The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday April 2, 1973 at 8:00 o'clock P.M. in the
Council Chambers of City Hall.

Members present: Councilmen Collins, Schnirring, Kramer, Hall-
berg, O'Connor, Wilson, Driscoll, Novak and
Mayor Petersen.
Members absent: None.
Minutes of the last meeting were read and approved.
BIDS FOR WATER DEPARTMENT ONE-HALF TON PICKUP
Pursuant to an advertisement for bids for furnishing the City
with one (1) one-half ton pickup for the Water Department, the following
bids were received complying with the advertisement.

Moved by Councilman Driscoll, seconded by Councilman Schnirring
to hold over awarding the bid! until the next regular meeting on April
16th. Ayes, all; Nays, none.
The Mayor reopened the Hearing continued from the March 19th
meeting on the Special Use permit request of Mr. J. A. Neidere for a
basement apartment at the residence of 543 McNamara Avenue, Lot 9,
Block 1, Le Duc's 6th Addition in accordance with Section 94.2 of the
City Zoning Ordinance.
The Council afforded all persons present an opportunity to
present their views and objections. The City Engineer read the list
of requirements that must be met before the property in question would
comply. All requirements could be met except the ceiling height. It
was requested by Mr. Neidere that a request for a varience on the require-
ment be issued.
Moved by Councilman Driscoll, seconded by Councilman Hallberg
to recommend approval of the Special Use Permit, subject to the State
Building Official's approval on the ceiling height varience. Ayes, all;
Nays, none.
Moved by Councilman Driscoll, seconded by Councilman Wilson to
approve the request for a name change on Nybo~s On-Sale liquor license
from Robert L. Nybo to Nybo's Castle Corporation. Ayes, all; Nays, none.

Moved by Councilman Hallberg, seconded by Councilman Kramer
to approve a refund of $292.60 to be paid to James H. Charlton for an
overpayment of 1971 Assessments on Lot 2, Block 6, Country Estates.
Ayes, all; Nays, none.
Moved by Councilman O'Connor, seconded by Councilman Wilson to
refer to the Planning Commission the request for a Special Use Permit
for John Delbourn to construct a back yard swimming pool at his residence
at 1909 Ashland Street for the purpose of private swimming instruction.
Ayes, all; Nays, none.
Moved by Councilman Driscoll, seconded by Councilman Novak to
remove the name of Lawrence Schweich, Street Department employee from
the payroll records due to his termination of employment. His final
work day paid thru March 16, 1973. Ayes, all; Nays, none.

Moved by Councilman Driscoll, seconded by Councilman Novak
to refer to the Planning Commission the request of Hudson Manufacturing
for a varience in accordance with Section 12.3 of the City Zoning Ord-
inance dated December 7, 1970 for construction of an addition to the
existing building located in Block 6, Original Town of Hastings. Ayes,
Councilman Collins, Schnirring, Kramer, Hallberg, Wilson, Driscoll, and
Novak. Nays, Councilman O'Connor.

A public hearing on the above request will be held by the City
Council sitting as a Board of Adjustment a regular meeting of the City
Council scheduled for Monday, April 16, 73 a 8:00 o'clock P.M. in the
Council Chambers of the City Hall.

Moved by Councilman Hallberg, seconded by Councilman Kramer
to pass the first reading of "AN AMENDMENT TO THE CITY ZONING ORDINANCE"
dated December 7, 1970 in accordance with Section 17 for the purpose of
rezoning from Residential 3 to Residential 4, the undeveloped portion
of Valley Manor Addition consisting of 15.2 acres. (Legal description
to be included in the 3rd reading) Ayes, Councilmen Collins, Schnirring,
Kramer, Hallberg, Driscoll, and Novak. Nays, Councilmen Wilson and
O'Connor.

Moved by Councilman Wilson, seconded by Councilman Schnirring
to authorize the City Engineer to advertise for a Survey Crew Chief for
the Summer Construction Program. This employee is to be hired as a part-
time employee at an hourly rate of $5.00 per hour. Ayes, all; Nay~, none.
Moved by Councilman Driscoll, seconded by Councilman Kramer
that the bills as audited be approved and the City Clerk be instructed
to issue warrants for the same. Ayes, all; Nays, none.
