HomeMy WebLinkAbout03-05-73 l r I ,...-- 1175 Hastings, Minnesota March 5, 1973 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, March 5, 1973 at 7:00 o'clock P.M. in the Council Chambers of City Hall. Members present: Councilmen Collins, Schnirring, Kramer, Hallberg, O'Connor, Wilson, Driscoll, Novak and Mayor Petersen. Members absent: None. Minutes of the last meeting were read, corrections made and approved. The City Clerk presented affidavits showing the due publication of the notice of a Public Hearing for the 1973 Improvements: Proposal I - Bituminous Surfacing, Concrete Curb and Gutter and Sidewalk Hillside Court and View Court within Dakota Hills 2nd Addition - Concrete Curb, Gutter and Bituminous Surfacing. East side of Spring Street between 17th and 18th Streets - Sidewalk Construction. West side of Pine Street, T.H. 55 to 15th Street - Sidewalk Construction. Proposal II - Sanitary Sewer and Lift Stations, Watermain, Storn Sewer, Street Grading and Gravel Base Highland Hills 1st Addition and 15th Street west from Brittany Road - Grading and Base, Sanitary Sewer, Watermain and Storm Sewer. North Frontage Road west from Pleasant Drive - Grading and Base and Storm Sewer. 1/16 Section Line along North Line of Dakota Country Court House property and Imperial Estates west from Pleasant Drive - Grading and Base, Sanitary Sewer, Watermain and Storm Sewer. North-South Street within Outlot E and part of Pleasant Drive within Imperial Estates 1st Addition - Grading and Base, Water- main and Storm Sewer. 14th Street within Dakota Hills 3rd Addition - Sanitary Sewer, Storm Sewer, Watermain and Street Grading and Gravel Base Construction. Sibley Street and Ramsey Atreet north of 2nd Street - Sanitary Sewer and Lift Station. Area on W. 2nd Street between Pine and Spring Street not now presently served - Sanitary Sewer and Water. Lock and Dam Road north of 2nd Street - Watermain. T.H. 316 from T.H. 61 to new National Guard Armory site at Spiral Boulevard - Sanitray Sewer Extension. 4th Street Lift Station at Spring Street. Descriptions For Areas Benefited By Watermain and Storm Sewers That part of the N ~ of Section 29, Tl15, R17, lying westerly of Pleasant Drive. 1176 State-Aid Project Pleasant Drive, 19th Street to 23rd Street - Concrete Curb and Gutter, Surfacing and Sidewalk. The Council heard all persons interested in said improvements. Al~ persons present were afforded an opportunity to present their views and objections to the making of said improvements. The City Clerk read a letter from Leo Schmacher requesting the deletion of the following: North-South Street within Outlot E and part of Pleasant Drive within Imperial Estates 1st Addition - Grading and Gravel Base Construction. o and a letter from Koch Refining and the United States Corps of Engineers requesting the deletion of the following: Lock and Dam Road north of 2nd Street - Watermain. Moved by Councilman Novak, seconded by Councilman Driscoll to delete the above listed projects as requested by Leo Schumacher and Koch Refining and U.S. Corps of Engineers. Ayes, all; Nays, none. The Council then discussed at length the imporvements on an area on West 2nd Street between Pine and Sprint Street not now presently served by Sanitary Sewer and Water. Moved by Councilman Novak, seconded by Councilman Kramer to delete the West 2nd Street project. Ayes, all; Nays, none. Moved by Councilman Hallberg, seconded by Councilman Novak to include in the 1973 Improvements the Watermain construction on East 10th Street and Progress Drive. Ayes, all; Nays, none. o Mr. Glen H. Featherstone officially requested to go on record objecting to the Dakota County Survey establishing the South line of his property. The following resolution was then introducednby Councilman Schnirring who moved its adoption: RESOLUTION ORDERING IMPROVEMENT, APPROV~NG PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS WHEREAS, after due notice of Public Hearing on the 1973 Improve- ments for the following streets: Hillside Court and View Court East side of Spring Street between 17th & 18th Streets West side of Pine Street, T.H. 55 to 15th Street Highland Hills 1st Addition and 15th Street west from Brittany Rd. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings, Minnesota as follows: That it is advisable, expedient and necessary that the City of Hastings construct said improvements and hereby orders the same to be made. l AND WHEREAS, pursuant to a resolution passed by the Council on the 2nd day of October, 1972, the City Engineer has prepared plans and specifications for the improvements of the following: Proposal I - Bituminous Surfacing, Concrete Curb and Gutter and Sidewalk Hillside Court and View Court within Dakota Hills 2nd Addition - Concrete Curb, Gutter and Bituminous Surfacing. East side of Spring Street between 17th and 18th Streets - Sidewalk Construction. West side of Pine Street, T.H. 55 to 15th Street - Sidewalk Construction. State Aid Project Pleasant Drive, 19th Street to 23rd Street - Concrete Curb and Gutter, Surfacing and Sidewalk. And have presented such plans and specifications to the Council for approval. NOW THEREFORE BE IT RESOLVED by the City Council of Hastines, MiMesota: 1178 1. Such plans and specifications, a copy of which is on file in the City Clerk's Office are made a part hereof are hereby approved. 