The City Cotmcil of the City of Hastings, Minnesota met in a
regular meeting on Monday, August 18, 1975 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Kramer, Erickson, Novak, Latch,
Schnirring, Fischer and Mayor Petersen.
Members absent: Councilmen Elliott and Hallberg.

The Mayor asked for corrections or additions to the Minutes of
August 4, 1975, hearing none the ~nnutes were approved as read.
The Mayor then asked for corrections or additions to the Minutes
of August 7, 1975, hearing none the Minutes were approved as read.
The Mayor opened the Public Hearing concernin g the Burns and
Enstad Frontage Road proposal for a Zoning Amendment at l250-80th TH #55
at 8:01 P.M. The Notices of Mailing and Publications were read into the
record. The Mayor having given everyone an opportunity to be heard in
this matter then closed the Hearing at 8:16 P.M.
Moved by Councilman Novak, seconded by Councilman Latch REZONING-ENSTAD &
to agree that the Council should give their approval to Mr. Enstad BURNS PUBLIC
for his rezoning, based on the condition that Mr. Enstad will be HEARING
able to get a two-thirds signed Petition of the property owners
concerned, prior to final passage of the Zoning Amendment. The
two-thirds Petition must be obtained from property owners that are
within 100 feet of the subject property. Ayes, Councilmen Erickson,
Latch, Novak; Nayes, Councilmen Fischer, Schnirring and Kramer.
Being a tie vote, the Mayor voted in favor. The motion failed be-
cause a two-thirds vote of the Council is required.
Moved by Councilman Schnirring, seconded by Councilman
Fischer to deny the rezoning request of James Weiland, 517 East
3rd Street unless Mr. Weiland agrees to put in sanitary sewer and
water. Ayes, Fischer, Schnirring, Kramer; Nayes, Erickson, Latch
and Novak. Being a tie vote, the Mayor voted no. Motion failed.
Moved by Councilman Latch, seconded by Councilman
Erickson to move the First Reading of the Zoning Amendment for
James Weiland, 517 E. Third St. Ayes, Erickson, Lat ch, Novak;
Nayes, Fischer, Schnirring, Kramer. Being a tie vote, the Mayor
voted aye but the motion. failed because a two-thirds vote of the
Council is needed for this item.

Moved by Councilman Kramer, seconded by Councilman PAY CERNY & ASSOC.
Schnirring to pay for five additional meetings plus the remainder
due on the contract to Cerny & Associates with the condition. that
one more meeting will be required with Cerny & Associates for the
Public Hearing which. will be coming up shortly with the Downtown
Redevelopment Project. Ayes, 6; Nayes, none.

Moved by Councilman Fischer, seconded by Councilman
Schnirring to table the consideration of the First Reading of
the Ordinance for Annexation. Ayes, 6; Nayes, none.
The City received from the Town of Marshan, a state-
meIlt concerning the Resolution on Annexation. It was ordered put
on file by the Council. The announcement was made that the next
regular meeting would be August 26, 1975 of the Annexation Com.
Moved by Councilman Fischer, seconded by Councilman
Novak to call for a Public Hearing on the Downtown Redevelop-
ment Project for September 10, 1975, at 7:30 P.M. in the Council
Chambers of the Ci ty Hall. Ayes, 5; Nayes, Councilman Kramer.

Moved by Councilman Novak, seconded by Councilman
Schnirring to charge to the Water Department $165.32 for them
to pay in regard to the costs of the Robert Moore settlement
which the Council arrived at earlier this year. Ayes, 6;
Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Schnirring to approve the Second Reading of the Amendment of
the Liquor Ordinance which allows Wine Licenses for Restaurants.
Ayes, 5; Nayes, Councilman Novak.
M:>ved by Councilman Fischer, seconded by Councilman
Kramer to over-ride the Mayor's veto concerning the Re-naming
of the Streets. Ayes, Councilmen Fischer"Schnirring, Kramer;
Nayes, Erickson, Latch, Novak. Veto stands.
M:>ved by Councilman Schnirring, seconded by Councilman
Kramer to send the Street Re-naming problem back to the Plann-
ing Commission for their review and to then submit their re-
commendations to the Council as soon as possible. Ayes, Fischer,
Schnirring, Kramer, Novak; Nayes, Erickson & Latch.
Moved by Councilman Erickson, seconded by Councilman
Latch to authorize the expenditure of $2,207.50 to install
rubber floor matting in the Ice Arena to replace the area that
now has carpet on the floor. Ayes, 5; Nayes, Kramer.
M:>ved by Councilman Schnirring, seconded by Councilman
Latch to increase the Assistant Firechief's salary by $57.00
per month to become effective September 1, 1975. Ayes, 4;
Nayes, Erickson and Latch. t-btion passed.

Erickson to approve additional Four year terms for the follow-
ing members of the Charter Commission. Ayes, 6; Nayes, none.

Elliott to approve the granting of the Commercial and Indus-
trial Haylers License for the City of Hastings to Mr. James Peters
to be renewed August 21, 1975 for a period of one year. The
renewal of the license to be considered again by August 21, 1976.

Schnirring to approve the partial payment to Pine Bend Paving Co.
for 1975 Construction work in the amount of $43,842.02

Latch to approve Change Order #3 to the B-Tu Mix for 1974
Construction in the amount of $721.98. Ayes, 6; Nayes, none.

Erickson to approve the final payment to B-Tu Mix for 1974
Construction work in the amount of $8,064.73. Ayes, 6

Moved by Councilman Fischer, seconded by Councilman
Kramer to order a Public Hearing for the 1974 Supplemental
Assessment Rolls, i.e. Street Surfacing and Parking Lot Improve-
ments for Wednesday, September 15, 1975 at 8: 00 P.M. in the
Council Chambers of the City Hall. Ayes, 6; Nayes, none.
Councilman Novak moved, Councilman Fischer seconded
to grant a one month extension time period to Fra ser Const.
Co. and to Pine Bend Construction Company and that they be put
on notice that this will be the only extension time th at the
City will grant for the work that the Companies are now doing
for the City. The extension of time will be to September 30,
Ayes, 5; Nayes, Councilman Kramer.
Councilman Novak moved, Seconded by Councilman
Erickson to forward Mr. Novak's letter to the Planning Comm.
for their review and response to the Council concerning the
Committee's system and time of review of items under consider-
ation before the Planning Commission itself. Ayes, 6; Nayes, none.
