The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, February 5, 1973 at 8:00 o'clock P.M. in the
Council Chambers of City Hall.

Members present: Councilmen Collins, Schnirring, Kramer,
Hallberg, O'Connor, Wilson, Driscoll, Novak,
and Mayor Petersen.
Members absent: None.
Minutes of the last meeting were read, corrections made and
approved.
Moved by Councilman O'Connor, seconded by Councilman Wilson
to set the date for the next regular meeting for February 20th instead
of the 19th because of the legal holiday. Ayes, all; Nays, none.
Moved by Councilman Kramer, seconded by Councilman Novak to
hold over the third reading on the Taxi-cab amendment to the next regu-
lar meeting scheduled for February 20th. Ayes, all; Nays, none.
Moved by Councilman Novak, seconded by Councilman Hallberg
to approve the appointment of Milo Simacek and Lee Erickson to the
Natural Resources Commission to fill the unexpired term of Dale Talafous
and Tom Wollmering. Termination date for Mr. Simacek is January 1, 1975,
and for Mr. Erickson on January 1, 1974. Ayes, all; Nays, none.
Moved by Councilman Hallberg, seconded by Councilman Kramer
to approve the purchase of a compressor and generator to be used by the
Street and Water departments. Ayes, all; Nays, none.

approve the expenses for Wallace H. Erickson to attend the Labor Relations
Seminar to be held at the Sheridan Motor Inn in Minneapolis on February
7th and 8th, 1973. Ayes, all; Nays, none.

Councilman Wilson introduced the following resolution and
moved its adoption:
RESOLUTION
ADOPTING LAND USE AND CONTROL MEASURES
IN FLOOD PLAIN AREAS
WHEREAS, certain areas of the City of Hastings are subject to
periodic flooding from its streams causing serious damages to properties
within these areas~ and

WHEREAS, relief is available in the form of flood insurance as
authorized by the National Flood Insurance Act of 1968 as amended: and
WHEREAS, it is the intent of this City Council to comply with
land use and management criteria regulations as required in said Act: and
WHEREAS, it is also the intent of this City Council to recognize
and duly evaluate flood hazards in all official actions relating to lane
use in the flood plain areas having special flood hazards,
NOW THEREFORE, BE IT RESOLVED, that this City Council of the
City of Hastings hereby assures the Federal Insurance Administration that
it will:

1. Require building permits for all proposed construction or other
improvements in the City of Hastings:
2. Review all building permit applications for new construction or
substantial improvements to determine whether proposed building
sites will be reasonably safe from flooding. If a proposed build-
ing site is in a location that has a flood hazard, any proposed new
construction or substantial improvement (including prefabricated
and mobile homes) must:
i. Be designed (or modified) and anchored to prevent floatation,
collapse, or lateral movement of the structure.
ii. Use construction materials and utility equipment that are
resistant to flood damage.
iii. Use construction methods and practices that will minimize
flood damage.
3.
Review subdivision proposals and other proposed new development
to assure that:
i. All such proposals are consistent with the need to minimize
flood damage.
o
ii. All public utilities and facilities, such as sewer, gas, elec-
trical, and water systems are located, elevated, and constructed
to minimize or eliminate flood damage, and
iii. Adequate drainage is provided so as to reduce exposure to
flood hazards, and
4. Require new or replacement water supply systems and/or sanitary
sewage systems to be designed to minimize or eliminate infiltration
of flood waters into the systems and discharges from the systems
into flood waters, and require on-site waste disposal systems to be
located so as to avoid impairment of them or contamination from
them during flooding. All private e and other sanitary waste
disposal systems must conform to a 1ica e standards, driteria,
rules and regulations of the Minnes ta Dep tment of Health and
the Pollution Control Agency and of ny app icab1e local governmental
regulations in terms of size, const tion nd maintenance.

Councilman Driscoll introduced the following resolution
and moved its adoption:
RESOLUTION RECEIVING PRELIMINARY REPORT AND
SETTING PUBLIC HEARING ON PROPOSED IMPROVEMENTS
WHEREAS, a preliminary report has been prepared by the City
Engineer with respect to the improvement described in the Notice of
Hearing hereinafter set forth, and

WHEREAS, said Engineers have advised this Council that the
aforesaid improvement is feasible and should be made as proposed in the
Notice of Hearing thereon, and
WHEREAS, the Council considers it expedient to made the follow-
ing listed improvements,
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Hastings, Minnesota, as follows:
1. Said Feasibility Reports are hereby accepted and approved.
2. Said Improvements are hrerby combined and designated 1973
Improvements and shall be undertaken pursuant to the
provisions of Chapter 429, Minnesota Statutes 1961.
3. A Public Hearing relative to said improvements will be held
on March 5, 1973 at 7:00 o'clock P.M. in the Council Cham-
bers of the City Hall for the consideration of said improve-
ments, the nature of which, the estimated cost thereof, the
area proposed to be assessed therefore, are described in
the Notice of Hearing which shall be in substantially the
following form and is made a part thereof.

