The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday June 2, 1975 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.

Members present: Councilmen Fischer, Erickson, Elliott, Kramer,
Schnirring, Latch, Hallberg, Novak and Mayor
Petersen.
Members absent: None.
The Minutes of the Council meeting of May 19, 1975 were approved
as read.
Moved by Councilman Schnirring, seconded by Councilman Novak
to remove from the table the Home Occupation Permit of Robert Barron,
1201 Lyn Way. Ayes, 8; Nayes, none.
Moved by Councilman Schnirring, seconded by Councilman
Novak to table the Home Occupation Permit requests of Robert
Barron, 1201 Lyn Way and Mac McGoon, 1016 Tyler Street, until
such time as the Planning Commission has finished its report on
Home Occupation Permits that it is currently studying and evalu-
ating. . Ayes, 8; Nayes, none.
Moved by Councilman Fischer, seconded by Councilman
Hallberg to approve the Second Reading of the Amendment to the
Zoning Ordinance for the Archdiocese of the Twin Cities to
re-zone 5.9 Acres + from R-l to R-4, for an elderly housing
project of 109 Units located at 1199 Bahls Drive. Ayes, 6;
Nayes, Elliott and Schnirring. Motion passed.
Moved by Councilman Erickson, seconded by Councilman
Latch to approve the First Reading of the Re-zoning for the
East Hastings Area and to call for a Public Hearing on this
issue for June 16, 1975 at 8:00 P.M. in the Council Chambers
and that proper notices be published, mailed and posted as
required by the Ordinance. Ayes, 8; Nayes, none.
The City Administrator reported on the status of the
Building Permits in the East Hastings Area. The Council
accepted the report as an information item.
Moved by Councilman Novak, seconded by Councilman
Hallberg to approve the contract between Art Baumeister, Jr.
and the City of Hastings to the effective renewal date of
June 6, 1975 through June 6, 1976. A copy of the contract
is on file in the City Administrator's office. Mr. Baumeister
will continue in the capacity of the Industrial Park Promoter
for the City of Hastings. Ayes, 8; Nayes, none.
Moved by Councilman Kramer, seconded by Councilman
Novak to defer the assessment of the Hjermstad property,
Lot 2, Block 2 Original Town of Hastings. The reasons for
the deferred assessments on the Sy1vander and Meyer properties
should apply to the Hjermstad property as well. The City will
defer the assessment until such time as the property changes
use. Ayes, 8; Nayes, none.
Moved by Councilman Hallberg, seconded by Councilman
Latch to approve the name change involved in the transfer of
the Liquor license from James Hiniker, dba Friar Tuck's to
William Hiniker, dba Friar Tuck's. Ayes, 8; Nayes, none.

seconded to take off the table the Franzmeier Plat condisera-
tion for Street & Utility Improvements. Ayes, 8; Nayes, none.
Moved by Councilman Kramer, seconded by Councilman
Erickson to permit the Franzmeier's to construct the necessary
water and sewer for Lots 1,2,3, in Block 1 and for Lot 1,
Block 2, Franzmeier's 1st Addition, which includes necessary
Engineering, Contractor's Cost, Field staking and inspection.
All such work is to be under the direction and supervision of
the Engineer's office to insure the Engineering aspects of the
project are done properly. Ayes, 8; Nayes, none.

Moved by Councilman Schnirring, seconded by Councilman
Fischer to table this item again until the July 21st meeting.
At such time we hope to have sufficient information frbm the
Corps of Engineers in regard to how much property will be
needed for the Flood Control Project and will give an oppor-
tunity to explore all revenue sources for the purchase and
development of the park property. Ayes, 8; Nayes, none.
Moved by Councilman Schnirring, seconded by Councilman
Kramer to adopt the Anderson Proposal, which incorporates
parrallel parking per the original plan for the south side of
the Red Owl Store on 12th Street. Ayes, 6; Nayes, Councilmen
Novak and Erickson. Motion passed.
Moved by Councilman Novak, seconded by Councilman Latch
to allow the Oak Street Project, which was considered under the
1975 Street Improvements to continue as originally voted on.
Ayes, 6; Nayes, Councilmen Kramer and Hallberg. Motion passed.
Councilman Kramer moved, Councilman Erickson seconded to
grant the one (1) foot Variance to Richard Larson, 308 W. 15th
St., in accordance with the Planning Director's recommendation.

