Planning Comrnission will meet Monday, April 12 at 7 p.m. at City Hall
• Hastings has been notified that it will be designated as a Yellow Ribbon Community.

Osberg introduced the item and provided some background on the item.
Moved by Councilmember Slavik, seconded by Councilmember Nelson to approve
the contract as presented.

Closed Door Session — Discussion of Contract Provisions Relating to TRAC
Employees who are Members of the 49er's Union
Moved by Councilmember Alongi, seconded by Councilmember Slavik to adjourn
the open meeting to closed door session at 9:05 p.m.

Mayor Hicks opened the closed door session. Mayor Hicks adjourned the closed door
session.
Moved by Councilmember Alongi, seconded by Councilmember Slavik to reconvene
to the open door session at 9:24 p.m.