Notice is hereby given that the Ctiy Council of the City of
Hastings, Minnesota, will meet in the Council Chambers of the City Hall at
7:00 o'clock P.M. on Monday, March 5, 1973 to consider the following im-
provements designated Improvements 1973:
PROPOSAL I
BITUMINOUS SURFACING
CONCRETE CURB AND GUTTER AND SIDEWALK
1. Hillside Court and View Court within Dakota Hills 2nd Addition-
Concrete Curb, Gutter and Bituminous Surfacing.
2. East side of Spring Street between 17th and 18th Streets -
Sidewalk Construction.
3. West side of Pine Street, T.H. 55 to 15th Street - Sidewalk
Construction.

STATE-AID PROJECT
1. Pleasant Drive, 19th Street to 23rd Street - Concrete Curb and Gutter,
Surfacing and Sdiewalk.
The City Council proposes to assess all or part of the cost for such
improvements against every lot, piece or parcel of land within the Corpor-
ate-Limits that abuts upon said improvements according to the special
benefits received without regard to cash valuation.
The estimated cost of said improvements is $878,000.00

Persons desiring to be heard in reference to the proposed improvements
may be heard at said time and place.
Dated this 5th day of February, 1973.
The City Clerk is hereby authorized and directed to cause said
notice to be given two publications in the official newspaper and to
give mailed notice to every property owner whose property is benefited
by said improvements. Such publications shall be one week apart and
at least three days shall elapse between the last publication and the
date of hearing. Mailed notice shall be ive ot less than ten days
before the hearing, pursuant to provision of Se tion 429.031, Minne~-
sota Statutes.

ESTABLISHING
POLICE DEPARTMENT FUND

Moved by Councilman Driscoll, seconded by Councilman Kramer
that pursuant to the 1971 Minnesota Session Laws, Chapter 695 (M.S. 1971
Chapter 69) on State Aid to Police Relief Associations and Police Depart-
ments, there shall be a Police Department fund in the municipal treasury
to be used for police purposes. The Police Department budget will be
removed from the General Fund and set in an ear marked fund within the
total budget for the City of Hastings. Ayes, all; Nays, none.
FEDERAL REVENUE SHARING FUND
Moved by Councilman Driscoll, seconded by Councilman Novak

that pursuant to the State and Local Fiscal Assistance Act of 1972,
local governments are required to place Revenue Sharing monies into
special funds and account for them separately from other funds. This
rule was established so that the Secretary of the Treasury can maie
periodic compliance studies and Congress will be assisted later in
determining whether the Revenue Sharing program should be continued,
revised or terminated at the end of the five-year period, therefore
this Federal Revenue Sharing fund be established. Ayes, all; Nays,
none.

Upon investigation of the property at 510 East 6th Street, owned by the
above, we have found the following:
The property has been abandoned for some weeks with doors
open, house unheated, water pipes broken, and in a condition
unfit for human occupancy.

The out-buildings and yard are in total disaray. No attempt
to close doors and windows as a safety factor, with debris
piled about. There is also an abandoned refrigerator and
dryer on the premises with doors still in place.
This is to notify you the property has been duly inspected and tagged.
It now awaits legal dispensation, and would appreciate your immediate
attention.

In response to a complaint received, an inspection was made this date
of the above property. We have found the following conditions exist:
The house is open, unattended and unheated.
There is a refrigerator abandoned with the door in place.
Also other equipment free standing.
We find substandard plumbing, heating, wiring and the
structure in very poor condition.
We feel that in its present condition, this house could not be occupied
and could not be repaired to meet minimum standards.

(as it deals with rear lot setback requirements) by St. Johns Lutheran

in the City of Hastings in accordance with Section 12.3 of the City of
Hastings Zoning Ordinance dated December 7, 1970, he/referred to the

as a Board of Adjustment, to grant a Special Use Permit to allow a bicycle
sales and repair shop within an R-2 zone according to Section 12.2 of the

Moved by Councilman Novak, seconded by Councilman Kramer to
authorize the purchase of a new gas pump from Pump & Meter Service, Inc.,
including the automatic nozzle, key bank and accumulative stamper with
52 additional keys at a cost of $1,117.80. Ayes, all; Nays, none.

Moved by Councilman Hallberg, seconded by Councilman Schnirring
to appoint Charles Keller as a member to the Hastings Planning Commission
of the City of Hastings to replace Walter E. Petersen whose term expired
January 1st, 1973.
Moved by Councilman Novak, seconded by Councilman Collins to
table the appointment of Charles Keller until the meeting of February
20th, 1973. Ayes, Councilmen Collins, Kramer, Driscoll, and Novak;
Nays, Councilmen Schnirring, Hallberg, O'Connor, and Wilson. Being a
tie vote, Mayor Petersen voted in the affirmative to table the appointment
until February 20th. Motion passed by a five to four vote.
Moved by Councilman Hallberg, seconded by Councilman Schnirring
