The City Council of the City of Hastings, Minnesota met in
a regular meeting on Tuesday, September 4, 1973 at 8:00 o'clock P.M.
in the Council Chambers of the City Hall.

Members present: Councilmen Novak, Collins, Kramer, Hallberg,
Schnirring, O'Connor, Fischer, Driscoll and
Mayor Petersen.
Members absent: None
Minutes of the last meeting were read and approved.
Councilman Kramer introduced the following resolution and moved its
adoption: BID FOR ONE SQUAD CAR
WHEREAS: pursuant to an advertisement for bids for furnishing
the City with one (1) Squad Car for the Police Department, the following
bid was received complying with the advertisement.

RESOLUTION REGARDING AGREEMENT BETWEEN THE UNITED STATES OF AMERICA
AND THE CITY OF HASTINGS, MINNESOTA FOR LOCAL COOPERATION AT THE
VERMILLION RIVER FLOOD CONTROL PROJECT.
Councilman Hallberg moved the following resolution be adopted:
THIS AGREEMENT entered into this 4th. day of September 1973 by and
between the UNITED STATES OF AMERICA (hereinafter called the "Government"),
represented by the Contracting Officer executing this agreement, and the City
of Hastings, Minnesota, (hereinafter called the "City"), the City WITNESSETH
THAT:
WHEREAS, construction of the Vermillion River Flood Control Project
at Hastings, Minnesota, (hereinafter called the "Project") was authorized by
the Flood Control Act approved 30 June 1948, (Public Law 858) 80th Congress,
2nd. session; and

WHEREAS, the City represents that it has the authority and
capability to furnish the non-Federal cooperation required by the Federal
legislation authorizing the Project and by other applicable law.
NOW, THEREFORE, the parties agree as follows:

1. The City agrees that, if the Government shall commence construction of
the Vermillion River Flood Control Project at Hastings Minnesota, substan-
tially in accordance with Federal legislation authorizing such Project,
Section 205 of the 1948 Flood Control Act, as amended, the City shall, in
consideration of the Government commencing construction of such Project,
fulfill the requirements of non-Federal cooperation specified in such
legislation, to sit:
a. Provide without cost to the United States all lands, ease-
ments, and rights-of-way necessary for the construction and subsequent
maintenance of the Project when and as required.
b. Hold and save the United States free from damages due to the
construction of the Project.
c. Maintain and operate all of the Project works, including the
beautification measures, in accordance with regulations prescribed by the
Secretary of the Army.
d. Provide without cost to the United States all alterations and
relocations of existing improvements including bridges, highways, building,
utilities, sewers, and any other special facilities resulting in a local
betterment, except as otherwise warranted for special reasons.
e. Prevent any encroachment on construction works and other
Project features that would interfere with the proper functioning of the
Project.
f. Assume full responsibility for all Project costs in excess
of the Federal cost limitation of $1,000,000.
g. Provide payments and services as required by Sections 210 and
305 of the Uniform Relocation Assistance and Real Property Acquisition
Policies Act of 1970, Public Law 91-646.
h. Assure that within a reasonable time prior to displacement
decent, safe, and sanitary replacement dwellings will be available to
displaced persons.
i. Assure that in acquiring real property the sponsors will be
guided to the greatest extent practicable under State law by the Land
Acquisition Policy in Sections 301 and 302 of Public Law 91-646 and that
property owners will be paid or reimbursed for necessary expenses as spec-

j. Either preclude future construction within Hastings alond
the Vermillion River and other unprotected areas of the City or regulate
construction within these areas in a manner which would prevent flood
damage to future construction from all floods of magnitudes equal to or
less than that of a flood which would have a I-percent chance of being
equaled or exceeded during any single year.
2. Pursuant to Section 221 of the Flood Control Act of 1970, Public Law
91-611, the City shall grant the Government a ri~ht to enter upon, at
reasonable times and in a reasonable manne~, lands which the City owns or
controls, for access to the Project for the purpose of inspection, and for
the purpose of completing, repairing and maintaining the Project, if such
inspection shows tha~ the Ci,ty for any rea;~n is, fap~~g to repair and
maintain the Project in accd~dance with the assurances hereunder and has
persisted in suth' failure' after a reaso'nabie notice in writing by the
Government delivered to the Mayor of the City. No repair and maintenance
by the Government in such event shall operate to relieve the City of respon-
sibility to meet its obligations as set forth above, or to preclude the
Government from pursuing any other remedy at law or equity.
3. This agreement is subject to the approval of the Secretary of the
Army.
IN WITNESS WHEREOF, the parties hereto have executed this contract

