Hastings Planning Commission
July 14, 2008
Regular Meeting
7:00 p.m.
Chair Schmitt called the meeting to order at 7:00 p.m.

Approval of Minutes
2. –June 9, 2008
Motion by Commissioner Vaughan to approve the June 9, 2008, meeting minutes. Seconded
by Commissioner Peine.
Upon vote taken, Ayes 5, Nays 0. Motion carried.
PUBLIC HEARINGS

3. - Variance #2008-19 – Minimum Lot Area – East Side Highway 61 in
Washington County.
Staff Report by Justin Fortney.
Chair Schmitt open the public hearing at 7:06. No members of the public spoke to the issue.
Chair Schmitt closed the public hearing at 7:06.
Commissioner Vaughan asked if there was another house on the property. Associate Planner
Fortney stated that the home seen in the aerial photograph was not on the applicant’s property,
though he thought the house may belong to the applicant’s son.
Chair Schmitt said that a smaller plat of land was not being created. Chair Schmitt added that
a deed restriction really does not do anything as the three acres could be sold independently.
Associate Planner Fortney stated that the deed would allow the parcels to be sold
independently, but would never allow a house to be built on the three acres adjacent to the
subject parcel.
Commissioner Stevens stated that the deed or covenant requirement would be a Catch 22
because the City does not enforce covenants. Therefore, the deed or covenant requirements
would get the total required acreage, but it would not be enforced. Chair Schmitt added that
since the parcel is not in the City of Hastings, the City could not enforce the deed or covenant

requirements.
Action by Planning Commission:
Motion by Commissioner McInnis to recommend approval of the variance for minimum lot
area on the east side of Highway 61 in Washington County with the four recommended
conditions. Seconded by Commissioner Stevens.
Upon vote taken, Ayes 5, Nays 0. Motion carried.
OTHER ACTIONS
Lakeside Cemetery –
4. Site Plan #2008-20 – Accessory Storage Building – Nininger Road.
Associate Planner Kari Barker gave a staff report.
McInnis asked for clarification on the siding requirements. Associate Planner Kari Barker
stated that it was staff’s recommendation that the front and two sides be sided with vinyl clad
steel siding. However, the applicant was concerned with the cost associated with this
recommendation and would prefer the to use vinyl siding over vinyl clad steel siding if
Planning Commission agreed with staff’s recommendation regarding additional siding due to
visibility.
Chair Schmitt asked if the garage is only visible from the front. Barker responded that the
front was most visible from County Road 42, but the sides could also be seen.
Chair Schmitt asked if there was going to be fuel powered equipment stored in the building.
Associate Planner Barker responded that the garage will be used for the storage of burial
equipment, which may include fuel powered equipment. Associate Planner Fortney stated that
the Building Safety Department would regulate that aspect of the structure. Chair Schmitt
stated that they cannot approve something that is not allowed. He further stated a concrete
floor should be required if fuel powered equipment was going to be stored in the building.
Commissioner Schmitt asked if vinyl siding meets the Class One and Class Two
requirements. Associate Planner Barker stated it did in this situation.
Action by Planning Commission:
Motion by Commission McInnis to recommend approval of the site plan for construction of an
accessory storage building with the seven recommended conditions and an eighth condition
that the structure must have a concrete floor if fuel powered equipment was going to be stored
in the garage. In addition, condition number seven was amended to read that the two sides and
front of the building be sided with horizontal vinyl siding. Seconded by Commissioner Peine.

Associate Planner Kari Barker gave a staff report.
Commissioner Vaughan asked for clarification on the requirements for tree replacement.
Association Barker stated that the replacement was one tree if the tree was greater than 3
inches in diameter or two trees if the trees were less than 3 inches in diameter.
Action by Planning Commission:
Motion by Vaughan to recommend approval of the variance for an addition to a
nonconforming structure with staff’s recommended conditions. Seconded by Stevens.
Upon vote taken, Ayes 5, Nays 0. Motion carried.
Other Business

Associate Planner Barker updated the Commission on upcoming items.

Motion by Stevens to adjourn the July 14, 2008, Planning Commission meeting. Seconded by
McInnis.
Upon vote taken, Ayes 5, Nays 0. Motion carried.
