November 19, 1973
The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, November 19, 1973 at 7:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present:
Councilmen Collins, Schnirring, Hallberg,
Fischer, Driscoll, Novak and Mayor Petersen.

Members absent:
Councilmen Kramer and O'Connor.
Minutes of the last meeting were read and approved.
The Mayor declared open the Public Hearing on Robert Frembgen's
request for a Variance in accordance with Section 9.15 "District Lot
Regulations" of the City Zoning Ordinance dated December 7th, 1970 to con-
struct a fireplace chimney on Lot 10, Block 5, Oak Park Addition in the
City of Hastings.
No one appeared in opposition to the Variance, the Mayor declared
the Hearing closed.
Moved by Councilman Driscoll, seconded by Councilman Schnirring
to approve the Variance for the above described property, in accordance
with Section 12. 3.1.3 and Section 12. 3.1.3 of the Zoning Ordinance dated
December 7th, 1970. Ayes: all, Nayes: none.
Councilman O'Connor came in at this time.
Councilman Driscoll introduced the following resolution and moved
its adoption.

WHEREAS, pursuant to an advertisement for bids for furnishing the
City with one (1) Dump Truck for the Street Department, the following bids
were received complying with the advertisement:

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Hastings, Minnesota:

The Mayor and City Clerk are hereby authorized and directed to
enter into a contract with Schneider Implement Company for the purchase of
one (1) Dump Truck according to the specifications therefore approved by the
City Council and on file in the office of the City Clerk.

Councilman Fischer seconded the motion to adopt said resolution
and the same was passed by the following vote: Ayes; all, Nayes; none.

Pursuant to an advertisement for bids for furnishing the City
with one (1) Tandem Steel Roller for the Street Department, the following
bids were received complying with the advertisement.

Moved by Councilman Hallberg, seconded by Councilman Novak to
hold over awarding the bids until the next regular meeting on December 3rd.

Moved by Councilman Schnirring, seconded by Councilman Collins
that the application for a Cigarrette License from Smead Manufacturing Co.
be approved. Ayes; all, Ayes, none.
Moved by Councilman Novak, seconded by Councilman Driscoll that
Horan and Associates be hired as Architect for the Hockey Arena subject to
their submitting a Contract to the City of Hastings for Council approval
at the December 3rd. meeting. Ayes; all, Nayes; none.
Moved by Councilman Novak, seconded by Councilman Driscoll that
Marge Voelker, Joseph Kugler and Anthony Willeke be re~appointed to the
Library Board for a period of three years. Ayes; all, Nayes; none.
Moved by Councilman Fischer, seconded by Councilman Hallberg
that the letter read by the City Clerk from Calvary Baptist Church
requesting a special use permit for the purpose of establishing a day
care center on the premises of Calvary Baptist Church, 15th and Pine
Streets be referred to the Planning Commission. Ayes; all, Nayes, none.

Moved by Councilman Novak, seconded by Councilman Schnirring that
the City Clerk be and hereby is authorized and directed to advertise for
bids for a Vehicle for the Engineering Department, with specifications on
file in the City Clerk's Office. Bids to be opened on Monday, December 3rd.
at 2:00 p.m. Bids to be awarded on December 3, 1973 at 8:00 o'clock P.M.

The City Council held a discussion regarding the putting up of the
Christmas decorations and lights and questioned whether the lights should be
turned on because of the Energy shortage. Following discussion it was
moved by Councilman Hallberg, seconded by Councilman Driscoll that the Lights
and Decorations be placed on the poles and the Lights be turned on December
21st and turned off December 26th. Ayes; all, Nayes; none.

Moved by Councilman O'Connor, seconded by Councilman Hallberg that
a Public Hearing be held on Monday, December 3rd, 1973 at 8:00 P.M. in the
Council Chambers of the City Hall and that the following notice be published
mailed and posted as required by the City Zoning Ordinance. Ayes; all, Nayes;
none.
NOTICE OF PUBLIC HEARING

Notice is hereby given that the City Council of the City of
Hastings, Minnesota will meet in a Public Hearing on Monday, December 3, 1973
at 8:00 o'clock P.M. in the Council Chambers of the City Hall to consider
the following variance request from the City Zoning Ordinance.
Variance from Section 9.15 District Lot Regulations.
Variance request for Lot 10, Blokk 1, Dakota Hills to construct a
fireplace chimney.
Persons desiring to be heard in reference to this variance may be heard at
this time.

Discussion was held on condition of the auxiliary shed located at
511 West Fourth Street, Hastings, Minnesota. Reports were received from the
City Attorney who relayed information from the fire marshall and building
inspector on the condition of the structure. It was further stated that the
owner had agreed that the structure was in a delapidated condition and re-
moval warranted. A photograph was received and reviewed.

Councilman Fischer moved, and Councilman Driscoll seconded the
motion to declare the aforedescribed structure hazardous, de1apidated and a
fire and public safety hazard. Further, that pursuant to Chapter 393 of the
laws of 1965 (M.S.A. 463.15 Etseq) that the Council order the above hazardous
structure to be razed within thirty (30) days from the date of the service of
this order upon the owner. Further,that if the owner agrees, the same may be
forthwith demolished by the City or under the City's direction, and the costs
thereof paid by the City. Further, that the owner be advised that if the
City does accomplish said razing, that the costs incurred by the City may be
assessed against the real estate and collected as other taxes. The vote was
as follows: Ayes, all, Nayes; none.
Moved by Councilman Driscoll, seconded by Councilman Fischer that
the request for a Barbed Wire Variance, subject to Section 5.6 of the Zoning
Ordinance of the City of Hastings dated December 7, 1970 for Smead Mfg. Co.
600 E. 10th. St. and Louis "Jim" Hoffman, Wilfred Lehmann and Paul B. Meiers
property located on Highway #91 be referred to the Planning Commission.
Ayes; all, Nayes; none.
Moved by Councilman Hallberg, seconded by Councilman Fischer that
the bills as audited be approved and the City Clerk be instructed to issue warrants
for the same. Ayes; all, Nayes; none.