ORDINANCE PROVIDING FOR AND CREATING THE OFFICE OF
ADMINISTRATOR FOR THE CITY OF HASTINGS
WHEREAS, The City Council of the City of Hastings is of the belief
that the operation and functioning of the City would be improved and better
coordinated by the creation of the Office of City Administrator, and that
the administrative details of the City would be more efficiently and
economically handled by the creation of the Office of City Administrator;
NOW, THEREFORE, IT IS HEREBY ORDAINED by the City Council of the
City of Hastings, as follows:
That the Office of City Administrator is hereby created in the
City of Hastings;
That the City Administrator shall be appointed by the Council on
the basis of his training, experience and administrative qualifications;

That the duties of the City Administrator shall be as follows:
a. Exercise control and superVI.SlOn over all departments of the City
(except the Police Department) and coordinate the activities of
consultants and advisory bodies. Exercise control and supervision
of the Police Department in accordance with the direction of the
Mayor.
b.
Submit to the Council recommendations relative to the appointment and
removal of all employees of the City on the basis of merit, and act
as Personnel Officer being responsible for the implementation of City
personnel policy.

c. Secure the enforcement of all laws, ordinances and resolutions of the
City and of the State as they apply to the City, and make recommenda-
tions for changes or additions to ordinances when necessary.
d. Attend all special and regular meetings of the Council and actively
participate in such meetings in all respects, except voting.
e. Prepare and submit to the Council the proposed annual budget, and
enforce and administer all provisions of the adopted budget.
f. Submit reports to the Council on City finances, budget status and
administrative activities on a regular basis.
g. Supervise the preparation and coordination of and submit to the Council
the annual and long-range work programs of the departments of the City.
h. Keep the Council advised as to the future needs of the City and make
recommendations on long-range promotion of community welfare.

Familiarize himself with alternate and supplemental sources of revenue,
including but not limited to federal and state aids, loans, grants and
other sources of revenue, and prepare and submit proposals to the
Council and other appropriate agencies of the City recommendations for
actions necessary to fully take advantage of such sources.

j. Personally maintain amicable relations with City employees and the
Public and promote such relations between the City Council and its
employees and constituents and adjoining and overlapping governmental
entities.
k. Recommend to the Council any other measures required for the efficient
administration of City affairs and promotion of community welfare.

the City Clerk be authorized to advertise in the League of Municipalities
magazine" the American Cities Magazine and it was also suggested that every
City and Village Engineer that is a member of the City and Village Engineers
Association of Minnesota be sent copies of an application and also the advertise-
ment for the Engineer Position.

Mr. DuWayne Kasma from the consulting firm of Toltz, King, Duvall, Anderson &
Associates be appointed Acting City Engineer beginning October 1, 1973.

by and between the City of Hastings, a Municipal Corporation, hereinafter
called "Lessor", and the County of Dakota, a Municipal Corporation, herein-
after called "Lessee".
WITNESSETH, Lessor, in consideration of the rents and covenants here-
inafter mentioned, does hereby demise, lease and rent unto the Lessee, and
the Lessee, does hereby hire and take from the Lessor, the following described
premises, situated in the City of Hastings, County of Dakota and State of
Minnesota, to wit:
The area in the Municipal Building of
Hastings located at 100 Sibley Street,
Hastings, Minnesota, designated now as
the Court Facilities, including the Clerk
of Court's Office, Judge's Chambers, Court
Room, Court Reporter's Office, two
Attorney's Conference Rooms and also the
use of all entryways, stairways, lavatories
and accesses to said premises, said space
being approximately 2,686 square feet.
NOW THEREFORE, In consideration of the above described premises and
of the agreements and covenants herein, the parties hereto agree as follows:
1. Lessor leases to Lessee the premises to be used by Lessee for
the purposes of the County Court for a term beginning July 1, 1973, and ending
June 30, 1974, together with uses in common with others of the public hallways,
corridors and like facilities.
2. Lessor, however, reserves the right to use the premises after
normal business hours of the County Court, and at 'other times when not in use
by the County Court for city functions including City Council and Planning
Commission meetings, and various staff meetings. Lessor further agrees that
upon completion of this use after business hours, the premises shall be returned
to the same conditic. "'s it was prior to the commencement of the particular city
proceedings.
3. Lessor shall furnish heat, light, air conditioning and janitor
service, and shall be responsible for making any necessary repairs, but shall
not be required to effect any improvements to the premises.