The Council received the report from John Lightbourn,
Ice Arena Mgr., concerning the Ice Arena and ordered it placed
on file.
The Council accepted the report from the Planning
Director for the Mississippi River Corridor and ordered it
placed on file. Dexter Marston informed th e Council that he
would be attending the meeting in June which will be discuss-
ing this matter further.
Moved by Councilman Schnirring, seconded by Councilman
Fischer to authorize the City Attorney to take the necessary
litigation steps to see that the dilapitated building on the
Prano property be removed. Ayes, 8; Nayes, none.
The City Attorney went on to say that the Honda and
Majeski building, both owned by Dakota County, are still a
problem for the City. The County had not cooperated so far in
the City's request to remove those buildings and the hazard that
they represent.
The Council, after discussion on the Zoning Amendment for
the Used Car Sales Lot as a Special Use in a C-3 Zone, decided
to take no action whatsoever in regard to this matter. The
intent of the Council is that they do not look favorable on such
Special Uses in a C-3 Zone.
After a discussion in regard to the process that is being
followed with the sign regulations in the Downtown Area the
Council merely commended the Staff to continue on with the exist-
ing program as stated.
Moved by Councilman Schnirring, seconded by Councilman
Kramer to approve Frank Truax as the full-time Fire Marshal
for the City of Hastings. His probationary period has been
successfully completed and a salary increase of $40.00 per
month be granted, effective immediately. Ayes, 8; Nayes, none.
A general discussion was held in reg~rd to the final
payment to Mr. Horan for his professional services. The Council
instructed the Administrator to hold his bill until a later date.

Moved by COlUlcilman Kramer, seconded by Councilman
Hallberg to adopt the final draft of the Affirmative Action
Program for the City of Hastings as the official document
which represents the City's policy. It is further recognized
that thispolicy statement has been approved by the Minnesota
Department of Human Rights and the policies so stated within
the program are now in effect. A copy of the Affirmative
Action Program is on file in the City Administrator's office.

~1oved by Councilman Kramer, seconded by Councilman
Schnirring to report on the Federal Revenue Sharing money
allocation for 1975-1976 the amount of $148,207 to be reported
to the Federal Government as intended to be used for Multi-
purposes in General Government Expenditures, which is Line #9
on the Federal Government's Form entitled: "General Revenue
Sharing Planned Use Report". Ayes, 8; Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Schnirring to approve the advertisement for bids for a Squad
Car for the Police Department with a Trade-In. Bids to be
opened Monday, June 16, 1975 at 10:00 A.M. and awarded at the
Council meeting on June 16, 1975 at 8:00 P.M. Ayes, 8; Nayes,
none.
The Council held a general discussion on the sprinkling
ban and decided to take no action on the proposed Ordinance
Amendment. Additional information from the Water Department
in regard to water capacity, pumping capacity, well capacity,
etc. should be undertaken to determine whether we have a water
capacity problem in the City of Hastings.
Resolution introduced by Councilman Fischer, seconded
to adopt by Councilman Hallberg to approve the final payment
to Collins Electrical Co. in the amount of $16,971.40 with the
understanding that this includes the 10% retainer. Copy of
Resolution on file in City Administrator office. Ayes, 7;
Nayes, Councilman Kramer.
Resolution introduced by Councilman Hallberg, seconded
to adopt by Councilman Fischer to approve the final payment to
Loosen, Inc. in the sum of $12,031.80. The Administrator to
write a letter to Mr. Loosen stating that this final payment
does not, in any way, remove any concerns that the City or
Mr. Loosen has in regard to the freezing compressor units which
are in the process of being examined for damage by the manu-
facturer. Mr. Loosen still has the responsibility in this area
and the City has a great deal of concern in this area. Ayes, 7;
Nayes, Councilman Kramer.
The City Engineer presented a report in regard to the
Roadside Tennis Courts on Hwy. #55. The report was accepted
by the Council and ordered placed on file.
The Council took no action in regard to the Fourth
Street Maintenance Agreement. They instructed the Engineer to
examine certain aspects of the Agreement before corning back to
the Council for re-consideration.

for work in the Parking Lot, in the amount of $22,368.00.
