June 21, 2010
The City Council of the City of Hastings, Minnesota met in a regular meeting on
Monday, June 21, 2010 at 7:00 PM in the Council Chambers at the Hastings City Hall,

Members Present: Mayor Hicks, City Councilmembers Balsanek, Alongi, Hollenbeck,
Nelson Schultz, and Slavik

Mayor Hicks asked if there were any corrections or additions to the minutes of the
regular City Council meeting on June 7, 2010. Hearing none, the minutes were approved
as presented.
Presentation -2009 Comprehensive Annual Financial Report
Dave Blumberg, HLB Tautges Redpath, the City's auditing firm, presented an
unqualified (clean) audit to the Council. Both Blumberg and the Council commended
City staff for their assistance with the process.
Consent Agenda
Moved by Councilmember Slavik, seconded by Councilmember Nelson to approve
the Consent Agenda as presented.

Permit Surcharge Fees & Construction Regulations
17. Resolution —One Day Liquor License Amendment Request for June 25, 2010 for the
American Legion

Public Hearing —Storm Water Management Ordinance .
Montgomery introduced the item and stated that the amendment is being
recommended to allow the City to issue the perinit.
Mayor Hicks opened the public hearing at T13 p.m. Hearing no comments, the
public hearing was closed at 7:15 p.m.
Second Reading /Adopt Ordinance— Storin Water Management Ordinance
Moved by Councilmember Alongi, seconded by Councilmember Slavik to approve
the ordinance amendment as presented.
7 Ayes; nays, none.
Public Hearing — Shoreland Ordinance: Conservation Buffers
Hinzman introduced the item and recommended that the amendment be approved as
presented. Hinzman noted that conservation buffer regulations are effective upon
subdivision of property.
Mayor Hicks opened the public hearing at 7:20 p.m.
Kerry Nygaard, 1060 County Road 47 inquired about impact on his property. He was
advised to contact VRMJPO directly for additional information.
Hearing no Comments, the public hearing was closed at 7:2315 p.m.
Second Reading /Ordinance Adoption — Shoreland Ordinance: Conservation Buffers
Moved by Councilmember Schultz, seconded by Councilmember Hollenbeck to
approve the ordinance amendment as presented.
7 Ayes; nays, none.
Second Reading /Ordinance Adoption — Transient Merchant Ordinance
Hinzman stated that the Planning Committee recommends that there be a limit of 180
days, two 90 day periods, on this amendment. He also noted that the Planning
Commission will also be reviewing the regulations on Garden Centers.
Schultz inquired about a section related to operations longer than one year. Hinzman
stated that with the Planning Committee recommendations, that is no longer valid and
should be removed from the draft before the Council.
Moved by Councilmember Schultz, seconded by Councilmember Slavik to remove
the invalid language from the draft.
7 Ayes; Nays, none.
Moved by Councilmember Alongi, seconded by Councilmember Nelson to approve
the amended language as proposed.
There was discussion about the proposed change. Hicks stated that he was not
supportive of the change. Alongi stated he was supportive of the change.

Moved by Balsanek to table the item until the regulations on Garden Centers could be
addressed. The motion died for lack of a second.
On the motion before the Council, four Ayes; Nays: three. Councilmembers
Balsanek, Mayor Hicks and Councilmember Schultz voting against.
Resolution —Site Plan 42010 -25: Napa Store/Linn Companies (1501 Vermillion
Street)
Hinzman introduced the item. There was discussion about truck access, TIF for the
project, screening/buffering and the overall landscape plan.
Moved by Councilmember Schultz, seconded by Councilmember Alongi to approve
the site plan as presented.
7 Ayes; Nays, none.
Resolution— Variance 42010 -29: Sideyard Setback/Non- Conforming: Mark
Loosbrock (725 Y Street West)
Moved by Councilmember Slavik, seconded by Councilmember Nelson to approve
the variance as presented.
7 Ayes; Nays, none.
Resolution — Special Use Permit #2010 -27: Temporary Auto Sale in C -4 District:
Hastings Automotive Group at Coborns (225 33' Street West)
Moved by Councilmember Alongi, seconded by Councilmember Hollenbeck to
approve the special use permit as presented.
7 Ayes; Nays, none.
Resolution — Special Use Permit ##2010 -26: Soil Processing Permit: William Hoist
(Glendale Road & Ravenna Trail)
Moved by Councilmember Alongi, seconded by Councilmember Slavik to approve
the special use permit as presented.
7 Ayes; Nays, none.
Comments from the Audience
Gary Lukowicz, 620 Prairie, inquired about a letter received about a meeting on
proposed Lions Park ballfield changes. It was noted that there is a neighborhood meeting
scheduled for Wednesday on this issue.
Announcements
• The Finance Committee will meet on June 29 at 7:30 a.m. to discuss the 2011 budget
• City Hall will be closed on Monday, July 5 in observance of the Independence Day
holiday.
• The next City Council meeting will be Tuesday, July 6 at 7:00 p.m.
• There will be a public welcome for Police Chief Paul Schnell on Tuesday, Julyy 6 at
6:00 p.m. at City Hall