2. The City Clerk shall prepare and cause to be inserted in the official paper an advertisement for bids upon the making of such approved plans and specifications. The advertisement shall be published for three (3) weeks and shall specify the work to be done and s~all state that bids will be opened and considered by the Council at 2:00 o'clock P.M. on Thursday, April 19, 1973 in the Council Chambers of the City Hall and awarded on Monday, April 23rd, 1973 at 8:00 o'clock P.M. and that no bids will be considered unless sealed and filed with the Clerk and accompanied 0 by a cash depository, cashier's check, bit bond or certified check payable . .. . to the Clerk for five (5) percent of the ount of such bids. Moved by Councilman O'Connor, seconded by Councilman Collins to hold over the resolution entitled: "RESOLUTION SUPPORTING THE ADOPTION OF LEGISLATION AUTHORIZING THE USE OF TWIN TRAILERS ON STATE HIGHWAYS" until the next regular meeting on March 19th, 1973. Ayes, all; Nays, none. Moved by Councilman Driscoll, seconded by Councilman Schnirring to pass the second reading of an amendment to the Taxi-cab Ordinance with a rate schedule set forth as follows: Ayes, all; Nays, none. Moved by Councilman Novak, seconded by Councilman Kramer to approve the Planning Commission's recommendation to deny the request of James Hoffman to rezone Lot 5, Block 108, of the Original Town of Hastings. Moved by Councilman O'Connor, seconded by Councilman Novak to approve the Cigarette license of the Continental Oil Company for the Conoco Station located at 1421 Vermillion Street in the City of Hastings. Ayes, all; Nays, none. Moved by Councilman Kramer, second~d by Councilman Collins to deny the request of the Continental Oil Company for a 3.2. Off sale Beer license, for the Conoco Station at 1421 Vermillion Street in the City of Hastings. Ayes, all; Nays, none. Moved by Councilman Hallberg, seconded by Councilman Driscoll to approve the expenses for the Mayor, Councilmen, Administrator, Engineer, Police Chief, Fire Chief, and Planning Commission Chairman to attend the Minnesota Municipalities League Convention to be held in Alexandria, Minne- sota on June, 27th, 28th and 29th, 1973. Ayes, all; Nays, none. Moved by Councilman Schnirring, seconded by Councilman Wilson to approve the Library Board recommendation to hire Mr. Ken Hanson as part-time Library janitor at a salary of $170.00 per month effective March 5, 1973. Ayes, all; Nays, none. o o 1179 Moved by Councilman Hallberg, seconded by CouncilmanSchnirring to approve the City Engineer and the City Attorney to acquire necessary right of way and/or slope easements as necessary for all projects in the 1973 Construction Program. Moved by Councilman Wilson, seconded by Councilman O'Connor to approve the expenses for Police Chief Daryl Plath to attend the Minnesota State Chiefs of P9lice Institute to be held on March 14th, 15th, and 16th, in Minneapolis, Minnesota. Ayes, all; Nays, none. l Moved by Councilman Hallberg, seconded by Councilman Wilson to approve the tuition and registration fee for Hastings Juvinile Officer Ronald Hillmer to attend the National District Attorneys Seminar on Narcotics and Drug Abuse to be held in Chicago on April 23rd thru the 27th. Ayes, all; Nays, none. The next item for consideration was a report from the City Engineer regarding the necessity of acquiring railroad right-of-way from the present Peavy spur line into the Industrial Park. The Engineer's report showed that the following described property will have to be ac- quired by the City for this purpose as it is the only means of obtaining railroad access to the industrial park: Part of the SE~ of the NW~ of Section 34, Township 115 North, Range 17 West, described as follows: l Beginning at a point 171 feet Easterly of the intersection of the institutional coal spur and the Chicago Milwaukee St. Paul & Pacific Railroad spur track; thence Easterly on the South rail of the coal spur 400 feet; thence North 0 degrees '57 minutes 10 seconds East 342.23 feet; to the in- tersection with the CMStP & P Railroad spur track; thence Southwesterly along the CMStP & P Railroad spur track 521 feet to the point of beginning. After furth~~iscussion, the following motion was duly made by Councilman O'Connor, and seconded by Councilman Novak as follows: THAT WHEREAS, the City of Hastings is presently involved in the development of an Industrial Park along the southerly limits of the City; and WHEREAS, it is essential that railroad service be made available to said industrial park; and WHEREAS, there is only one means of obtaining railroad access to said industrial park, which means is across the following described property: Part of the SE~ of the NW~ of Section 34, Township 115 North, Range 17 West, described as follows: Beginning at a point 171 feet Easterly of the intersection of the institutional coal spur and the Chicago Milwaukee, St. Paul & Pacific Railroad spur track; thence Easterly on the South rail of the coal spur 400 feet; thence North 0 degrees 57 minutes 10 seconds East 342.23 feet; to the intersection with the CMStP & P Railroad spur track; thence South westerly along the CMStP & P Railroad spur track 521 ft. to the point of beginning. l NOW, THEREFORE, BE IT HEREBY RESOLVED THAT: 1. That the therein City Clerk, and other city officials are hereby authorized and instructed to attempt to negotiate the purchase of said property from the owner thereof. 2. If the City officials are unable to negotiate a purchase, they are authorized and instructed to institute condemnation proceedings either safely or in conjunction with and in cooperation with the Chicago, Milwaukee, St. Paul & Pacific Railroad Company. Upon being put to a vote, the following vote was recorded.
