The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday July 2, 1973 at 8:00 o'clock P.M. in the Council Chambers
of City Hall.
Members present: Councilmen Collins, Kramer, Hallberg, O'Connor,
Driscoll, Novak, and Mayor Petersen.
Members absent: Councilman Schnirring.

Minutes of the last meeting were read and approved.
Councilman Driscoll introduced the following resolution and moved
its adoption:
BIDS ON CRUSHING GRAVEL
WHEREAS, pursuant to an advertisement for bids for crushing gravel
for the City of Hastings, the following bids were received complying with
the advertisement:

WHEREAS, it appears that Davies Excavating, Inc. is the lowest re-
sponsible bidder,
NOW THEREFORE BE IT RESOLVED by the City Council of Hastings:
The Mayor and City Clerk are hereby authorized and directed to enter
into a contract with Davies Excavating, Inc. for the crushing and screening
of 8,000 cubic yards of gravel according to the specifications therefore
approved by the City Council and on file in the office of the City Clerk.

Councilman Collins seconded the motion to adopt said resolution and
the same was passed by the following vote: Ayes, all; Nays, none.
Moved by Councilman O'Connor, seconded by Councilman Kramer to in-
struct the City Clerk to investigate the procedures and costs of retaining
a utility rate expert to review the Central Natural Gas rate increase request
on behalf of the City, and further ask Central Natural Gas Co. to bear the
costs involved in such a study. Ayes, all; Nays, none.
Moved by Councilman Hallberg, seconded by Couneilman Kramer to
approve the following pattial payments to Robert W. Moore Construction Company
for the 1973 Construction Program and to George Olson Construction Company
for work performed on the Public Works Garage. Ayes, all; Nays, none.

Moved by Councilman Hallberg, seconded by Councilman Kramer to deny
the request of the Hastings Bee Line for two customer parking spaces on West
Second Street. Ayes, all; Nays, none.
Moved by Councilman Hallberg, seconded by Councilman Driscoll that
the City Council acting as a Board of Adjustment, in accordance with Section
12.4 of the City Zoning Ordinance, approve the request for variance from the
Central Natural Gas Company for three strand barb wire fencing to be located
at their Peak Shaving Plant, as an extension of a pre-existing condition.

Councilman Driscoll introduced the following resolution and moved
its adoption:
RESOLUTION LEVYING TAX FOR ARMORY
PURPOSES AND REPEALING RESOLUTION
OF SEPTEMBER 1St 1972
BE IT RESOLVED by the City Council of the City of Hastingst Minne-
sotat as follows:
1.01 Minnesota Statutest Section 193.l45t Subdivision 2t authorizes 0
municipalities in which an Armory has been constructed or is to be constructed ..f
to irrevocably provide for levying and collecting annually for a specific
periodt not exceeding 40 yearst a tax upon all taxable property therein of
such amount as such governi~g body may detarminet not exceeding one mill.
Pursuant to said authoritYt this Council ~dopted a r~solution at a regular
meeting held on September 1St 1972t whereby it irrevocably levied upon the
taxable property of the City of Hastingst Minnesotat for a period not to ex-
ceed 30 years an annual tax of one mill or $6t600t whichever is lesst for the
purpose of paying part of the annual principal and interest to become due on
$135tOOO Hastings Armory Bondst to be issued by the Minnesota State Armory
Building Commission for the purpose of financing the cost of a new Armory in
the City of Hastingst Counties of Washington and Dakota.
1.02 Minnesota Statutest Section 273.ll0lt requires with respect
to taxes levied in the years 1972 and thereaftert for collection in the years
1973 and thereaftert that the "true and full value" of the property shall be
the same as the market value of property. By virtue of Section273.1l0lt and
without regard to the appreciation or depreciation in the value of property
within a taxing districtt or depreciation in the value of property within a
taxing districtt the levy of a tax in 1972 at the rate of one mill will pro-
duce three times the revenues in the years 1973 and thereafter as the levy of
a tax in 1971 and the same rate produced in 1972.
1.03 Minnesota Statutest Section 273.ll02t providest with respect 0
to taxes levied in the years 1972 and thereafter t that any tax rate limita- ..Ji.,
tion imposed by law or charter on the levy of taxes€by a political subdivi-
sion or public corporationt and expressedin mills times the assessed value
or times full and true valuet shall be divided by three to determine the
a;;licable limitation for taxes levied in said years. Application of Section
273.1103 to Minnesota Statutest Section 193.l45t Subdivision 2t requires that
the tax rate limitationcontained.i~ said subdivision 2 be reduced from one
mill per year to one-third of a mill per year for taxes levied in the years
1972 and thereafter.
1.04 This Council has been advised by the Minnesota State Armory
Building Commission that the City's annual share of the debt service with
respect to the $135tOOO Hastings Armory Bonds is $6t600.
2.01 It is hereby foundt determined and declared to be necessary
and expedientt in order to insure that the provisions of Section 273.1101
are effectuated and the requirements of Section 273.1102 satisfiedt that for
each of the years 1973 through 2002t or until such earlier time as the $135tOOO
Hastings Armory Bondst dated July 1t 1973t are fully paid and discharged in
accordance with their termst there be and hereby is irrevocably levied an
annual tax upon all taxable property within the City of Hastings in the amount
.i"$6~600; providedt that in no event shall the annual amount levied exceed
the levy limitation imposed by Minnesota Statutes 1971t Section 193.145t Sub-
division 2. In the event that a tax levy in the amount of $6t600 should in
any year exceed the limitation imposed by Minnesota Statutes 1971t Section 0\
193.145t the dollar amount to be levied in such year shall be reduced to the
maximum amount authorized; provided that in any future year during which the
bonds are outstandingt to the extent permissible within the levy limitation
of Section 193.145t the $6t600 levy shall be increased by an amount or amounts
sufficient to make up any deficiency in the payment of the City's share of the
debt service on the bonds resulting from the application of said limitation.
The proceeds of said levy are hereby irrevocably appropriated and shall be
paid to the Minnesota State Armory Building Commission for the purpose of pay-
ing the principa1t interest and redemption premiumt if anYt on $135tOOO Hast-
ings Armory Bondst dated July 1t 1973.

