HomeMy WebLinkAboutPCMinutes-20070723City of Hastings Planning Commission Minutes – July 23, 2007 Page 1 of 3 Hastings Planning Commission July 23, 2007 Regular Meeting 7:00 p.m. Chair Truax called the meeting to order at 6:55 p.m. 1.Roll Call Commissioners Present: Hiedeman, McInnis, Peine, Schmitt, Stevens, Truax, Zeyen Commissioners Absent: None Staff Present: Planning Director John Hinzman Associate Planner Justin Fortney 2.Approval of Minutes – July 9, 2007 Motion by Schmitt to approve the July 9, 2007, meeting minutes. Seconded by Peine; motion passed unanimously. Other Actions 3.Cuong (Kim) & Lori Duong - Variance #2007-33 – legal nonconforming use – 1908 Vermillion Street. Associate Planner Fortney gave a staff report. Chair Truax opened the Public Hearing at 7:05. David Carroll, resident at 1905 Eddy Street, spoke to the issue. He wanted to know what the applicants were proposing and how big of a structure would be built. Fortney answered, the garage would be about 990 Sq Ft and it would be about 20 feet from the rear property line. Fortney added that this is well within the accessory structure regulations for any residential district. Commissioner Schmitt added that this case is only before them because the use is not allowed by right in a commercial district. Action by Planning Commission: Motion by Schmitt to approve the expanding nonconforming use variance. Seconded by Zeyen. Upon vote taken, Ayes 7, Nays 0. Motion passed unanimously. 4.Greg J. Homes – Site Plan Review #2007-34 – Townhomes - 3530-3568 Riverwood Drive and 3533-3575 Village Trail. City of Hastings Planning Commission Minutes – July 23, 2007 Page 2 of 3 Planning Director John Hinzman gave a staff report Commissioner Stevens asked the applicant what would be happening in respect to the driveway. Darren Kunert with Greg J. Homes answered that the driveways will have to be realigned requiring the curbs to be cut and rebuilt. Stevens then asked why only half of the structure will be built. Kunert replied that market forces are not pressing them all to be completed immediately and they would like to get their new floor plans on the market. Stevens asked if all of the foundations would be poured at one time. Kunert replied that only half would be poured at a time. Schmitt raised concerns about having a plain side being built that may never be finished as the side elevations showed, if the other two units were never built. Commissioner Peine asked how the sunset clause would affect this situation. Hinzman replied that as long as there was continuous progress on the site, the approval would remain in effect. Commissioner Stevens asked if the setbacks would be different for a twin home rather than a four unit. Hinzman replied that since this is in a PRD there were no specific setbacks. Kunert told the commissioners that construction on all four units would most likely be completed this construction season. Commissioner Hiedeman mentioned that maybe they should have waited to apply for site plan approval until they were ready to build all four units. Peine suggested that they could build the shell for all four units but only finish-out one or two of them. Commissioner Schmitt told the applicant that if they approve the request for a four unit structure they could not build just two units. Kunert said then we will build all four units at one time. Action by Planning Commission: Motion by Schmitt to approve the site plan. Seconded by Hiedeman. Upon vote taken, Ayes 7, Nays 0. Motion passed unanimously with the following conditions: 1)Conformance with the Planning Commission Staff Report and plans dated July 23, 2007. 2)Approval is subject to a one year Sunset Clause; if significant progress is not made towards construction of the proposal within one year of City Council approval, the approval is null and void. 3)All disturbed areas on this property shall be stabilized with rooting vegetative cover to eliminate erosion problems. 4)Final approval of the grading, drainage and utility plans by the Public Works Director, and reimbursement for any fees incurred in review of the development. The owner City of Hastings Planning Commission Minutes – July 23, 2007 Page 3 of 3 assumes all risks associated with the grading and utility placement prior to formal approvals. 5)All landscaped areas must be irrigated. 6)Any uncompleted site work (including landscaping) must be escrowed for prior to issuance of a certificate of occupancy. 7)Submission of an electronic copy of all plan sets (TIF, PDF, or similar format) prior to submittal of a building permit. 8)Boulevard trees must be planted at spacings of no less than 50 feet along all public right- of-ways. Additional boulevard trees need to be planted between Lots 1 and 2 and Lot 18 th and 36 Street 9)One additional front yard tree needs to be planted on one of the eight units on both Village Trail and Riverwood Drive. 10)All four units of the structure must be built at one time. 11)The curb must be reconstructed if it is altered. 12)The garage doors must have raised panels. 5. Planning Director Hinzman updated the Commission on previous Council activities and upcoming agenda items. Items include a City initiated rezoning of Red Wing Boulevard, Wal-Mart plat, and a Comprehensive Plan update. 6. Adjournment Schmitt motioned, seconded by Zeyen. Motion passed unanimously.
