HomeMy WebLinkAbout12-03-96 r I l I I \ r-- j Hastings, Minnesota December 3, 1996 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, December 3, 1996 at 7:00 p.m. in the City Hall Council Chambers, 101 4th Street East, Hastings, Minnesota. Members Present: Councilmember Riveness, Warner, Johnson, Simacek, Hicks, Moratzka and Mayor Werner Members Absent: None Staff Members Present: Dave Osberg, City Administrator; Lori Webster, Finance Director; Joyce Pruitt, Administrative Assistant/City Clerk; and Shawn Moynihan, City Attorney Approval of Minutes Mayor Werner asked whether there were any corrections or additions to the minutes of the regular meeting of November 18, 1996 and hearing none, declared the minutes approved as presented. Consent Agenda Moved by Councilmember Riveness, seconded by Councilmember Simacek to approve the consent agenda as presented. 1. Pay all bills as audited. 2. 1997 Cigarette Renewal Licenses 3. Resolution No. 12-01-96- One Day Exempt from Gambling License - Hastings Sno-Mo's at Papa Charritos - February 9, 1997 4. 1997 Massage Therapy/Establishments Renewal Licenses 5. Resolution No. 12-02-96- 1996 Budget Transfers 6. Pay Estimate #1, 1996 Improvements/Wallin 3rd Addition, Danner Construction, $47,575.76 7. Copier Proposal 7 Ayes; Nays, None. Public Hearing - 1997 City Budget/Property Tax Levy - Truth in Taxation Mayor Werner opened the public hearing at 7:04 p.m. to receive comments on the proposed 1997 City BudgetlProperty Tax Levy. Finance Director, Lori Webster, introduced the item, explaining the item is a public hearing for truth-in-taxation and adoption of the tax levy would not be until the December 16, 1996 City Council Meeting. She explained overall the proposed tax levy is increasing by 8% but that this still means no increase to an individual's city portion of their property taxes, assuming property values remain the same. Mayor Werner asked if anyone wished to comment on the proposed budget/tax levy and Mr. Willis Olson 80 Valley Lane, complemented the City Council on the 1997 proposed budget. He also expressed concern regarding a 45% increase in rental property taxes due to a 50% increase in market value. Mayor Werner explained the taxable market value issues should be addressed at the Dakota County Truth-in Taxation Hearing. Dale Freke, 1018 Ramsey Street, requested clarification on his property tax statement. Finance Director, Lori Webster, explained any increase in 1997 is attributable to an increase in a property's market value. Everyone wishing to speak were given the opportunity to do so, and the Mayor closed the public hearing at 7:17 p.m. Public Hearing - Special Assessment Certification of Delinquent "Dutch Elmffree Removal" Bill Mayor Werner opened the public hearing at 7: 18 p.m. to receive comments on the proposed special assessment certification of a delinquent "Dutch Elm/Tree Removal" bill. Mayor Werner asked if anyone wished to comment on the proposed special assessment and no one wished to do so. Mayor Werner closed the public hearing at 7:19 p.m. Public Hearing - Rezone - AG to R-l - South Pines 2 Mayor Werner opened the public hearing at 7:19 p.m. to receive comments on the proposed rezoning of South Pines 2. Mayor Werner asked if anyone wished to comment on the proposed rezoning and no one wished to do so. Mayor Werner closed the public hearing at 7:20 p.m. City of Hastings Minutes for Regular Meeting of December 03, 1996 Page 2 of2 2nd& Final Reading - Rezone - AG to R-l- South Pines 2 Moved by Councilmember Hicks, seconded by Councilmember Simacek, to approve the 2nd Reading of Ordinance No. 400, an ordinance to rezone the area to be platted as South Pines 2 from the AG (Agriculture) District to the R-l Single Family Residence District. 7 Ayes; Nays, None. Authorize Certification for Special Assessment - Delinquent Bills- "Dutch Elm" and Water/Sewer Utility Bills 0 Moved by Councilmember Johnson, seconded by Councilmember Riveness, to authorize . the certification of all delinquent Utility and Dutch Elm accounts to the County Auditor. Finance Director, Lori Webster, explained that when a property is sold and there are delinquent water charges legally the water bill remains with the property. She added the City attempts to locate the previous owner and that typically any delinquent charges are founding during closing. 7 Ayes; Nays, None. Reschedule January 20, 1997 City Council meeting Moved by Councilmember Hicks, seconded by Councilmember Warner, to schedule the second City Council meeting in January 1997 for Wednesday, January 22, 1997. 7 Ayes; Nays, None. Public Works Director Compensatory Time Schedule Moved by Councilmember Johnson, seconded by Councilmember Riveness, authorizing Public Works Director Tom Montgomery to exceed the cap on the accumulation of compensatory time currently at eighty hours, to 120 hours, provided that Public Works Director Tom Montgomery shall have the compensatory time balance at, or below eighty hours by July 1, 1997. 7 Ayes; Nays, None. Comments from the Audience There were no comments from the audience. o Unfinished Business City Councilmember Moratzka, as Chair of the Finance Committee and Chair of the Citizens Budget Committee thanked the following citizens for their participation in the Citizens Budget Committee: Bob Wise, Turney Hazlet, Joan Donndelinger, John Moes, Rory Johnson, Jim Collins, and Lew Linde. New Business City Councilmember Hicks announced Terry Kelly's acceptance of a position at KAAL Television Station in Austin. The City Council congratulated him and thanked him for his work as the News Director at KDW A. Councilmember Moratzka requested the Operations Committee meet again to discuss snow shoveling and snowmobile usage on Pleasant Drive.