4. For the period July 1, 1973, to June 30, 1974, Lessee shall pay
to Lessor as rent for the premises the sum of Six Thousand Six Hundred Dollars
($6,600.00) payable in equal quarterly installments on the first day of each
quarter in advance.
5. Lessee will not make any alterations in or additions to the
premises without the written consent of Lessor first had and obtained.
6. Lessor shall maintain adequate security about said premises to
protect any of Lessee's property situated on said premises from harm or injury
after normal business hours of the County Court; however, Lessor shall not be
liable for the loss of such property which is due to fire, windstorm or theft.
7. Lessor shall not be liable for any stoppage of heat, air con-
ditioning or janitor services or of any part of mechanical plant of the
building, not directly due to a lack of ordinary care by Lessor, or arising
from riot, strike, unavoidable accident, or other like or unlike causes beyond
the control of Lessor or for stoppage thereof for needful repairs or for
improvements, providing Lessor uses reasonable diligence to resume such service.
8. If during the duration of this lease the demised premises should
be so injured by fire or other casualty as to be rendered untenantable then,
and if such injury be not promptly repaired by Lessor, it shall be optional
with either party hereto to cancel this agreement by notice in writing to the
other party given fifteen (15) days after election of Lessor not to repair,
and in case of such cancellation rent which has become due to date of such
fire or casualty shall be paid. If Lessor repairs such injury, rent or a
just and proportionate part thereof, according to the nature and extent of
the injury, shall be rebated until the premises have been repaired by Lessor.
9. Lessee will keep and maintain the premises during the afore-
mentioned said term, and quit and deliver up said premises to Lessor peaceably
and quietly at the end of the ~foresaid term or at any previous termination
thereof, in as good order and condition and state of repair, rea~onable use
and wearing thereof and inevitable accidents excepted, as the same now are or
may be put into by Lessee.

10. Lessor further agrees that upon the termination of this agr~e-
ment, that it will reserve to the Lessee the option to lease the above
described premises on a quarter to quarter basis under the terms and con-
ditions above described until December 31 t 1974.
IN TESTIMONY WHEREOF, The said parties have signed, sealed and

The Mayor read a letter to the City Council asking them to
re-appoint James Caturia as Commissioner of the City of Hastings Housing
and Redevopment Authority for a five year term pursuant to M.S.A. 462.425
Sub-Divisions 6 & 7.
Moved by Councilman Novak, seconded by Councilman Driscoll to
confirm the Mayor's above appointment of James Caturia. Ayes, all; Nayes, none.
Moved by Councilman Driscoll, seconded by Councilman Fischer to
re-appoint to the City of Hastings Charter Commission: Donald G. Anderson,
Anthony Kramer, Edward Sontag and Joseph Kugler for a four year term effective
August 1, 1973 and that the above names be recommended to the Chief District
Judge of Dakota County.

Part or all of the following described area shall be assessed for
oversizing watermain and storm sewer facilities:

westerly of Pleasant Drive.

The proposed assessment roll is now on file in the Office of the City Clerk
and is open for public inspection to all persons interested. Each of said
assessments will be payable, unless prepaid, in ten (10) equal consecutive
annual installments, the first such installment to be payable with general
taxes for the year 1974 and collectable with such taxes during the year 1974.
The total amount to be assessed on 1973 Improvements is $480,932.50.
Assessments shall be proportionate to the benefits to be derived by said
improvements. ' ".
AND WHEREAS, The Clerk has notified the Council'thatsuch proposed assessments
have been completed and filed in his office for public inspection and the
proposed amount to be assessed is $480,932.50.

1. A hearing shall be held on the 1st day of October, 1973 at
7:00 o'clock P.M. in the Council Chambers of the City Hall to pass upon such

reference to such assessments.
2. The City Clerk is hereby directed to cause a notice of the