2.02 The resolution adopted by this Board on September 18, 1972,
with respect to the levy of a tax of one mill or $6,600, whichever is the
lesser, for the Hastings Armory Bonds is, to the extent inconsistent here-
with, hereby repealed and the tax levies ed for in said resolution
in the years 1973 and thereafter are here can lIed to be replaced by the
levies in the amounts and for the years as, set orth in Section 2.01.

the following abatement, as recommended by the County Assessor be approved.

REAL ESTATE TAXES
Parcel No. 14056 - Over valuation on structure - It was found in checking,
that an error was made on house value for 1972 assessment.
Clerical error in extension of structure value.
Moved by Councilman Hallberg, seconded by Councilman Novak to sell
to Western Film the following property in the Industrial Park:
That part of Lot 1, Block 1, Hastings Industrial Park
No. 1 within Section 34, Tl15N, Rl7W City of Hastings
Dakota County, Minnesota, according to the recorded
plat thereof, described as follows:
Beginning at the Westerly most corner of said Lot 1
(which point is on the Southerly right-of-way line
of Spiral Boulevard); thence North 61 degrees 43
minutes 30 seconds East along the Southerly right-
of-way line of Spiral Boulevard for a distance of
180.00 feet to the point of beginning of the parcel
to be described:
Thence continuing North 61 degrees 43 minutes 30
seconds East along the Southerly right-of-way line
of Spiral Boulevard for a distance of 51.05 feet;
thence South 28 degrees 16 minutes 30 seconds East
for a distance of 393.14 feet; thence Westerly along
a tangential curve concave to the North having a
radius of 450.00 feet and a central angle of 07 de-
grees 16 minutes 30 seconds West for a distance of
360.00 feet to the point of beginning containing
0.4413 acres.

Moved by Councilman Novak, seconded by Councilman Collins to
approve a wage increase to $950.00 per month retroactive to June 18th, for
Mr. Thomas Donahue, Assistant City Engineer who has successfully completed
his educational six months leave of absence. Ayes, all; Nays, none.
Moved by Councilman Novak, seconded by Councilman Driscoll to
appoint Richard Doffing as acting Assistant Water Superintendant effective
July 1, 1973 and increase his monthly wage from $873.00 to $903.00. Ayes,
all; NaYIiJ, none.
Moved by Councilman Kramer, seconded by Councilman Collins to
approve a wage increase from $808.00 to $843.00 per month for Alfred Lund-
berg as Light Equipment Operator who has satisfactorily completed three
months of his six month probationary period continuing until October 1, 1973.
Ayes, all; Nays, none.
Moved by Councilman Hallberg, seconded by Councilman O'Connor to
schedule a Public Hearing for 8:00 o'clock P.M. on August 6, 1973 in the
Council Chambers of City Hall on the changes in the City Zoning Ordinance
incident to the Ordinance Codification and further to publish notices nec-
essary to effect enactment of the Codified Ordinances. Ayes, all; Nays, none.
