The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, January 8, 1973 at 8:00 o'clock P.M. in the
Council Chambers of City Hall.

Members present: Councilmen Collins, Schnirring, Kramer,
Hallberg, O'Connor, Wilson, Driscoll, Novak
and Mayor Petersen.
Members absent: None.
Moved by Councilman Collins, seconded by Councilman Driscoll
that Wallace H. Erickson be appointed Administrator, Clerk/Treasurer.
Ayes, all; Nays, none.
The City Clerk administered the Oath of Office to the new
Mayor and City Council members.
Moved by Councilman Wilson, seconded by Councilman Novak that
the following employees of the City of Hastings be appointed for a two
year term. Ayes, all; Nays, none.

Moved by Councilman Collins, seconded by Councilman Kramer that
Councilman Driscoll be nominated. Moved by Councilman Hallberg, seconded
by Councilman O'Connor that nominations close. Ayes, all; Nays, none.
The motion nominating Councilman Driscoll was then voted upon resulting
in the following vote: Aye~, all; Nays, none.
Moved by Councilman Hallberg, seconded by Councilman Schnirring
that the First National Bank of Hastings and the Northwestern National
Bank of Hastings be designated as depositories for City funds. Ayes, O.
all; Nays, none.
Moved by Councilman Novak, seconded by Councilman Hallberg
that the Hastings Gazette be designated the official City newspaper.
Ayes, all; Nays, none.
Moved by Councilman Driscoll, seconded by Councilman Wilson
that the firm of To1tz, King, Duvall, Anderson & Associates, Inc., be
appointed consulting engineers for the City. Ayes, all; Nays, none.
Councilman Wilson introduced the following reso~ution and

BE IT RESOLVED by the City Council of the City of Hastings,
Minnesota, that the following set-out amounts shall be the salaries,
compensations, wages, or fees for services rendered by the following

Work based on 173 hours per month.
Department heads will receive time and one-half for time
worked over 40 hours per week, except the Chief of Police who will
receive no compensation for time worked over 40 hours per week. The
Fire Chief will receive no compensation for time worked over 40 hours
per week, except he will be paid the regular fees for off duty ambu-
lance and fire calls. The City Clerk and Engineer will attend the
regular Council meetings and will receive no compensating time for the
same or time worked over 40 hours per week.

Insurance Benefits
All employees will continue to be covered under the hospital-
medical-surgical insurance plan adopted by the City. Full cost of employee
coverage to be paid by the City. Cost of dependent coverage to be paid
by the employee. All regular employees will also receive a $5,000. life
insurance policy with the full cost of the premiums to be paid by the
City.

Sick Leave
All employees of the City shall be entitled to accumulate one
day of sick leave for each month of employment and allowed accumulation
of sick leave up to one hundred twenty days. Employees shall bank an
additional one-half day per month after the accumulation of the 120 days
to be used only in cases of very prolonged illnesses. Sick leave will be
granted for actual sickness, temporary physical disability, quarantine
and death in the immediate family. The City may require a doctor's cer-
tificate on sick leave claims of three days or more.

Severance Pay
If an employee retires at age 65, or as otherwise provided by
law, or is forced to retire due to physical condition not allowing him
to continue gainful employment, but not if discharged or resigns by the
request of the City, after ten years of service, they will receive 35%
of unused sick-leave based on their then current hourly rate, as severance
pay. The one-half day per month accumulated after the 120 days, will
not be considered for severance pay purposes.

The police officers hours of employment is based upon 2080
hours per year, with an average of a forty hour work week for 52 weeis.
All time worked over the shift within a twenty-four hour
perios is to be paid at a rate of one and one-half times the employee's
regular rate of pay, exclusive of change in shifts within the twenty- '
four hour period.
The overtime rate will also apply for any "off duty" court
appearance or if required to consult with the City Attorney on police
matters, filling in shifts for vacations, sick leave replacements,
emergency call backs as determined by the Chief, with a two hour mini-
mum. All time worked over two hours is subject to the overtime rate.
the two hour minimum will not apply when instituted just prior to the
officer's regular shift, on an extension of such shift.

Straight time rate will apply for all other off duty overtime,
such as first aid training courses, departmental meetings, fire arms
training and authorized police training courses, with a mimimum of two
hours. Authorized time worked over two hours is to be compensated for
al the straight time rate.

that the request of.Mr. Tom Stane to have his name ~~moved from the
Liquor License of the Gardner Hotel and Tavern of 221 East 2nd Street

Moved by Councilman Wilson, seconded by Councilman Hallberg
to approve the expenses for Roger Tonsager, Building Inspector to attend
the Annual Institute for Building. Officials to be held in Bloomington
on February 15, 16, and 17, 1973, and for John Davidson, City Engineer
to attend the City & Village Engineers and Public Works Officials Confer-
ence to be held in Minneapolis on February 1 and 2, 1973. Ayes, all;

