August 11, 2008
Regular Meeting
7:00 p.m.
Chair Schmitt called the meeting to order at 7:00 p.m.

Approval of Minutes
2. –July 14, 2008
Motion by Commissioner Stevens to approve the July 14, 2008, meeting minutes. Seconded
by Commissioner Peine.
Upon vote taken, Ayes 5, Nays 0. Motion carried.
PUBLIC HEARINGS
Jim Smith
3. - Special Use Permit #2008-22 – Allow Retail Sales in an I-1 Zoning District (Kids
ATV’s) – 2750 Millard Avenue.
Staff Report presented by John Hinzman.
Chair Schmitt open the public hearing at 7:05.
Jim Smith, owner, explained that he would like to sell larger types of scooters that would
require a dealership license from the state. He added that he would like to display them
outdoors during the day and take them back into the building at night.
Chair Schmitt closed the public hearing at 7:07.
Commissioner Vaughan asked Hinzman why the trash enclosure required. Hinzman
responded that since they have applied for a major application they must bring their site up to
compliance with the new regulations; in this case it requires a trash enclosure.
Schmitt asked the applicant if he has enough room for their stock. Smith responded that he
owns other warehouses.

Action by Planning Commission:
Motion by Commissioner Vaughan to recommend approval of the Special Use Permit with the
10 recommended conditions. In addition to adding that any outdoor display shall only be
during business hours to condition 9. Seconded by Commissioner Peine.
Upon vote taken, Ayes 5, Nays 0. Motion carried.
OTHER ACTIONS
Review Proposed Heritage Preservation Commission Historic Properties Designation.

Associate Planner Fortney gave a staff report.
Commissioner Stevens asked the proposal was to designate individual properties or a district.
Fortney responded that the proposal is to look at designating 17 individual properties.
Stevens asked how the designations would affect OHDS review. Fortney said that any
designated properties would be reviewed only by the HPC, even if they were in the OHDS
area.
Schmitt asked how the possible designation of the Hudson site could affect the new bridge
alignment. Fortney said the proposals that staff have seen would not affect the historic
structures on site. Fortney added that local designation would not affect the state bridge
project.
Commissioner Hiedeman asked if the homeowner ultimately have a say in the designation of
their property. Fortney said their comments will be forwarded on to the HPC and City
Council and have the opportunity to speak at public hearings, but ultimately the City Council
has the discretion to designate a property.
Action by Planning Commission:
Motion by Commissioner Peine that the commission concurs with the staff reports findings
that there are no foreseeable incompatibilities between the proposed designations and the
zoning code, comprehensive plan, development plans, or development objectives adopted by
the City Council. Seconded by Commissioner Vaughan.
Upon vote taken, Ayes 5, Nays 0. Motion carried.

Other Business

Planning Director Hinzman updated the Commission past Council actions and on upcoming
items.
Adjournment

Motion by Hiedemanto adjourn the August 11, 2008, Planning Commission meeting.
Seconded by Stevens.
Upon vote taken, Ayes 5, Nays 0. Motion carried.
The meeting was adjourned at 7:30 p.m.