Moved by Councilman O'Connor, seconded by Councilman Kramer
that the request for Special Use or Variance of Mr. Tom Smith, 904
Maple Street described as Lot 1, 2, and East 24' of Lot 3, Block 13;
Allison's Addition be referred to the Planning Commission. Ayes, all;
Nays, .none.
The City Attorney stated that the property owned by the City
in South Hastings easterly of Highway 316, which property is commonly
referred to as the "ball park property" had been acquired from the
State of Minnesota in 1959 by a Quit Claim Deed which provided that the
City was to "have and hold the same for public purposes only. Provided,
however, that when such property is no longer used by the municipality
for public purposes, the title to said described land shall revert to
the State of Minnesota as provided by laws of Minnesota, 1957, Chapter
170." It was further noted that this is the parcel of property that
the Hockey Boosters Association had an interest in for purposes of

constructing a hockey rink. but that the reversionary clause prohibited
this use as proposed by the Hockey Boosters. Further that the highest
and best use of the property might very well be for purposes other than
as a ball park. The City Council was advised as to whether the Council
wished City Officials to attempt to have the reversionary clause removed
by legislative action during the 1973 session.
WHEREUPON. the following resolution was introduced by Council-
man Schnirring. who moved its adoption:

RESOLUTION ON BALL PARK PROPERTY
NOW THEREFORE BE IT RESOLVED by the City Council of Hastings:
WHEREAS. by deed dated December 23. 1959. the State of Minnesota
conveyed to the City of Hastings. the following described property:
"All that part of the Southwest Quarter (SW~rl of
Section Thrity-four (34). Township One Hundred Fifteen
(115). Range Seventeen (17). described as follows:
Commencing at the intersection of the Southeasterly
line of Lot 23. in Block 1. of the Town of Vermillion
with the Easterly line of State Aid Road No. 10;
then Northeasterly at right angles to the Easterly
line os said State Aid Road No. 10. a distance of
741.16 feet thence at right angles Southeasterly
881.59 feet. thence at right angles Southwesterly
741.16 feet to the intersection with the Easterly
line of said State Aid Road No. 10. thence North-
westerly along said Easterly line of said State
Aid Road No. 10 a distance of 881.59 feet to the
point of beginning. containing 15 acres of land
according to the Government Survey." and:

WHEREAS. said conveyance to the City of Hastings provides
that the land will revert to the State of Minnesota if it is no longer
used by the municipality for public purposes; and
WHEREAS. it appears that the highest and best use of said
land may no longer be for public purposes by the municipality.
NOW THEREFORE. BE IT RESOLVED:
1. That the City Officials request our representative in
the State Legislature to introduce legislation which will. in effect.
remove said reversionary provision.

The City Attorney stated that. in connection with the proposed
flood control improvements for the Vermillion River in South Hastings.
the Corps of Engineers had requested that the City obtain from the State
Legislature. authority to enter into a contract with the Crops of Engin-
eers which contains a "hold harmless" provision.
Moved by CouncilmanCO';Connor. seconded by Councilman Wilson
that the following be offered:
That our Representative in the Legislature offer and support
legislation authorizing the City of Hastings specifically. or muni~ipal-
ities in the State in general including the City of Hastings. to enter

into contracts with the United States of America through its Corps
of Engineers for flood control work which contracts provide that the
municipality, and/or the City of Hastings in particular agrees to hold
harmless the United States of America from damages due to the construc-
tion of the project.
Upon being put to a vote, the following vote was received.

Moved by Councilman Driscoll, seconded by Councilman Novak
to ~ss the first reading to amend Section 7 of an, Ordinance entitled:
"AN ORDINANCE PROVIDING. FOR THE LICENSING OF TAXICABS AND REGULATING
THEIR OPERATION IN THE CITY OF HASTINGS" to read as follows:

Section 7. Taxicab Cards and Rates.
The r~te structure shall be as follows:
The fare for transportation within zone shall be 65~.
The fare for crossing one zone boundary shall be 75~.
The fare for crossing two zone boundaries shall be 85~.
The fare for crossing three or more zone boundaries shall be 95~.
The fare for transportation outside the City limits shall
be 50~ plus 50~ per mile or fraction thereof.
The fare shall be increased by 15~ for each additional pas-
'sertger over 14 years of age.
An additional rate of 25~ may be charged for each additional
required stop.
One additional zone shall be added to the present zone
schedule, which will be West of Westview Drive in the City of Hastings.
The Council passed this first reading by a vote of: Ayes,
all; Nays, none.

Councilman O'Connor introduced the following resolution and

RESOLUTION ON RETIRiENG MAYOR AND COUNCILMEN
BE IT RESOLVED, that the City Council of the City of Hastings,
Minnesota pay tribute to the Honorable Evarist J. Rotty, our retiring
Mayor.
His voluntary retirement brings to an end sixteen (16) years
of continuous service as Councilman and Mayor to the City of Hastings
and the 1973 City Council of Hastings is proud to note his retirement
and extend to him a humble expression of our esteem for him.
It is fitting that this City Council should note in its records
the retirement of Mayor Rotty along with its sincere and profound appre-
ciation and thanks in behalf of the citizens of this community for his
many years of faithful service.
We wish him we~l in the future and it is hereby resolved
that a copy of this Resolution be presented to the Honorable Evarist
J. Rotty.
BE IT FURTHER RESOLVED, that it is fitting that this City
Council should note in its records the retirement of Councilmen Joseph
Novak, Paul Kane and Jack Christenson along with its grateful appre-
ciation and thanks in behalf of the c . s of this community for
their many years of faithful service.

** Insurance Benefits (continued)
Also, the City will provide a long-term disability insurance
policy with no cost to the employee, as follows:
Eligibility: Each active, full-time employee who works
a minimum of 30 hours per week, except tem-
porary employees.
Qualifying Period: Benefits accruewith respect to anyone
period of disability after the expiration of
a qualifying period of three (3) consecutive
months.
Benefit Period: Monthly benefits are payable during the

but in no event are benefits payable beyond
the attainment of age 65.
